HomeMy WebLinkAbout10-03-1983 MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING OCTOBER 3, 1983 CALL TO ORDER Meeting called to order at 8 00 P M by E A Snider, Mayor ROLL CALL By City Clerk Councilmen present were Susan Boothe, Beverly Green, Charles Grigg, Ira Schmidt, E A Snider, Joe Jackson and Emerson Morgan Also present were Leland F Kraft, City Manager, Greg Rubstello, City Attorney, Diane Dolan, Director of Finance, James Ajax, Director of Public Works/City Engineer, Richard Erickson, Director of Parks/Recreation, Gary Crutchfield, Director of Community Development and Jerry Conner, Accounting Supervisor CONSENT AGENDA Mrs. Boothe moved that Consent Agenda be approved Seconded by Mr Schmidt Motion carried by roll call vote of seven (7) Consent items are as follows a) Approval of Minutes To approve minutes of regular meeting, held September 19, 1983 b) Bills To approve General Claims in the amount of $154,311 28, claim warrant nos 35211 through 36342 To approve Payroll Claims in the amount of $410,066 81, Payroll Warrant Nos 5436 through 5623, and 5624 through 5811, and 5812 through 5983 c) Transportation for Senior Citizens To request that, in 1984, the Benton-Franklin Transit Authority pay the portion of the operating expense for the Senior Center van that is not paid by Grant revenues from the Area Agency on Aging d) Surplus Fire Truck (1962 Ford) To declare the 1962 Ford Fire Truck as surplus and to authorize the sale of the vehicle, and to direct that the proceeds of sale be set up in a reserve account for Fire Department capital improvement needs e) Request for Driveway Approval (Graham - 3rd & Lewis) To concur in the denial of any driveway on the south side of Lot 9, Block 23, Northern Pacific Plat of Pasco f) Resolution No 1595 A Resolution of the City of Pasco relating to a Comprehensive Solid Waste Management Plan, and re-authorizing the Benton-Franklin Governmental Conference to continue to function as the Solid Waste Planning Agency for the Bi-County area g) Resolution No 1606 A Resolution of the City of Pasco, approving changes in the ICMA Retirement Corporation Deferred Compensation Plan VISITORS There were no visitors wishing to address the Council at this time PUBLIC HEARINGS MAYOR SNIDER DECLARED THE PUBLIC HEARING OPEN FOR THE PURPOSE OF CONSIDERING ROBISON APPEAL (REZONE FROM R-1 TO THE "0" OFFICE DISTRICT) It was noted that the Hearing had been duly published and affected property owners notified of Hearing Continued Next Page MINUTES PASCO CITY COUNCIL REGULAR MEETING OCTOBER 3, 1983 PUBLIC HEARING - Continued Mr Gary Crutchfield stated the Planning Commission conducted a public hearing on August 8, 1983 After conducting the hearing and considerable deliberation on traffic and parking congestion, a motion to recommend approval of the rezone request failed on a 4 - 2 vote due to problem of parking congestion. Mr Robison, the applicant, has appealed the Commission's recommendation to Council, believing testimony at the hearing was more emotional than factual, and that it falsely lead the Commission to conclude parking congestion was more of a problem in the area than it really is The site is zoned R-1 (Low Density Residential) and developed with a 1,600 sq ft single family home There is a residential garage on the property accessed by the adjacent alley The property adjacent the west side of the applicants is also zoned R-1 and developed with a single family home The property to the north, across the alley, is zoned Office and developed with the DSHS Office complex and associated parking along the alley and adjacent 8th Avenue The property adjacent to the east side of the applicant's is zoned R-1 and developed with a parking lot for approximately 60 vehicles The properties to the south, across Brown Street, are zoned R-1 and contain single family homes and a vacant lot Of the total block in which the applicant's property, requested for rezone, is located, one-half block is presently utilized in office space, one-fourth is utilized for off-street parking for the office space, and one-fourth utilized by two single family homes Therefore, three-fourths of the entire block is already devoted to office use The applicant's request would devote another one-eighth of the block to office use, leaving a single residence as the only non-office oriented use in the block Therefore, the City Council is authorized under PMC 22 88 070 to approve the request, with or without modification, remand to the Planning Commission for reconsideration, enter into Concomitant Agreement with the petitioner as set forth in 22 88 090, or deny the request for rezone Mr Jim Robison, petitioner, stated the building leased to DSHS comprises 21,775 square feet of office space and off-street parking is provided for a minimum of 78 parking spaces To be specific, five or six more parking spaces are provided on the site in excess of requirement to meet Code of the City of Pasco Further, he had made a parking survey over several days and always found parking available He concurred that many clients parked their cars on the street to avoid walking and he sympathized with surrounding neighbors for this inconvenience However, this is a common practice throughout Pasco and parking in someone's driveway is a traffic violation and that be treated as such Mr Robison further stated that if his request is granted, he will provide for adequate parking to meet Pasco's requirements When office space is rented, the structure will be remodeled to accommodate the services needed Landscaping and improvements will be made to enhance the aesthetic appearance of the neighborhood Mr Robison circulated pictures he had taken at various times of day to substantiate his claims on traffic If his request was granted and the City felt additional parking was necessary, he would purchase an additional lot for parking improvement Mr Floyd Whitwer, 903 W Brown, reiterated there was inadequate parking for Welfare Building, further, they had bought their property as homes and requested that the City "leave us alone " Mr Joe Osborne, realtor, stated the single family residence had depreciated in value from $70,000 to $40,000 and proposed improvement would definitely be an asset to the area Mr Lloyd Tilton, 831 W Brown, reminded the Council that there was no need for more office space when there are empty offices across the street from Welfare Office and Sheridan Center (east of Welfare Office on Court) is 3/4 empty He stated that there were more employees than parking spaces and his calculation came up with 14 short MINUTES PASCO CITY COUNCIL REGULAR MEETING OCTOBER 3, 1983 PUBLIC HEARING - Continued Mr Dick Gonzales, 907 W Brown, expressed concern that commercial growth was devaluating residential property He submitted a written letter of protest from Fred A Reinig who was unable to be present at meeting Further, Mr Pete Overlie, 746 W Court, had telephoned his opposition to rezone (City Clerk confirmed Mr Overlie's telephone call) Following three (3) calls from Mayor Snider for further comments from the floor, either for or against, the public hearing was declared closed Mr Jackson moved that the council approves the findings and conclusions of the Planning Commission and deny the Robison request for rezone Seconded by Mrs Boothe Motion carried by roll call vote of seven (7) MAYOR SNIDER DECLARED THE PUBLIC HEARING OPEN FOR THE PURPOSE OF DISCUSSION OF POSSIBLE USES OF GENERAL REVENUE SHARING FUNDS ($375,000 - 1984) It was noted that the Hearing had been duly published as prescribed by Law There were no written communications Diane Dolan, Director of Finance, anticipated that $375,000 will be received during the next fiscal year In past years, these funds have been used to supplement the General Fund for the specific purpose of providing adequate public safety Following three (3) calls from Mayor Snider for further comments from the floor, either for or against, the public hearing was declared closed ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS ORDINANCE NO 2469 AN ORDINANCE PROVIDING FOR AN AD VALOREM TAX LEVY IN THE CITY OF PASCO IN ACCORDANCE WITH STATE LAW Ordinance No 2469 was read by title only Mr Schmidt moved to adopt Ordinance No 2469, providing for an Ad Valorem Tax Levy in the City of Pasco in accordance with State Law Seconded by Mrs Boothe Motion carried by roll call vote of seven (7) ORDINANCE NO 2470 AN ORDINANCE AMENDING CHAPTER 9 52 PASCO MUNICIPAL CODE AND RELATING TO THE CRIME OF TRESPASS Ordinance No 2470 was read by title only Mr Schmidt moved to adopt Ordinance No. 2470, amending Chapter 9 52 of the Pasco Municipal Code relating to the crime of trespass Seconded by Mrs Green Motion carried NEW BUSINESS Kurtzman & Richardson Pools Rehabilitation Project Mr. Jackson moved to authorize the City Manager to enter into an agreement with Romm Construction, Inc in the amount of $181,184 to rehabilitate Kurtzman and Richardson Pools and parks per bids submitted on September 28, 1983, and to waive the irregularities in the Non-Collusion Affidavit, Compliance Statement, and Certification of non-segregated facilities Seconded by Mr Schmidt Mr Stephen Dean, Owner of Winthrop Development, took exception to award of bid based on the fact that Romm's bid was not in separate envelopes as called for, he submitted one Bid Bond to cover both improvements instead of separate bid bonds, the Non-Collusion statement was not signed, Compliance Statement was not signed as well as Certification of Non-Segregated facilities Mr Dean complimented Romm's Construction as good contractors, but his concern was if the City was going to waive irregularities, why put them into the specifications? He stated that much time had been expended by himself to see that all all bid documents were properly signed before submitting Mr Dean further stated that he had contacted two attorneys and they concurred there were inequities and procedures should have been followed ADJOURNMENT No further business, meeting adjo.rfre -aill:a 9 40 ider, Mayor MINUTES PASCO CITY COUNCIL REGULAR MEETING OCTOBER 3, 1983 The City Attorney concurred that Mr Dean's logic was essentially correct, however, the City Council has the authority to waive irregularities, and the contractor has since signed documents which had been completed but due to an oversight, he had not signed them There was no change of numbers or amounts which is not allowed under the bidding process Gary Crutchfield stated that two bids had been requested for accounting purposes only due to the fact that Block Grant funds could be used for Kurtzman Park and not Richardson Park Mark Pence, architect, stated that Romm's bid was a good buy and recommended acceptance of bid Motion carried by roll call vote of six (6) Mrs Green voting no The City Attorney recommended that the record show irregularities waived by the City Council Mr Jackson moved that bid of Romm Construction submitted their bid in one envelope instead of two, and, he submitted one bid bond encompassing both projects, both of which had been waived by the City Council Seconded by Mr Grigg Motion Carried North 4th Avenue Overlay/Improvement, No 83-3-04 Bids were opened at 10 00 A M , October 3, 1983, for North Fourth Avenue Overlay Improvement Project Two (2) bids were received as follows Transtate Paving $198,811 50 ** Tri City Paving $212,119 20 **Staff Recommendation Mr Grigg moved to award the construction contract for North Fourth Avenue Overlay Improvement Project to low bidder, Transtate Paving Company, in the amount of $198,811 50, all in response to their proposal as submitted and further, to authorize the Mayor to sign the contract documents Seconded by Mrs Boothe Motion carried by roll call vote of seven (7) MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL Mayor Snider suggested that Our Lady of Lourdes Hospital be the recipient of a Civic Improvement Award due to expansion for the betterment of our community Staff will prepare award Councilman Morgan requested that a letter of commendation be prepared and sent to Gayle Metcalf, Tri City Herald Reporter, who has diligently covered Pasco City Council Meetings in a professional manner Staff will prepare letter for Mayor's signature with carbon copies to Mr Metcalf's editor and publisher Councilman Jackson requested that a letter of commendation be written to Milli Banks, Past President of East Pasco Neighborhood Council, for a job well done Staff will prepare a letter for Mayor's signature Councilman Grigg requested that staff prepare a listing of properties that are For Sale in the 3-R Area and to get an indication of the sales price for each of the properties He feels that the City ought to be looking for opportunities for developing public parking lots in the 3-R Area ATA10, ve yn We ls, City Clerk PASSED and APPROVED this //7 day of x_4L,z,l,) , 1983
