HomeMy WebLinkAbout05-05-1986 MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING MAY 5, 1986 CALL TO ORDER' Meeting called to order at 8 00 P M by Joe W. Jackson, Mayor. ROLL CALL By City Clerk. Councilmen present were Susan Boothe, Ed Hendler, Beverly Green, Lee Kraft, Joe Jackson, E.A. Snider and Emerson Morgan. Also present were Gary Crutchfield, City Manager, Greg Rubstello, City Attorney, Jerry Conner, Director of Finance, James Ajax, Director of Public Works, Donald Francis, Chief of Police, David McDonald, Director of Community Development and Webster Jackson, Personnel/Purchasing Supervisor. CONSENT AGENDA Mr Snider moved to approve Consent Agenda. Seconded by Mr. Hendler, Motion carried. Consent items are as follows a) Approval of Minutes. To approve minutes of regular meeting, held April 21, 1986 b) Bills To approve General Claims in the amount of $210,541.31, Claim Warrant Nos 50250 through 50395. To approve Payroll Claims in the amount of $280,868 00, Payroll Voucher Nos 7419 through 7587, and 7588 through 7753 To approve bad debt write-offs in the amount of $2,470.35 and, of this amount, authorize $1,899 53 be turned over for collection. c) Resolution No 1728 A Resolution of the City of Pasco, authorizing and directing the Mayor to sign Supplement No 1 to the Municipal Agreement between the City of Pasco and the State of Washington (for Federal Highway Administration Programming for Funds). d) Resolution No. 1729 A Resolution accepting work by Sharpe and Preszler Construction, Inc. under contract for Project No. 86-3-03, the 18th Avenue Storm Drain e) Resolution No 1730. A Resolution fixing the time and place for a public hearing to consider the vacation of certain street and alley rights-of-way within the City of Pasco (Frey's Addn ) f) Damage Claim of Maria Cepeda To deny the claim for damages filed by Lilia Gomez on behalf of Maria Cepeda g) Sale of Golf Course Residential Land To approve the Action Plan for the sale of,all or part of the Golf Course Residential Land and, further, authorize the City Manager to solicit proposals for engineering services, MM appraisal services, and letters of purchase interest h) Appointments to Park & Recreation Advisory Council To confirm the Mayor's appointments of the following to three vacancies on the Parks and Recreation Advisory Council, consisting of 3-year terms which will expire on February 2, 1989 Bill Farrens Carol Hackwith (unexpired term of Geraldine Linton) Eugene Van Sickle (unexpired term of Grant Stringham). REPORTS FROM COMMITTEES AND/OR OFFICERS Benton-Franklin Governmental Conference. Councilman Beverly Green reported that a 20-year Anniversary party is being planned in recognition of all past and present Board Members. Don Morton will give an update of what is going on at the Conference. MINUTES PASCO CITY COUNCIL REGULAR MEETING MAY 5, 1986 PUBLIC HEARINGS Cable Television Rate Increase Proposal. Mr. Hendler moved to continue the public hearing regarding the Cable Television rate increase until 8 00 P.M., Monday, May 19, 1986, pending completion of consultant's report Seconded by Mr. Kraft. Motion carried III ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS A RESOLUTION OF THE PASCO CITY COUNCIL OPPOSING THE REDUCTION OF RAIL PASSENGER SERVICE IN THE STATE OF WASHINGTON. Resolution No. 1731 was read by title only. Mr. Snider moved to approve Resolution No. 1731, opposing the reduction of rail passenger service in the State of Washington Seconded by Mr. Morgan. Motion FAILED by the following roll call vote YES Morgan and Jackson. NO Boothe, Hendler, Green, Kraft and Snider. ORDINANCE NO. 2597- AN ORDINANCE ESTABLISHING PENALTIES FOR PARKING INFRACTIONS AT THE TRI CITIES AIRPORT, AND CREATING NEW SECTION 10.94.020 OF THE PASCO MUNICIPAL CODE Ordinance No. 2597 was read by title only Mr. Snider moved that the City Council adopt Ordinance No 25971 an Ordinance establishing penalties for parking infractions at the Tri Cities Airport, and creating new Section 10.94.020 of the Pasco Municipal Code. Seconded by Mrs Boothe. Councilman Snider expressed concern that it was a Pasco Airport, paid for by citizens of Pasco and he felt revenue derived should come to Pasco Councilman Hendler stated that the City of Richland had been a large contributor in the construction of new airport facility Councilman Green reiterated she had several complaints on conduct of officers at the Airport and felt they should use more decorum and courtesy Main motion carried ORDINANCE NO. 2598 AN ORDINANCE ESTABLISHING A PARKING INFRACTION FOR VIOLIATION OF A HANDICAP ORDINANCE 'ESTABLISHING A PARKING INFRACTION FOR VIOLATION OF A HANDICAP Ordinance No 2598 was read by title only Mr. Kraft moved that the City Council adopt Ordinance No. 2598, an Ordinance establishing a parking infraction for violation of a handicap parking place and creating new Chapter 10.58 to the Pasco Municipal Code. Seconded by Mrs Boothe. A brief discussion ensued on what constituted a handicapped person, either permanent or temporary, and the City Attorney gave a legal opinion on the issue Main motion carried. ORDINANCE NO. 2599 AN ORDINANCE DECLARING PARKING VIOLATIONS TO BE CIVIL INFRACTIONS, SETTING PENALTIES FOR VIOLATIONS, ADDING NEW SECTION 10.16 135 TO THE PASCO MUNICIPAL CODE; REPEALING PMC SECTIONS 10.16 070, 080, 100, AND AMENDING SECTION 10.16.090 Ordinance No 2599 was read by title only. Mr. Hendler moved that the City Council adopt Ordinance No 2599, an Ordinance concerning parking violations Seconded by Mr. Snider. Motion carried RESOLUTION NO. 1731 I I MINUTES PASCO CITY COUNCIL REGULAR MEETING MAY 5, 1986 ORDINANCES/RESOLUTIONS - Continued RESOLUTION NO. 1731 (Reassigned Number) A RESOLUTION IN RECOGNITION AND APPRECIATION OF THE GREATER PASCO AREA CHAMBER OF COMMERCE, THE "BLUE BRIDGE CLOSURE COMMITTEE", AND THE CONTRIBUTION OF MANY Resolution No. 1731 was read by title only. Mr Hendler moved to approve Resolution No. 1731, in recognition and appreciation of the Greater Pasco Area Chamber of Commerce, the "Blue Bridge Closure Committee", and the contribution of many Seconded by Mr. Snider. Seconded by Mr. Kraft. Motion carried. MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL Mayor Jackson read the following prepared statement to Greg Rubstello, City Attorney "On behalf of the City Council, I wish to express my sincere appreciation for the staff effort, particularly that of City Attorney Greg Rubstello, to establish the ability to produce and maintain internally, the Pasco Municipal Code That effort has not only produced a more readable and more efficiently updated Code Book for the organization and community at large, but has also eliminated a $6,000 annual expenditure for external updating. Thank you and the other staff members for your efforts - they are sincerely appreciated " North Oregon Widening. James Ajax, Director of Public Works, distributed information letter, requesting permission to bid grindings (existing asphalt) as an alternate to the asphalt treated base the City Staff was planning to use on Hillsboro and North Oregon Avenue. With asphalt treated base, our budget limits the project to an average depth of 2 3/4 inches varying from a minimum of two inches to a maximum of 3 1/2 inches. At approximately the same cost, we may be able to put down an average depth of 4 1/2 inches varying from a minimum of 3 inches to a maximum of 6 inches. I MINUTES PASCO CITY COUNCIL REGULAR MEETING MAY 5, 1986 MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL - Continued 1) If we are to proceed immediately - call for bids May 12th - open bids on May 27th and award May 27th. 2) Replace $135,000 of Federal money budgeted for the project with $135,000 of one-half cent gas tax source, $70,000 from money the City is getting back from 10th and 14th intersections with Sylvester, $65,000 from money originally assigned to 20th and "A" intersection project which has been abandoned. 3 ) If grinding alternative is accepted, be prepared to accept criticism from other contractors that they could not compete. Our City Attorney says what is being proposed is legal Mr. Snider moved that staff call for bids on North Oregon Avenue Widening, and bid using grindings as an alternate Seconded by Mr Hendler. Motion carried Golf Course Advisory Councilman Ed Hendler reported that Golf Course Advisory Committee met this date and recommended hiring Mark Pence as architect for new proposed Golf Club House. Further, he moved they be allowed to proceed with preliminary design and cost estimates up to $3,000, charging expense to Golf Course Fund, and bring it back to council for formal action. Seconded by Mr. Kraft. Motion carried by roll call vote of seven (7). Absence of Ed Hendler. Mr. Hendler reported he would be absent at the next Workshop Meeting of the City Council as he will be out of town Gambling in City Parks, etc. Councilman Beverly Green expressed concerns over children gambling in public parks, etc and asked if tighter restrictions could be applied. Staff will check into this problem and report back. I
