HomeMy WebLinkAbout08-02-1982 MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING CALL TO ORDER Meeting called to order at 8 00 P M by E A Snider, Mayor ROLL CALL AUGUST 2, 1982 By City Clerk Councilmen present were Susan Boothe, Beverly Green, Charles Grigg, Ira Schmidt, E A Snider, Joe Jackson and Emerson Morgan Also present were Greg Rubstello, Acting City Manager/City Attorney, Diane Dolan, Finance Director, James Ajax, City Engineer, Gary Crutchfield, Director of Community Development and Webster Jackson, Purchasing/Personnel Supervisor CONSENT AGENDA a) Approval of Minutes To approve minutes of regular meeting, held July 19, 1982 b) Bills To approve General Claims in the amount of $105,967 27, claim warrant nos 31700 through 31870 To approve Payroll Claims in the amount of $287,648 50, Payroll Warrant Nos 218 through 427, and 428 through 632 c) Public Hearing Date - Northwest Pasco Annexation To fix 8 00 P M , Monday, August 16, 1982, in the Council Chamber at City Hall as the time and place for a public hearing to consider the Northwest Pasco Annexation petition d) Public Hearing - Appeal of Planning Commission's Recommendation, Benward To fix 8 00 P M , Monday, August 16, 1982, as the date for a public hearing to consider the Benward appeal e) Special Council Meeting - August 9, 1982 To set August 9, 1982, as a Special Council Meeting for the purpose of 1) Consideration of bid award on the Second Water Pressure Zone Transmission Intertie Project 2) Second Pressure Zone East Pasco Booster Station, together with Raw Water Pump and Line over Dike 3) Contract for lowering the 36-inch Waterline in Road 36 4) To conduct a public hearing for consideration of adopting the Six- Year Street Construction Program by Resolution VISITORS Mayor Snider recognized Mr Lee Gaines, representing Concerned Citizens for Responsive Government, owner of Tune Tech, 1909 W Court, and speaking in support of Police Chief, Michael Vandiver He spoke against "the City Manager's decision to ask for the Chief's resignation" and in support of Chief Vandiver He also read from a printed statement which he handed out to the Council and press Mr Gaines also presented petitions requesting the City Manager to retain Chief Vandiver, which were given to the City Clerk Mr Albert Stallworth, 2nd Vice-President of the NAACP, stated "We, the National Association for the Advancement of Colored People (NAACP), have evaluated the Media's coverage of statements claimed to 11/ have been made by NAACP and find that the vast majority were inaccurate, out of context, and published in total disregard of its truth or falsity For example, the News reports claiming NAACP support for Butner's dismissal were never issued by our organization The news media should re-evaluate its own professional standards, and verify its source of information prior to release Inaccurate reporting merely misinforms the public and has no proper place in professional journalism Continued Next Page MINUTES PASCO CITY COUNCIL REGULAR MEETING AUGUST 2, 1982 VISITORS - Continued The Resolution previously reported on by the news media was still in draft form and had not been formally approved prior to release An official Resolution concerning adequate and effective law en- forcement in the City of Pasco will be forthcoming It will be submitted to the Pasco City Council and City Manager, who have final responsibility for safety and law enforcement The Resolution is a generic statement concerning years of law enforcement and has nothing to do, what-so-ever, with the Butner case Although we take no official position regarding the propriety of the recent decision rendered by the Pasco City Civil Service Commission, we commend the Chief of Police for his courage to take action against a fellow officer /s/ Edgar Hargrow, President At this time, Reverend Stallworth read Resolution No 001 of Benton-Franklin NAACP., "A Resolution Demanding Adequate and Effective Law Enforcement and Minority Participation in City Government " (Copy Attached to Minutes) Mayor Snider thanked Rev Stallworth for his presentation and reiterated that this had been a frustrating experience for the City as well He asked Rev Stallworth's assistance in recruiting Blacks to take the Civil Service Exams Perhaps this could be achieved by "coaching" and trading cities for recruitment Mayor Snider asked, "how can we develop an interest?" Rev Stallworth replied that the Black community lacked faith in the present system, but reaffirmed his willingness to work together for a common goal It was announced that a special meeting of the Civil Service Commission was being scheduled to discuss Affirmative Hiring Practices in Police and Fire Departments Councilman Grigg stated that while he was sure both parties were working towards the same end result, he was somewhat offended by the word "demand" in Resolution He felt that great strides had been made in the East Pasco Community and Pasco Councils had made special efforts on their behalf Councilman Morgan reiterated that a good challenge had been made to the City, therefore, the City was challenging theNAACP to work diligently with them in solving the problem Rev Stallworth accepted this challenge REPORTS FROM OFFICERS Benton-Franklin Transit Councilman Ira Schmidt reported that meeting of July 21, 1982 had been very short The site location had been selected and a public hearing was scheduled for September 9, 1982 on location choice Mr Peter Arniel was being replaced by Ed Frost, who will begin employment on August 9, 1982 Benton-Franklin Governmental Conference Councilman Beverly Green reported that meeting of July 23, 1982 was also brief The main business was waterline in North Pasco being approved A secretary will be appointed by next meeting Benton-Franklin Community Services Board Councilman Beverly Green reported this group was presently in transition as a new Coordinator, Nancy Caldwell, had been hired Park & Recreation Advisory Council Councilman Emerson Morgan reported the meeting had been moved to last of July MINUTES PASCO CITY COUNCIL REGULAR MEETING AUGUST 2, 1982 PUBLIC HEARINGS MAYOR SNIDER DECLARED THE PUBLIC HEARING OPEN FOR THE PURPOSE OF CONSIDERING ORDINANCE No 2379, AMENDING THE 1982 ANNUAL BUDGET BY PROVIDING A SUPPLEMENT THERETO It was noted that the Hearing had been duly published, as required by Law There were no written communications Following three (3) calls from Mayor Snider for further comments from the floor, either for or against, the public hearing was declared closed. ORDINANCE NO 2379 (Second Reading) AN ORDINANCE AMENDING THE 1982 ANNUAL BUDGET OF THE CITY OF PASCO, BY PROVIDING A SUPPLEMENTAL THERETO, BY APPROPRIATING AND REAPPROP- RIATING REVENUE, BY PROVIDING TRANSFER AND EXPENDITURE AUTHORITY, BY ADJUSTING THE EXPENDITURE PROGRAM OF VARIOUS FUNDS AND BUDGETS WITHIN FUNDS, AND DECLARING AN EMERGENCY Ordinance No 2379 was read by title only Mrs Boothe moved to adopt Ordinance No 2379, amending the 1982 annual budget of the City of Pasco Seconded by Mr Schmidt Motion carried by roll call vote of seven (7) MAYOR SNIDER DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE VACATION OF THE NORTH TEN FEET OF AINSWORTH STREET, LYING BETWEEN A POINT TEN FEET WEST OF THE EAST LINE OF EIGHTH AVENUE, AND A POINT TEN FEET EAST OF THE WEST LINE OF SEVENTH AVENUE, ALL ADJACENT THE SOUTH LINE OF BLOCK 16, RIVERSIDE ADDITION WITHIN THE CITY OF PASCO' It was noted that the Hearing had been duly published and posted as required by Law There were no written communications presented Mr Gary Crutchfield stated the applicant had signed an easement agreement with the P U D and no other utility company had objected or responded to proposed street vacation Further, the requested vacation would improve the usefulness of the property abutting Ainsworth Street, the right of way is not necessary for public access to the adjacent property, there are no utilities located in said portion of Ainsworth Street and the vacation of said right of way would eliminate any City responsibility regarding maintenance or liability upon the premises Councilman Schmidt felt the City should look at sidewalk situation on north side of Ainsworth as it was a long block Following three (3) calls from Mayor Snider for further comments from the floor, either for or against, the public hearing was declared closed ORDINANCE NO 2381 AN ORDINANCE VACATING A CERTAIN PORTION OF AINSWORTH STREET WITHIN THE CITY OF PASCO Ordinance No 2381 was read by title only Mrs Green moved to adopt Ordinance No 2381, vacating the north ten feet of Ainsworth Street, lying between the east line of Eighth Avenue and the west line of Seventh Lane Seconded by Mr Jackson Motion carried by roll call vote of seven (7) ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS RESOLUTION NO 1520 A RESOLUTION ACCEPTING RIGHT OF WAY ON IRVING STREET Resolution No 1520 was read by title only Mr Grigg moved to approve Resolution No 1520, which has the effect of accepting right of way for a cul-de-sac on Irving Street from R X and Lola Lyle Seconded by Mrs Boothe Motion carried by roll call vote of seven (7) 1 I M Edgar Hargrow, President Ze, Ai/ zAki P pprove ee' as to form A RESOLUTION NO 001 OF BENTON-FRANKLINNAACP A RESOLUTION DEMANDING ADEQUATE AND EFFECTIVE LAW ENFORCEMENT AND MINORITY PARTICIPATION IN CITY GOVERMENT WHEREAS Various law enforcement agencies in the City of Pasco, County of Franklin, State of Washingon are responsible for the enforcement of the law and maintaining order, and WHEREAS These agencies are obligated to serve and protect the lives and properties of all the citizens of our community, and WHEREAS Criminal activity has continued to rise in our community, to wit burglary, prostitution, drug trafficking, unlawful gambling and, WHEREAS Said criminal activities still exist in the East Pasco Community much more conspicuously than in other areas fo the city and WHEREAS Various law enforcement agencies in the City of Pasco, County of Franklin, State of Wahsington, have failed to afford equal protection and justice to citizens of our community, therefore creating serious credibility problems, negative attitudes, and a potentially explosive situation for all concerned, WHEREAS Less than adequate and effective law enforcement, including the lack of positive community participation in disciplinary proceedings involving police and govermental misconduct has proven to be detrimental to the community as a whole, NOW, Therefore be it resolved that the Benton-Franklin Branch of the National Association for the Advancement of Colored People (NAACP) acting pursuant to the authority vested in it, hereby make the following demands, 1 That the Pasco City Council immediately instruct the Pasco City Police Department to provide adequate and effective law enforcement in the East Pasco cummunity without regard to race, creed, nationality, special status, etc and to establish protection of lives and property, and 2 That the City of Pasco recruit and hire at least two (2) Black police officers in 1982, and 3 That the Pasco City Council direct all city departments to establish and maintain effective community relations with the Black community, including the creation of a Community Police Review Board, and assure that Blacks and other ethnic minorities are recruited and hired in all departments and 4 That the Pasco City Council direct all departmental heads to take immediate disciplinary action against any employee known to have committed or been involved in racial slurs and/or racial harrassment, discriminatory practices, or other conduct unbecoming an officer Be it further resolved that unless the City of Pasco and other local governmental agencies take positive and aggressive steps to alleviate the concerns herein, that the Benton -Franklin NAACP shall focus all of its available resources to remove and/or defeat those elected and/or appointed officials who have contributed or failed to act for the betterment of our community Readopted this day of August, 1982 The Benton-FranklinNAACP Ordinance No. 2386 was read by title only Mr Schmidt moved to adopt Ordinance No. 2386, granting the rezone from R-1 to RMH-1, of Lots 1 - 14, Block 14, Wehe's First Addition, with Concomitant REGULAR MEETING AUGUST 2, 1982 ORDINANCES/RESOLUTIONS - Continued ORDINANCE NO 2382 (Sea-First National Bank, Trustee for Fanning) AN ORDINANCE RELATING TO ZONING BY CHANGING ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY IN THE CITY OF PASCO FROM R-2 (Medium Density Residential) TO R-3 (Medium Density Residential) Ordinance No 2382 was read by title only Mr Schmidt moved to adopt Ordinance No 2382, granting the rezone from R-2 to R-3, as recommended by Planning Commission Seconded by Mrs Boothe. Motion carried by roll call vote of six (6) Mrs Beverly Green voting no ORDINANCE NO 2383 (Walleston) AN ORDINANCE RELATING TO ZONING BY CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY IN THE CITY OF PASCO FROM R-2 (Medium Density Residential) to R-3 (Medium Density Residential) Ordinance No 2383 was read by title only Mrs Boothe moved to adopt Ordinance No 2383, granting the rezone from R-2 to R-3, as recommended by Planning Commission Seconded by Mr Schmidt Motion carried by roll call vote of seven (7) ORDINANCE NO 2384 (O'Shea) AN ORDINANCE RELATING TO ZONING BY CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY IN THE CITY OF PASCO FROM R-2 (Medium Density Residential) to R-3 (Medium Density Residential) Ordinance No 2384 was read by title only Mr Schmidt moved to adopt Ordinance No 2384, granting the rezone from R-2 to R-3, as recommended by Planning Commission Seconded by Mrs Boothe Motion carried by roll call vote of seven (7) , ORDINANCE NO 2385 (Abrams) AN ORDINANCE RELATING TO ZONING BY CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY IN THE CITY OF PASCO FROM R-2 (Medium Density Residential) to R-3 (Medium Density Residential) Ordinance No 2385 was read by title only Mr Schmidt moved to adopt Ordinance No 2385, granting the rezone from R-2 to R-3, as recommended by the Planning Commission Seconded by Mrs Boothe Motion carried by roll call vote of seven ( 7 ) . ORDINANCE NO 2386 (Robinson/American Armenian College) AN ORDINANCE RELATING TO ZONING AND CHANGING ZONE CLASSIFICATION FOR CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM R-1 (Low Density Residential) to RMH-1 (Residential Mobile Home) Rezone - R-2 to R-3, File No 82-26-Z, State of Washington Mr Schmidt moved to concur in the Planning Commission's recommendation that the property is appropriately classified R-2, and that a change in land use classification is unwarranted Seconded by Mrs Boothe Motion carried by roll call vote of seven (7) MINUTES PASCO CITY COUNCIL REGULAR MEETING AUGUST 2, 1982 NEW BUSINESS - Continued b) Rezone - R-2 to R-3, File No 82-26-Z, Trinity Lutheran Church Mr Schmidt moved to concur in the Planning Commission's recommendation that the property is appropriately classified R-2, and that a change in land use classification is unwarranted Seconded by Mrs Boothe Motion carried by roll call vote of seven (7) c) Rezone - R-2 to R-3, File No 82-26-Z, Evergreen Builders Mrs Boothe moved to concur in the Planning Commission's recommendation that the property is appropriately classified R-2, and that a change in land use classification is unwarranted Seconded by Mr Schmidt Motion carried by roll call vote of seven (7) d) 1982 Street Overlays, FAM - Bid Results. Mr Jackson moved to award the construction contract for the 1982 Street Overlays to L W Vail Company, Inc , in the amount of $266,870 65, which includes applicable sales tax, all in response to their proposal as submitted and, further, to authorize the Mayor to sign the contract documents Seconded by Mr Schmidt Motion carried by roll call vote of seven (7) Mr Schmidt moved to authorize the Mayor to sign Supplement No 1 to the Municipal Agreement between the City of Pasco and the State of Washington on the 1982 FAM funded Arterial Overlay Project Seconded by Mrs Boothe Motion carried by roll call vote of seven (7) ADJOURNMENT No further business to come before the council, the meeting adjourned at 9 40 P M E A Snider, Mayor PASSED and APPROVED this // day of 1982 1
