HomeMy WebLinkAbout10-12-1981 MinutesMINUTES PASCO CITY COUNCIL SPECIAL MEETING OCTOBER 12, 1981 CALL TO ORDER Meeting called to order at 8 00 P M by Mayor Pro-Tern, Ira Schmidt ROLL CALL By City Clerk Councilmen present were S K Adams, Gary Bosch, Beverly Green, Charles Grigg and Ira Schmidt Mayor E A. Snider was absent (excused) Also present were Webster Jackson, Acting City Manager, (Manager Lee Kraft absent due to illness), Greg Rubstello, City Attorney, Diane Dolan, Finance Director, James Ajax, City Engineer, Ken Neilsen, Data Processing Supervisor and Gary Crutchfield, City Planner PUBLIC HEARINGS MAYOR PRO-TEM SCHMIDT DECLARED THE PUBLIC HEARING OPEN TO RECEIVE CITIZEN INPUT ON POSSIBLE USES OF ENTITLEMENT PERIOD THIRTEEN REVENUE SHARING FUNDS It was noted that the Hearing had been duly published and posted, as required by Law. Mr Ken Neilsen, Office Manager, reported that the City had received word of probable decrease of 12% in previously allocated funds He stated this would represent approximately $45,490, leaving tentative figure of $333,600 00 The Department of Revenue Sharing encouraged cities to budget for the lesser figure in order to avoid any shortfalls In previous years, Revenue Sharing Funds had been earmarked for Public Safety but this is not a precedent However, the funds must be spent for what it has been appropriated for Folowing three (3) calls from Mayor Pro-Tern Schmidt for further comments from the floor, the public hearing was declared closed MAYOR PRO-TEM SCHMIDT DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE VACATION OF THAT PORTION OF SOUTH STREET, LYING BETWEEN SOUTH FOURTH AVENUE AND SOUTH FIFTH AVENUE It was noted that the Hearing had been duly published and posted, as required by Law Mr Gary Crutchfield, Director of Community Development, stated that the south 12 feet and north 9 feet of South Street (between 4th & 5th Avenues) was vacated under Ordinance No 1386 in 1969, thus, South Street was reduced to a standard 60' right of way The North/south alley extending between Columbia and South Streets was left open also The owners of more than two-thirds of the abutting property have recently submitted a petition requesting vacation of South Street South Street is the only right of way providing access to Lots 15 and 16, and is the principal right of way used to gain access to the "row houses" situated on Lots 13 and 14 Vacation of South Street would interrupt that access There are no municipal utilities in South Street, however, a 30-inch storm sewer stub is located at the intersection of South Street and 4th Avenue Franklin County PUD has requested retention of an easement 10 feet wide, extending 25 feet Vacation of all of South Street clearly would create land-locked parcels and would render the north/south alley useless Vacation of the south half of South Street would create a substandard right of way (when the owner applied for a building permit, he would be required to dedicate the right of way back to the City), consequently, this option is not desirable and staff recommends rejection Mr Grigg ask, "are we proposing to vacate the street down to 60'"? Staff replied, no, it is now 60' - at one time, it was 80', and was vacated 12' on the south side and 8' on the north side some years ago The petition requests vacation of all or any part of the remaining 60' width of South Street Mr Grigg then asked, "can't those houses be served by, say if we vacated a portion of South Street going down to that alley - they would still have access down to that alley " MINUTES PASCO CITY COUNCIL SPECIAL MEETING OCTOBER 12, 1981 PUBLIC HEARING - Continued Mr Crutchfield responded with the following background information Approximately 1 1/2 years ago, a Resolution was adopted legislating that prior to the issuance of a building permit for any development, they had to be certain there was adequate right of way In the case of South Street, it is presently 60' and if we vacate the south half, that would leave a 30' right of way If we closed it all, it would not present a problem, but it would land lock the parcels and that is not the prudent thing to do Discussion ensued over access of "row houses" that face alley behind the Pasco Elks Lodge Mr Don Cooper, 1114 W Park, petitioner for vacation stated that it was not his intent to close the street entirely nor block any of the "row houses" from access Their intent is for parking only as they lost a good portion of their previous parking on 5th Avenue The property is so narrow that it is good for nothing but parking, and if the property were vacated and made wide enough to build on, they would fence it off He conceded that a compromise would be acceptable Mr Jim Ajax asked, "wouldn't it be possible to make this a 1-way street? Mr Cooper replied that they could go 1-way, either way Mr Bosch felt there were questions left to be answered and suggested that this be referred to a workshop session for more consideration Mr Grigg moved to continue hearing to the next regular meeting of the City Council on October 19, 1981 at 8 00 P M Seconded by Mr Adams Motion carried ORDINANCES ORDINANCE NO 2306 (L I D No 114 - Southeast Pasco Waterline) AN ORDINANCE FIXING THE AMOUNT, FORM, DATE, INTEREST RATE, MATURITY AND DENOMINATIONS OF LOCAL IMPROVEMENT DISTRICT NO 114 BONDS AND DIRECTING THE ISSUANCE AND SALE THEREOF TO FOSTER & MARSHALL, INC , OF SEATTLE, WASHINGTON Ordinance No 2306 was read by title only Prior to motion, Mrs Mary Hughes of Foster & Marshall gave the following presentation At the last bond sale in June, we were able to offer 12% interest, but tonight, the interest rate is 15 84% There are three reasons for the increase, 1) bond market in general, 2) nature of this particular L I D , 3) marketability of Pasco L I D bonds However, the prime rate refers to short term interest whereas the bond market is a long term market She further stated there is a real lack of-bond buyers, and for the first time, they have had to go out of state to secure them She expressed caution due to employment layoffs, closure of WPPSS projects and risk of developer L I D 's Mr Grigg had no problem with interest rate because everything was going up, but was critical of negative attitude as far as Pasco bonds Mr Bosch concurred With this statement and reiterated that we had a very stable economy in the Tri Cities Mr Jim Ajax defended project by stating that bids had come in 30% below estimate and he felt the property had been benefited amount assessed Mr Grigg moved to adopt Ordinance No 2306, fixing the amount, form, date, interest rate, maturity and denomination of Local Improvement District No 114 Bonds and providing for the sale and delivery thereof to Foster & Marshall, Inc , Seattle, Washington Seconded by Mrs Green Motion carried by roll call vote of five (5) I MINUTES PASCO CITY COUNCIL SPECIAL MEETING OCTOBER 12, 1981 NEW BUSINESS TURNBACK AGREEMENT BETWEEN CITY OF PASCO AND STATE OF WASHINGTON FOR CB LINE, ETAL Mr Adams moved to authorize the Mayor to sign the turnback agreement for the CB Line etal, said agreement entered into and between the Cityof Pasco and the State of Washington Seconded by Mr Grigg Mr Ajax noted that he did not know if the Manager's secretary got one page of the agreement replaced, "but the only significant part is we'll relocate a waterline, and they will relocate a sewer It turned out to be a hassle and they are going to relocate both " At that time, the State indicated they would be awarding contract on 1-182, 20th Avenue out to the bridge, early in 1982 Motion carried by roll call vote of five (5) MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL SECOND PRESSURE ZONE In response to Mr Bosch, the City Engineer reported that engineering is almost complete on the second pressure zone, the City is making grant applications, and we are not that far from going to bid When we do go to bid, the City is going to have to have a rather large revenue bond issue, so this project has not been put on the "front burner " ADJOURNMENT Mr Grigg moved that the meeting adjourn Seconded by Mr Adams Motion carried Meeting adjourned at 9 00 P.M dA, 741 6164a4 Ira L Schmidt, Mayor Pro Tern III ATTEST Evelyn Wells, Ci y Cler PASSED and APPROVED this /9 day of , 1981
