HomeMy WebLinkAbout02-16-1982 MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING FEBRUARY 16, 1982 CALL TO ORDER Meeting called to order at 8 00 P M by Mayor, E A Snider ROLL CALL By City Clerk Councilmen present were Susan Boothe, Beverly Green, Charles Grigg, Ira Schmidt, E A Snider, Joe Jackson and Emerson Morgan Also present were Lee Kraft, City Manager, Greg Rubstello, City Attorney, Diane Dolan, Finance Director, Richard Erickson, Director of Parks & Recreation, Mike Vandiver, Chief of Police, Webster Jackson, Purchasing/Personnel, and Gary Crutchfield, Director of Community Development CONSENT AGENDA Mr Grigg moved to approve Consent Agenda Seconded by Mr. Schmidt Motion carried by roll call vote of seven (7) Consent items are as follows a) Approval of Minutes. To approve minutes of regular meeting, held February 1, 1982 b) Bills To approve general claims in the amount of $296,993 41, claim warrant nos 29983 through 30151 c) Dead Tree Removal To approve the plan submitted by staff for permitting private individuals to remove unwanted trees in the parks, based on interested individuals signing an indemnification agreement and provided—that the Director of Rarks &-Recreation, or his desIgnater see to it that appropriate measures are„t taken to safeguard the work area where trees are being removed and, where the exposure hazard is of concern, to require evidence of adequate property damage and liability insurance d) Resolution No 1490. A Resolution fixing the time and place for a public hearing to consider vacation of a certain portion of Hugo Avenue and a certain alley within the City of Pasco e) Resolution No 1491 A Resolution designating the Finance Director of- the City of Pasco as the Auditing Officer for the City of Pasco, pursuant to RCW 42 24 080 and repealing Reolution No 686 , f) Fence at Richardson Park To authorize the erection of a chain link fence across Richardson Park to separate the front yard of Jan Sass from the park area, at a cost not to exceed $675, with the expense to be chargeable to the Contingency Fund, and with the further requirement that staff try to utilize volunteer labor to keep the City outlay to the lowest possible dollar outlay g) Trees on Lewis Street To direct staff to replace the missing trees on Lewis Stre-et no later than this spring VISITORS There were no visitors wishing to address the Council at this time MAYOR SNIDER TRANSPOSED REGULAR ORDER OF BUSINESS TO RECEIVE CITIZEN INPUT ON III AMUSEMENT DEVICE ORDINANCES PRIOR TO VOTING Michael Froese, Manager of Pizza Pete, stated his machines were there for the convenience of customers, and often time, supplemented his regular business of selling pizza He urged Council's reconcideration of present fee Mr William Pitzer reiterated his used machines-,bring ,in from $10 to $20 weekly, depending on the novelty and further felt Pasco had an unfair assessment on their revenue MINUTES PASCO CITY COUNCIL REGULAR MEETING FEBRUARY 16, 1982 AMUSEMENT DEVICE ORDINANCES - Continued ORDINANCE NO 2337 (Flat Rate Fee) AN ORDINANCE CONCERNING AMUSEMENT DEVICES AND AMENDING CHAPTER 5 20 PASCO MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS 100 and 110 OF SAID CHAPTER, AND BY THE ENACTMENT OF SECTION 115 OF SAID CHAPTER Ordinance No 2337 was read by title only. Mrs Green moved to adopt Ordinance No 2337, concerning amusement devices and amending Chapter 5 20 of the Pasco Municipal Code No Second to motion Motion DIED for lack o a second ORDINANCE NO. 2338 (Graduated Rate Fee). AN ORDINANCE CONCERNING AMUSEMENT DEVICES AND AMENDING CHAPTER 5 20 PASCO MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS 100 and 110 OF SAID CHAPTER, AND BY THE ENACTMENT OF SECTION 115 OF SAID CHAPTER Ordinance No 2338 was read by title only Ordinance No 2338 DIED for lack of a motion (This subject to be back on Workshop Agenda, February 22, 1982) REPORTS FROM OFFICERS AND/OR COMMITTEES AWC - City Legislative Conference Mayor Duke Snider reported that he attended AWC Conference on February 4, 1982, and lobbied for various bills Among those discussed were 1/2 ¢ Sales Tax, 6% Lid Law, ACI Bond Issue, continued support for 1-82 and 1-182 and Financial Responsibility Laws He, emphatically, discouraged any support for State Income Tax for the State. of--Washington Parks & Recreation Advisory Council Councilman Emerson Morgan reported that he met with Parks & Recreation Advisory Council on February 4, 1982. New members were introduced and orientated East Pasco Neighborhood Facility was discussed with respect to available rental space Letters have been sent out to prospective renters Tr-Mats Policy Advisory Council Beverly Green stated 1-82 and 1-182 was dis- cussed at their February 10th meeting Local television station introduced their staff person to council Counc-il ,o4lAging Emerson Margan—r;eported that 34 people.attended their February 10th' meeting and he was most impressed with the conduct of meeting He stated that the had netted approximately $478 from sale of apples during recent holiday season In December, they served 4,224 meals at home comprising over 482 people Emergency Medical Service Beverly Green reported that Emergency Medical Service was before the 'House and they are proposing.-a fee of $45 to check theh n ambulances Businesses felt this was an exhorbitant fee Good Roads Meeting Mayor Snider presented Key to the City of Pasco to Duane Berenson, Secretary of Transportation, at recent Good Roads Meeting This meeting was also attended by Mr Schuster of the State Highway Department and 1-82 and 1-182 was discussed thoroughly At this time, Mayor Snider introduced Mr Kelso Gillenwater, of the Tri City Herald, who was sitting in the audience Benton-Franklin Transit Authority Ira Schmidt reported that two (2) Workshops had been held on Resolution The routes are basically resolved with the exception of Richland which is being concluded soon Councilman Charles Grigg asked what had been done to cffset 50% of revenue as a result of mothballing WPPSS plants 4 & 5 7 Mr Schmidt was aware of Mr Grigg's concerns and stated this had been discussed in Executive Sessions and he was unable to comment at this time Further, concern had been raised over lift system on busses and it was anticipated that a smaller, 12-passenger bus might be initiated with lift system on it PASSED and APPROVED this // day of , 1982 ADJOURNMENT Meeting adjourned at 8 55 P.M '414-1186 T'—'411s, City Clerk MINUTES PASCO CITY COUNCIL REGULAR MEETING FEBRUARY 16, 1982 PUBLIC HEARINGS MAYOR SNIDER DECLARED THE PUBLIC HEARING OPEN TO CONTINUE REQUEST ON FRANKLIN COUNTY ALLEY VACATION Mr Grigg moved to postpone the public hearing on Franklin County Alley Vacation until 8 00 P M , Monday, March 15, 1982 Seconded by Mr Jackson Motion carried MAYOR SNIDER DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE VACATION OF EAST/WEST ALLEY, LYING BETWEEN SOUTH 10TH AVENUE AND SOUTH 11TH AVENUE OF BLOCK 25, RIVERSIDE ADDITION TO PASCO It was noted that the hearing had been duly published and posted as required by law Mr Gary Crutchfield reported that owners of more than 2/3 of the property abutting the alley right of way have signed and submitted a qualified petition requesting Council to vacate said alley right of way The requested vacation would improve the usefulness of the properties abutting the alley right of way The alley is not necessary for public access to any adjacent properties and no utilities located in said alley By vacating said alley, the City would eliminate responsibility for maintenance or liability upon the premises Following three (3) calls from Mayor Snider for further comments from the floor, either for or against, the public hearing was declared closed ORDINANCE NO 2335 AN ORDINANCE VACATING A CERTAIN ALLEY IN BLOCK 25, RIVERSIDE , ADDITION TO THE CITY OF PASCO Ordinance No 2335 was read by title only Mrs Green moved to adopt Ordinance No 2335, vacating the east/west alley in Block 25, Riverside Addition Seconded by Mr. Schmidt Motion carried by roll call vote of seven (7) ORDINANCES/RESOLUTIONS NOT RELATING TO PUBLIC HEARINGS RESOLUTION NO 1492 A RESOLUTION OF THE CITY OF PASCO PROVIDING FOR EXPENDITURE OF $3,096 00 OUT OF THE CONTINGENCY FUND FOR FINANCING A PROPORTIONATE SHARE OF THE COST OF MONITORING AND LEGAL EXPENSES ASSOCIATED WITH CONSTRUCTION IMPACT GROUP ACTIVITIES RELATED TO THE PUGET SOUND POWER AND LIGHT NUCLEAR PROJECTS Resolution No 1492 was read by title only Mr. Grigg moved to approve Resolution No 1492, which upon adoption, will provide Pasco's share of the expenses of the Construction Impact Group legal work relating to the Puget Power Nuclear projects at Hanford Seconded by Mrs Boothe Motion carried by roll call vote of seven (7) ORDINANCE NO 2336 (Opportunity Investment Company Rezone) AN ORDINANCE RELATING TO ZONING AND CHANGING ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM C-1 (RETAIL BUSINESS) TO R-3 (HIGH DENSITY RESIDENTIAL) Ordinance No 2336 was read by title only Mr Schmidt moved to adopt Ordinance No 2336, granting the Opportunity Investment Company Rezone from C-1 to R-3 Seconded by Mr Jackson Motion carried by roll call vote of six (6) Mrs Green voting no
