HomeMy WebLinkAbout03-18-1985 MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING MARCH 18, 1985 CALL TO ORDER Meeting called to order at 8 00 P M by Joe W Jackson, Mayor ROLL CALL By City Clerk Councilmen present were Susan Boothe, Beverly Green, Charles Grigg, Ira Schmidt, E A Snider, Joe Jackson and Emerson Morgan Also present were Gary Crutchfield, City Manager, Greg Rubstello, City Attorney, Jerry Conner, Finance Director, James Ajax, Director of Public Works and Max Bigby, Assistant Planner CONSENT AGENDA Mr Snider moved to approve Consent Agenda Seconded by Mrs Schmidt Motion Carried Consent items are as follows a) Approval of Minutes To approve minutes of regular meeting, held March 4, 1985 ( b) Bills TO approve General Claims in the amount of $168,389 09, claim warrant nos 41643 through 41812 c) Request to Connect to Road 36 Sanitary Sewer To authorize staff to modify the service area of the Road 36 sanitary sewer to include the area between Court Street and Brown Street from Road 38 to Road 40 d) Old Street Department Asphalt Distributor - Authorization to Sell To authorize staff to sell by competitive bid, the Street Department's old trailer-type asphalt distributor, subject to receiving a responsive bid in at least the amount of $200 e) Lease of City Property for Farming Purposes To approve the revised agreement with Tippett Land and Mortgage Company to lease City property for farming purposes, under the specifications delineated therein f) Authorization to Call for Bids - Park Department Equipment To authorize staff to call for bids for three (3) pickups, one (1) flatbed truck, one (1) greensmower, one (1) turf vac sweeper, and one (1) utility vehicle These items of equipment are replacements for existing equipment and will be purchased through the Equipment Rental Fund VISITORS There were no visitors wishing to address the council at this time REPORTS FROM COMMITTEES AND/OR OFFICERS (Given during Workshop Session) Tr-Mats Policy Advisory Beverly Green reported that the main topic of discussion was closure of blue bridge for renovation when both lanes of 1-182 bridge are opened It was suggested that the State look at design of Lewis Street exit and what alternatives are available Good Roads Association The new interstate was discussed and the fact that there are 9,000 fewer cars using the blue bridge daily since 1-182 bridge opened Ben-Franklin Transit Authority Joe Jackson stated that our present "Dial-a-Ride" Program was reviewed and age eligibility was raised from 60 to 65 years of age Further, subsidy was raised from $1 25 to $1 30 Councilman Snider felt our "senior citizens" had paid for this service with their taxes and as far as he was concerned, "they could ride free " Arvid Grant Award Councilman E A Snider presented a copy of award given to Arvid Grant & Associates for design excellence (new cable stay bridge) to Mayor Joe Jackson, and asked that it be framed and hung in a suitable place of honor Staff will comply MINUTES PASCO CITY COUNCIL REGULAR MEETING MARCH 18, 1985 PUBLIC HEARING MAYOR JACKSON DECLARED THE PUBLIC HEARING OPEN TO DETERMINE APPROPRIATE ZONING FOR PROPERTY RECENTLY ANNEXED TO CITY (THOMAS KIDWELL, RD 36 - 40, WEST COURT) It was noted that the hearing had been duly published and all affected property owners notified of said hearing Mr Max Bigby gave the following brief statement "On February 21, 1985, the Planning Commission conducted a hearing to determine appropriate zoning for the recently annexed Kidwell area After conduct of the hearing, the Commission concluded a strict interpretation of the Comprehensive Plan appropriate and recommended that Council assign zoning accordingly Mr Kidwell, a property owner within the annexed area, has appealed the Commission's recommendation, requesting Council assign a zoning pattern different than that recommended by the Planning Commission The predominant considerations by the Planning Commission were to implement the nodal commercial development concept and to halt strip commercial development in accordance with the comprehensive plan The resulting recommended zoning pattern reflects a "stringent" nodal commercial development concept The appealing property owner desires a more "liberal" interpretation of the commercial node at Road 36, 1 e , more commercial zoning and less office zoning The City Clerk read letters opposing "Office" zoning from property owners, Bill D Hatfield and Art Klinginsmith They favored Franklin County commercial zoning, as originally assigned, in order to develop their property Councilman Snider stated he could recall previous annexations whereby the City adopted County zoning when a new area was annexed to the City and he was concerned why we were changing this particular area Councilman Beverly Green reiterated that we are discouraging annexation when we put such stringent zoning requirements into effect Mr Tom Kidwell, 4320 Riverhaven, favored commercial zoning as it would be more usable and less restrictive as far as attracting new businesses in the area Mr Ernie Boston, realtor and representing Bousman and Cornell properties, passed out literature to each councilman depicting size of each parcel and reputed owner He called attention to the fact that one property owner could own two parcels - one zoned commercial and the other zoned office under proposed guidelines This would create an impossible situation in the development of one's property Further, "office" zoning was too restrictive He encouraged the Council to retain present C-1 zoning for the entire area Councilman Grigg was not opposed to C-1 zoning, but he had reservations about Court Street becoming another "Clearwater Avenue" with street cuts every 75' or so This would create traffic congestion in annexed area as well as hazardous pedestrian crossing for school children nearby Councilman Snider stated he could see no reason to send this request back to the Planning Commission again The petitioner had already been heard by Planning Commission, had subsequently requested a hearing before the City Council on an appeal basis, therefore, a decision should be made Councilman Morgan concurred with this logic by stating that it was time to "stand up and be counted " Earl Warren, Vice Chairman of the Planning Commission, stated that his decision would have been much different had he been aware of information submitted by Mr Boston Following three (3) calls from Mayor Jackson for further comments from the floor, either for or against, the public hearing was declared closed Mr Snider moved to direct staff to prepare an Ordinance, rezoning the entire package C-1, incorporating Mr Grigg's concerns relating to number of driveway cuts, and have it ready for next regular meeting of the City Council Seconded by Mr Schmidt Motion carried III ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS MINUTES PASCO CITY COUNCIL REGULAR MEETING MARCH 18, 1985 PUBLIC HEARING - Continued I ORDINANCE NO 2538 AN ORDINANCE CONCERNING THE UTILITIES OCCUPATION LICENSE TAX AND AMENDING SECTION 5 32 050 OF THE PASCO MUNICIPAL CODE Ordinance No 2538 was read by title only Mr Grigg moved to adopt Ordinance No 2538, amending the reporting and remittance date requirements for City Utility Tax Seconded by Mr Snider Motion carried (the following correspondence from Columbia Cable is acknowledged for the record ) "I have no objection to your move to monthly payment of the City's Utility Tax We have been paying on a monthly basis in the past, and will continue to do so A thirty-day pay- ment window would be more practical for us The payment check is originated out of State in our Corporate accounting office, based on reports generated here Because of this paper flow, thirty days would appear to be a more realizable deadline " /s/ Ronald A Asplund ORDINANCE NO 2539 AN ORDINANCE CONCERNING SIDEWALK FOOD SERVICE AND AMENDING CHAPTER 5 28 OF THE PASCO MUNICIPAL CODE BY ADDING NEW SECTION 5 28 125 Ordinance No 2539 was read by title only Mr Snider moved to adopt Ordinance No 2539, authorizing the issuance of permits for a sidewalk food service in accordance with certain standards Seconded by Mr Schmidt Motion carried NEW BUSINESS Pasco Fall Harvest & Arts Festival. Mr. Snider moved that the City Council concurs in the general idea of supporting the Festival and commits up to $5,000 of hotel/motel tax funds for documented promotional expenses of the Pasco Fall Harvest and Arts Festival. Seconded by Mrs. Green Motion carried Maintenance & Inspection Manual for Pasco/Kennewick Intercity Bridge Mr Smider moved that the City Council authorize staff to recommend Arvid Grant and Associates for the preparation of the Maintenance and Inspection Manual for the Pasco/Kennewick Intercity Bridge (Cable Bridge) to the Washington State Department of Transportation Seconded by Mr Schmidt Motion carried Interfund Loan from Fire Pension Fund to LID 118 Mr Grigg moved to authorize an Interfund Loan of $259,000, with interest at 8 95%, from the Fire Pension Fund to LID 118, to be repaid out of proceeds from the issuance of Consolidated LID 117 and 118 bonds Seconded by Mr Snider Motion carried by roll call vote of seven (7) Court Street Signals, LID 119, Project No 82-4-02 Mr Snider moved to authorize staff to call for bids on LID 119, Court Street Signals, Project No 82-4-02 Seconded by Mrs Green Motion carried MINUTES PASCO CITY COUNCIL REGULAR MEETING MARCH 18, 1985 NEW BUSINESS - Continued 10th Avenue ("A" Street to Clark Street) Traffic and Street Improvements Mr Schmidt moved to authorize the Mayor to sign the preliminary proposal prospectus for the UAB funding consideration on the 10th Avenue proposed improvement project Seconded by Mrs Boothe Motion carried MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL Mrs Green asked if another tour of the City could be arranged, particularly, the Old McLoughlin School Staff will check into this ADJOURNMENT No further business, the meeting adjourned at 9 00 P M The W son, Mayor (Evel-yn—Well , City Clerk PASSED and APPROVED this day of , 1985
