HomeMy WebLinkAbout06-18-1984 MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING JUNE 18, 1984 CALL TO ORDER Meeting called to order at 8 00 P M by Ira L Schmidt, Mayor Pro Tern (Mayor Jackson arrived at 8 05 P M ) ROLL CALL By City Clerk Councilmen present were Beverly Green, Charles Grigg, Ira Schmidt, E A Snider, Joe Jackson (8 05 P M ), and Emerson Morgan Council person Susan Boothe was absent from the meeting (excused) Also present were Lee Kraft, City Manager, Greg Rubstello, City Attorney, Jerry Conner, Finance Director, Dennis Wright, City Engineer, Richard Erickson, Director of Parks/Recreation, Larry Dickinson, Acting Fire Chief, Webster Jackson, Purchasing/Personnel Supervisor and Gary Crutchfield, Director of Community Development CONSENT AGENDA Mrs Green moved to approve Consent Agenda Seconded by Mr Snider Motion carried Consent items are as follows a) Approval of Minutes To approve minutes of regular and special meetings, held June 4th and 11, 1984, respectively b) Bills To approve General Claims in the amount of $284,683 48, Claim warrant nos 38826 through 38965 c) Court Collection Contract To authorize the Mayor to execute an agreement on behalf of the City with Hanford Collectors, Inc , for a two-year term to provide collection services to the Pasco Police Court, with the new agreement to encompass Attachment "A" as presented at the Council Workshop on June 11, 1984 d) Waiver Utility Service Requirement, PMC Chapter 16 06 (83-09 RADA) To grant a waiver from the utility service requirement of PMC Chapter 16 06, provided the owner executes a written agreement binding the property (1) To equitably participate in any future L I D , (2) To equitably participate in any privately financed utility extension by an abutting property, (3) To connect to utilities at the discretion of the City VISITORS There were no visitors wishing to address the council at this time PUBLIC HEARING MAYOR JACKSON DECLARED THE PUBLIC HEARING OPEN TO RECEIVE INPUT AND COMMENTS ON PROPOSED 1985-1990 SIX-YEAR STREET CONSTRUCTION PROGRAM FOR THE CITY OF PASCO It was noted that the hearing had been duly publicized, as required by law There were no written communications received Mr Dennis Wright, City Engineer, gave the following history and facts brief "Each year, all cities are required to submit a Six-Year Street Construction Program The proposed projects in terms of cost must reasonably equal anticipated revenue The revenue picture for the coming year remains better than in the past few years due to the accumulation of money in the City's Overlay Fund, increase in Gas Tax Funding, funding of the Urban Arterial Program, and the continuation of Federal Highway Funding Programs Last year, staff noted that four projects needed immediate attention Those projects were 20th Avenue (By-Pass to Airport), East Lewis (Wehe to Avery), Oregon Avenue Extension (A to Ainsworth) and 10th Avenue (A to Clark) Two of the projects - 20th Avenue and 10th Avenue, are in the works, leaving Oregon Avenue and East Lewis To those two projects, we have added 4th Avenue from Sylvester to Court and Oregon Avenue from the By-Pass to the north City limits The remainder of the program includes traffic signal projects and overlay program from last year, as well as three proposed L I D 's " MINUTES PASCO CITY COUNCIL REGULAR MEETING JUNE 18, 1984 PUBLIC HEARING - Continued Following three (3) calls from Mayor Jackson for further comments from the floor, either for or against, the public hearing was declared closed RESOLUTION NO 1633 A RESOLUTION ADOPTING A REVISED AND EXTENDED COMPREHENSIVE STREET PROGRAM FOR THE CITY OF PASCO Resolution No 1633 was read by title only Mr Grigg moved to approve Resolution No 1633, establishing the Six-Year Street Construction Program for calendar years 1985 through 1990 Seconded by Mr Snider Motion carried ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS ORDINANCE NO 2505 AN ORDINANCE PROVIDING FOR THE OPERATION OF THE CITY'S EXISTING POLICE COURT PURSUANT TO THE REVISED CHAPTER 3 50 RCW Ordinance No 2505 was read by title only Mr Schmidt moved to adopt Ordinance No 2505, providing for the operation of the City's existing Police Court pursuant to the revised Chapter 3 50 RCW Seconded by Mrs Green Motion carried ORDINANCE NO 2506 AN ORDINANCE DEFINING, REGULATING AND LICENSING TRANSIENT MERCHANTS AND ITINERANT VENDORS AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND CREATING CHAPTER 5 10 OF THE PASCO MUNICIPAL CODE Ordinance No 2506 was read by title only Mr Grigg moved to adopt Ordinance No 2506, providing for the regulation of itinerant merchants Seconded by Mr Schmidt Motion carried ORDINANCE NO 2507(A) AN ORDINANCE PERMITTING THE DISPENSING AND CONSUMPTION OF BEER AT MEMORIAL PARK AND PROVIDING FOR A PERMIT THEREFORE Ordinance No 2507(A) was read by title only Mr Schmidt moved to adopt Ordinance No 2507(A), permitting the dispensing and consumption of beer at Memorial Park and providing for a permit therefore Motion died for lack of a second ORDINANCE NO 2507(B) AN ORDINANCE PERMITTING THE DISPENSING AND CONSUMPTION OF BEER AT MEMORIAL PARK FOR THE CENTENNIAL CELEBRATION LABOR DAY PICNIC AND PROVIDING FOR A PERMIT THEREFORE Ordinance No 2507(B) was read by title only Mr Schmidt moved to adopt Ordinance No 2507(B), permitting the dispensing and consumption of beer at Memorial Park for the Centennial Celebration Labor Day Picnic and providing for a permit therefore Seconded by Mr Morgan Mrs Isabel Quintinella expressed concern that there was no control in taverns - how can you control it in a City park? Mr Paul Durham, 1716 N 16th, asked "why have beer in parks?" Parks are for families and children and allowing beer in Memorial Park will force non-drinkers to stay home Mrs Jo Terry stated that "God doesn't honor serving beer in a public park " MINUTES PASCO CITY COUNCIL REGULAR MEETING JUNE 18, 1984 ORDINANCES - Continued Councilman Beverly Green expressed concern over serving beer at Memorial Park in view of teen-age drug and alcohol problems which we are trying to overcome She felt it was setting a bad example Mr David Cook urged the Council to go along with national crusade against drunk driving and not compound the problem by serving beer in a public park Mayor Jackson reiterated that this event was a one-time only affair in honor of 100-year centennial It is to be controlled and limited to one specific area Main motion passed by the following roll call vote YES Grigg, Schmidt, Jackson and Morgan NO Snider and Green RESOLUTION NO 1634 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DECLARING ITS INTENTION TO ORDER THE IMPROVEMENT OF SPECIFIED STREETS WITHIN THE CITY OF PASCO, WASHINGTON TO CITY STANDARDS, AND ALL WORK INCIDENTAL THERETO, CREATE A LOCAL IMPROVEMENT DISTRICT FOR THE PURPOSE OF ASSESSING THAT PORTION OF THE TOTAL COST OF THE ORDERED IMPROVEMENTS AND ASSOCIATED INCIDENTAL WORK AND EXPENSES, TO CITY STANDARDS COMMENSURATE WITH THE DISTRICT TO BE IMPROVED, AGAINST THE PROPERTIES ESPECIALLY BENEFITTED THEREBY, AND NOTIFYING ALL PERSONS WHO MAY DESIRE TO OBJECT TO SAID IMPROVEMENTS TO APPEAR AND PRESENT THEIR OBJECTIONS AT A MEETING OF THE CITY COUNCIL TO BE HELD ON JULY 9, 1984 Resolution No 1634 was read by title only Mr Schmidt moved to approve Resolution No 1634, which is a Resolution of Intent, as defined by State Law, to initiate the formation of an L I D Seconded by Mrs Green Motion carried UNFINISHED BUSINESS East Pasco Neighborhood Facility and Kurtzman Center Use Agreement Mrs Green moved to rescind Resolution No 1578 and Resolution No 1581, regarding the Use Agreement with the East Pasco Neighborhood Council, owing to unsatisfactory performance, and to direct staff to issue a call for proposals for recreation programming at these two facilities Seconded by Mr Snider Prior to vote, Mrs Green expressed regret for this decision as she did not feel that Mrs. Cain had had sufficient time to put her plans into action She commended her for her efforts The City Clerk read the following communication into the record "As President of the EPNC, I am withdrawing our organization's request to provide programming in the Kurtzman Park Building Realizing that it is the credability of EPNC and not my own that is in question, and trying in time to avoid this happening, I believe that under these conditions that it makes it hard for us to continue to provide community services to all the citizens of East Pasco To us, these needs are too great for our work to be jeopardized by this constant hassle We will, however, continue to be of whatever service we can and believe as an East Pasco based organization that we are aware of the needs of the residents of East Pasco We will oppose special interest groups having control of our public facility meant for the use of all residents in this area and not just a certain segment Please get this information to the Council members for tonight's meeting I would also like to thank the council members for their concern and to let them know that I will continue to be a representative for the people of East Pasco " /s/ Billie Cain, President The following communication was read from Community Action Committee , 1984 e yn We s, City Clerk PASSED and APPROVED this_Aday of MINUTES PASCO CITY COUNCIL REGULAR MEETING JUNE 18, 1984 UNFINISHED BUSINESS - Continued "Pursuant to my conversation with Dick Erickson, we want to confirm the fact that Benton-Franklin Community Action Committee has approxi- mately $8,000 for program director salary and wages, and approximately $2,000 for special interest classes such as sOimming passes, tennis lessons and other activities If you and the council approve, we would like to have you consider the Benton-Franklin Community Action Committee and the City of Pasco entering into an agreement whereby the Community Action Committee would provide programming of activities at the East Pasco Neighborhood Facility when it reopens and immediately at the Kurtzman Park Building We will work closely with your Park and Recreation staff to assure East Pasco participation in other City-wide programs We will also work closely with community leaders and organizations to receive input for programming needs in the community After an evaluation time and this arrangement is satisfactory with the City of Pasco and the Community Action Committee, we would look to more long term programming and needs in these facilities Thank you for your assistance and we will be awaiting your reply " /s/ Randy Ryan In view of communications received, Mayor Jackson was hopeful we could work out our differences Main motion carried by roll call vote of six (6) Mr Snider moved to authorize staff to work out agreement for recreation programming between the City of Pasco and Community Action Committee on an interim basis Seconded by Mrs Green Motion carried NEW BUSINESS Quit Claim Deed Mr Snider moved to authorize the Mayor to sign a Quit Claim Deed to the west ten (10) feet of Lot 22, Block 12, Gerry's Addition for the purpose of clarifying ownership on this lot Seconded by Mr Grigg Motion carried 1984 Crack Sealing Program - Bid Results Mr Snider moved to award bid for crack sealing to the low bidder, Titon Construction, in the amount of $23,472 00, and to authorize the Mayor to sign the contract documents Seconded by Mr Schmidt Motion carried by roll call vote of six (6) Bids on N 20th Avenue Mr Snider moved to award bid for construction of N 20th Avenue to the low bidder, A & B Asphalt in the amount of $132,130 46, and to authorize the Mayor to sign the contract documents Seconded by Mr Schmidt Motion carried by roll call vote of six (6) MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL Acting Fire Chief, Larry Dickinson, turned over check in the amount of $500 from Ladles Auxilliary of the Moose It is to be used for baby mannequins which are a necessity for CPR classes Mr Snider asked that staff direct a letter of appreciation to Ladles of the Moose, thanking and commending them for their generous donation.
