Meeting called to order at 8 00 P M by Mayor Joe W Jackson
ROLL CALL
APRIL 23, 1984
By City Clerk Councilmen present were Susan Boothe, Beverly Green, Charles
Grigg, Ira Schmidt, E A Snider, Joe Jackson and Emerson Morgan Also present
were Lee Kraft, City Manager, Greg Rubstello, City Attorney, Jerry Conner,
Director of Finance, Dennis Wright, City Engineer, James Ajax, Director of Public
Works, Richard Erickson, Director of Parks/Recreation, Donald Francis, Chief of
Police and Larry Dickinson, Acting Fire Chief
ORDINANCES
ORDINANCE NO 2497
AN ORDINANCE ORDERING THE IMPROVEMENT OF CERTAIN STREETS IN THE
AREA GENERALLY DESCRIBED AS EAST OF THIRD AVENUE, ALL IN ACCORDANCE
WITH RESOLUTION NO 1625 OF THE CITY COUNCIL, ESTABLISHING LOCAL
IMPROVEMENT DISTRICT NO 117 AND ORDERING THE CARRYING OUT OF THE
PROPOSED IMPROVEMENT, PROVIDING THAT PAYMENT FOR THE IMPROVEMENT BE
MADE IN PART BY SPECIAL ASSESSMENTS UPON THE PROPERTY IN THE DISTRICT,
PAYABLE BY THE MODE OF "PAYMENT BY BONDS", AND PROVIDING FOR THE
ISSUANCE AND SALE OF LOCAL IMPROVEMENT DISTRICT WARRANTS REDEEMABLE
IN CASH OR OTHER SHORT TERM FINANCING AND LOCAL IMPROVEMENT DISTRICT
BONDS
Ordinance No 2497 was read by title only Mr Snider moved to adopt Ordinance
No 2497, which, if passed, will create L I D No 117 Seconded by Mrs Boothe
Mr James Ajax, Director of Public Works, gave the following history and facts
brief
"At the regular meeting of April 16,1984, council held a public
hearing to receive input on the possible formation of a street
improvement L I D for the streets described as
Court Street from 4th Avenue to 1st Avenue
Margaret Street from 3rd Avenue to 1st Avenue
Nixon Street from 3rd Avenue to 1st Avenue
Sylvester Street from 3rd Avenue to Tacoma Avenue
Shoshone Street from 3rd Avenue to Tacoma Avenue
Bonneville Street from 3rd Avenue to Tacoma Avenue
2nd Avenue from Clark Street to Sylvester Street
2nd Avenue from Nixon Street to Margaret Street
1st Avenue from Clark Street to Court Street
Tacoma Avenue from Clark Street to Sylvester Street
At that hearing, there was a request made, supported by written
request by a number of property owners to have certain streets
deleted (East of 1st Avenue) from the proposed L I D
The need to improve all the streets is apparent, thus I do not
see a good rationale for excluding any street(s) except as a
strategy to better assure that the L I D will not be stopped by a
60% protest
The assessments to the property owners who wish to be excluded obviously
is a significant expense, but I cannot accept it as a valid reason to
exclude the streets as if that was a proper basis, it would apply to all
the property owners in this and other L I D 's
Basically, what we are waiting for is to know whether or not several
other large property owners are likely to protest Two Ordinances have
been prepared so Council can go either way If the L I D is created,
each property owner will be so notified and advised of the thirty (30)
day protest period "

Councilman Grigg suggested leaving petitioners out (approximately 20%), thus
facing liklihood that the remainder of LID would pass
Councilperson Green disagreed and favored passing Ordinance as originally proposed,
and giving residents of the area an opportunity to protest it out if they did
not want improvement
Mr Ajax reiterated that a smaller LID was possible but would delay construction
to early fall He emphasized this was a good time to improve area due to
Block Grant assistance and City participation The longer we wait to improve
streets, the more it is going to cost
Mrs Billie Cain, President of East Pasco Neighborhood Council, expressed concern
over people's ability to pay in this area because she knew of a case in East Pasco
where a lady had a home valued at $17,000, it was completely paid for,and she had
a $5,000 assessment against it She had no income and was facing foreclosure because
she could not borrow enough money to pay her LID
Mr Robert Waters, 303 W Bonneville, asked, "how about an overpass on Sylvester?"
Joe Houlihan reminded the council that this was a low income area and will of the
people should prevail If LID is successful, he would have to pass costs on to
his tenants
Mr Ronnie Dick stated that even though he favored the improvement, he would have
to side with property owners in opposition
Mrs Virginia Skinnell expressed her concern over climbing interest rates
Again, Mr Ajax wanted the record to show that property owner's final assessment
will be no more than preliminary estimate
Mr Henry Kidwell suggested that Sylvester Street from 3rd to 1st be made 22'
wider during construction in the event that future growth warrants it
Mr Ajax replied that Sylvester Street (three blocks east of Third) didn't need
to be wider at this time and it was too abstract to make that type of investment
Mr Snider concurred that it would be a good idea to secure right of way at this
time for possible future development
Main motion carried by roll call vote of seven (7)
Replacement of Traffic Signals on Sylvester Street at 10th Avenue and 14th
Avenue - Authorization to Call for Bids (City Project No 82-4-05) Mr Snider
moved to authorize staff to call for bids on City Project No 82-4-05, which
provides for the installation of new traffic signals on Sylvester Street at
10th and 14th Avenues Seconded by Mr Schmidt Motion carried
Resolution No 1628
A RESOLUTION APPROVING CHANGES IN BUS STOP
LOCATIONS
Resolution No 1628 was read by title only Mr Schmidt moved to approve
Resolution No 1628, which, if passed, relocates two bus stops at the request
of the Transit Authority Seconded by Mrs Boothe Motion carried
Lewis Street Access Mr James Ajax gave the following history and facts brief
"Many years ago, the Lewis Street right-of-way was acquired by the
Washington State Highway Department and access rights were acquired
from the adjacent property owners Subsequently, when the by-pass was
built, the State turned Lewis Street over to the City with access
totally restricted between 18th Avenue and Road 28 Subsequently, one
right hand access was granted to what is Dunning-Ray and the Apple Inn

LEWIS STREET ACCESS - Continued
On August 27, 1979, council made the policy statements outlined
in my memo of December 20, 1983 Ed Ray is now interested in
acquiring additional access rights and is receptive to the basic
concept and price suggested in my December 20, 1983 memo subject
to certain conditions, as follows
1 The present right hand only ingress would, as a
right or legally but initially not physically,
be moved easterly to Parcel "A" and "B",
2 A new unrestricted, that is, left and right turn
in and out, access would be purchased to serve
Parcel "B",
3. For the unrestricted access, the City would be paid
$30 per foot x 265 feet = $7,950 Payment as follows
20% down and 25% annually thereafter for four years,
further conditioned that if the access to Parcel "B"
is to be physically constructed during the payment
period, the entire balance shall be paid prior to
actual construction and/or use
If this is conceptually agreeable, Ed Ray will be so advised and staff
will proceed with working out a detailed agreement "
Mr Ajax further stated that proposed funds will be earmarked for the beautification
of Lewis Street
Councilmen Snider and Grigg concurred with Mr Ajax's plan and suggested that a
large sign welcoming people to Pasco should be considered as part of the plan
Staff will proceed with proposal and keep the council advised
East of Third L I D No 117 Mr Snider moved to authorize staff to call for
bids on the East of Third Avenue L I D No 117 Seconded by Mrs Boothe Motion
carried (Bid opening will not occur until after 30-day protest period has expired)
CH2M-Hill Water Plant Upgrade Mr Snider moved to authorize staff to meet and
confer with J M Montgomery to develop a proposed engineering service contract
for the water plant upgrade Seconded by Mrs Green Motion carried
MISCELLANEOUS
Mr Steve Wilson asked when an LID is possible west of 10th Avenue and south
of "A" Mr Ajax replied it is under consideration now
ADJOURNMENT
No further business, Mr Schmidt moved for adjournment Seconded by Mrs
