SPECIAL MEETING JULY 9, 1984
CALL TO ORDER
Special meeting called to order at 8 35 P M by Joe W Jackson, Mayor
ROLL CALL
By City Clerk Councilmen present were Susan Boothe, Beverly Green, Ira
Schmidt, Joe Jackson and Emerson Morgan Councilmen E A Snider and Charles
Grigg were absent from the meeting (excused) Also present were Lee Kraft,
City Manager, Greg Rubstello, City Attorney, Jerry Conner, Director of Finance,
Dennis Wright, City Engineer, James Ajax, Director of Public Works, Donald
Francis, Chief of Police, Larry Dickinson, Fire Chief, Webster Jackson, Purchasing/
Personnel Supervisor and Max Bigby, Assistant Planner
PUBLIC HEARING
MAYOR JACKSON DECLARED THE PUBLIC HEARING OPEN REGARDING PROPOSED "A"
STREET AND 28TH AVENUE L I D
It was noted that the hearing had been duly published, and all affected
property owners notified by mall
Mr Dennis Wright, City Engineer, gave the following statement
"In light of the extremely favorable bids received on L I D No 117
(East of Third Avenue), the staff requested and received Council approval
to meet with the property owners to discuss the possibility of creating an
L I D on Road 28 (Lewis to "A") and "A" (20th to 28th) There was good
support for an L I D although there were also several property owners
opposed
At the regular Council meeting of June 18, 1984, Council passed Resolution
No 1634, which was the Resolution of Intent to create the L I D That
Resolution, among other things, established July 9, 1984, 8 00 P M , as
the date and time to hold a public hearing on the possible creation of the
L I D All affected property owners have been notified of this hearing
In addition to input received from the affected property owners, there
are several additional factors Council should be aware of and take into
account before acting on the Ordinance
1) The water utility will necessarily incur an estimated expense
of $55,000 to complete the water system in the L I D area as a part
of the construction project There is ample revenue in the utility
fund to accomplish this.
2) The Street Fund will incur an estimated expense of $35,000 to pay
for the additional depth of rock and asphalt to bring these streets
to collector arterial standards Together with an estimated $20,000
to upgrade the traffic signal at the intersection of 28th and Lewis -
traffic actuation and pedestrian signals
3) The U S Army Corps of Engineers owns a large parcel of ground on
the south side of "A" Street The Federal Government, by law, is exempt
from L I D assessments Therefore, there are two options in how to
handle the amount their property normally would be assessed
A Have other properties pay,
B Have City pay
The assessment roll, as prepared, reflects that the City will pay the
assessment against the Corps' property This action is consistent with
all previous L I D 's involving Federal property The preliminary
assessment for the Corps' property is $34,848
4) Subsequent to mailing notices of assessment, Columbia Chapel called and
advised he was of the understanding that cemeteries were exempt from assessment
Greg Rubstello, City Attorney, has checked this out, and in fact, cemeteries
are in terms of practical reality, exempt from assessment in that the City
cannot have a lien on the property consequential to an L I D

This being consistent with how other exempt property is handled, the
City would have to pick up an estimated preliminary assessment of
$15,157 The total cost to the City from Item Nos 1 through 4 is
estimated as
$ 55,000 Water Fund
$105,000 Street Fund
In the case of the Street Fund, a budget supplement will be required
The revenue is available within the Street Fund as unobligated
Preliminary assessment roll, exclusive of U S Corps' assessment and
Columbia Chapel and Gardens - $184,363 22 Two (2) protests have been
received to date which total $47,480 16 or 26%
Right of Way - the existence of right of way has not been fully established
in several areas at the time of this writing Thus, the potential exists
that the Ordinance, if adopted, may have to be replaced due to right of way
problems
This L I D proposal once included 18th Avenue from Lewis Street to "A"
Street, however, we have been informed it no longer is wanted by the
property owners and staff no longer wants to pursue it "
Mr Vern Johnston, 429 S 23rd, felt he should not be assessed for "A" Street
when he used Frontage Road to get to his property Further, he asked if
Transit Authority was paying their share because the busses were breaking up
the road
Staff replied that the City was paying an extra $34,000 for asphalt, etc ,
to handle bus and truck traffic
Mr James Ajax, Director of Public Works, further explained zone and termini
method of assessment for benefit of the audience Completed project would
have sidewalks on the north side of "A" Street, on up 28th Avenue and a new
actuated signal light at 28th & Lewis to enable pedestrians to cross safely
He felt the area would be benefited by the amount of improvement
Mrs Delores Montero asked if the trucks would be kept off Staff replied
that trucks would be encouraged to use Lewis Street (except trucks in LID area),
however, it would be impossible to restrict their travel on this street
Mr Bruce Lee, owner of Bruce Lee Funeral Home, expressed concern over limited
access to his property when the State gave property back to the City He felt
that in his case, the cost exceeded the benefit
Mrs Joan Torres stated she didn't drive a car and was a low income person,
therefore, she didn't see how she could afford the assessment
Mr Earl Warren said, "if we get a street, we are going to have to buy it "
He felt the price was as good as they were going to get and favored LID
Mrs Virginia Sutherland expressed concern over property lines The City
Engineer replied that the pins are in place and final survey will be completed
soon
Following three (3) calls from Mayor Jackson for further comments from
the floor, either for or against, the public hearing was declared closed

ORDINANCE NO 2508
AN ORDINANCE ORDERING THE IMPROVEMENT OF CERTAIN STREETS
WITHIN THE CITY, ALL IN ACCORDANCE WITH RESOLUTION NO
1634 OF THE CITY COUNCIL, ESTABLISHING LOCAL IMPROVEMENT
DISTRICT NO 118 AND ORDERING THE CARRYING OUT OF THE
PROPOSED IMPROVEMENT, PROVIDING THAT PAYMENT FOR THE
IMPROVEMENT BE MADE BY SPECIAL ASSESSMENTS UPON THE PROPERTY
IN THE DISTRICT, PAYABLE BY THE MODE OF "PAYMENT BY BONDS",
AND PROVIDING FOR THE ISSUANCE AND SALE OF LOCAL IMPROVEMENT
DISTRICT WARRANTS REDEEMABLE IN CASH OR OTHER SHORT-TERM
FINANCING AND LOCAL IMPROVEMENT DISTRICT BONDS
Ordinance No 2508 was read by title only Mr Schmidt moved to adopt
Ordinance No 2508, which, if passed, will have the effect of creating
L I D No 118 for the construction of streets and related improvements
to "A" Street, between 20th and 28th Avenues, and 28th Avenue from "A"
Street to Lewis Street, and, further, will eliminate improvements to
18th Avenue from this L I D Seconded by Mrs Green Motion carried
At this time, Mr Ajax reiterated to audience that this begins 30-day
protest period, and if anyone objects to proposed L I D , they should
submit their protest,in writing,to City Clerk's Office
