Snider. ROLL CALL: By Deputy City Clerk. Councilmen present were: S. K. Adams, Beverly Green, Charles Grigg, Ira Schmidt, E. A. Snider, Bill Wilkins and Gary Bosch. Also present were: Lee Kraft, City Manager; James Ajax, City Engineer; and Ted Johnson, Associate Engineer. VISITORS: There were no visitors wishing to address the council at this time. PUBLIC HEARING: (Verbatim) MAYOR SNIDER DECLARED THE PUBLIC HEARING OPEN TO CONDUCT A PRELIMINARY HEARING ON THE PROPOSED SYLVESTER PARK L.I.D. AND AT THE CONCLUSION ON THE HEARING, TOCOMDIDERAN ORDINANCE TO ACTUALLY CREATE THE L.I.D. It was noted that the hearing had been duly published and posted as required by law. At this time James Ajax, City Engineer read a letter that the City Clerk sent to the property owners involved in this L.I.D., it went as follows: "Dear Property Owner: As you are probably aware, a Local Improvement District in your neighborhood, specifically L.I.D. No. 112 Unit 1, was formed earlier this year and subsequently killed by protest. There were, no doubt, a number of reasons the L.I.D. was stopped by protest. The primary reasons the city heard about were: 1) High cost in general; 2) The unbearable hardship it would cause to people of low and low fixed income; 3) Peoplehavi,ngAomake annual payments with no option for monthly payments. Since that time several things have changed which have led the city to believe that a new L.I.D. may be acceptable to the neighborhood. We have discussed this with a number of people who protested the previous L.I.D. and they agree this new proposed L.I.D makes more sense. THINGS THAT HAVE CHANGED 1. LOWER COST: If you compare the preliminary assessment notice you are receiving in this package, you will find that it is 30% less than the amount you received on the previous L.I.D. This is now possible because we have actual bid prices. Further, the City of Pasco will and does hereby guarantee that your final assessment will be no more and possibly less than that stated on this preliminary notice. 2. GRANT MONEY AVAILABLE: The city has obtained a $40,000 HUD grant for the purpose of paying all, or at least part, of an eligible low-income homeowner's assessment. Families with income below the lower limit are eligible for 100% assistance. (Between these limits, the amount of assistance will be adjusted proportionately.) A family may not have assets in excess of $7,500. Assets include: real estate, (equity in the primary place of residence will be excluded from the asset limitation) bonds, savings accounts, certificates of deposits, stocks, other investments, notes receivable, antiques, jewelry, boats and other luxury items of substantial value. Assets do not include: necessary and usual personal household effects. The above requirements will have to be verified and all information is treated in a confidential manner. FINAL ASSESSMENT ROLL AND PAYMENTS: Upon the completion of all work a Final Assessment Roll will be prepared. It will then be placed in the hands of the City Treasurer. Notice of the Final Assessment will be sent to you. In addition, the City Treasurer will publish a notice that the Assessment Roll for this Improvement is in his hands for collection. You will then have thirty (30) days in which to pay the assessment without penalty or interest. The amount remaining unpaid at the end of thirty days may be paid in ten (10) annual installments of principal, plus Interest on the unpaid balance. 4. MONTHLY PAYMENTS: In lieu of lump sum annual installments, the City of Pasco will institute a monthly payment plan to assist property owners who would desire to utilize such a plan. Property owners wishing to make monthly payments will be required to come in and request such and to sign an agreement which outlines the terms and conditions. The property owners legal responsibility remains a single, lump sum annual payment. Use of the monthly payment plan will be voluntary. The City will send only one notice to users of the plan indicating the amount to be deposited monthly to make the annual assessment payment. No reminders will be sent other than the annual notice of monthly payment amount. No interest will accrue to the property owner's account. That is to say your monthly payment will be 1/12 of your annual payment. So actually rather than paying 1/12 of the annual payment each month, because it won't earn or save you interest, you would be better off putting the money in a bank or other investment and earn:interest all year and -then -make your(,annual payment. This is only a voluntary option and its up to you solely. 5. TIME OF CONSTRUCTION: It is anticipated that construction would begin in early August and be completed in late October. 6 FURTHER INFORMATION: For further information on this L.I.D. please call the Public Works Department, Engineering Division, at 545-3441 between 8:00 a.m. and 5:00 p.m. /S/ Evelyn 0. Wells, City Clerk Mayor Sniderasked if there were any questions from the Council for the staff. There were no questions by the Council. At that time the Mayor asked if there were any questions from the audience. Walter Hench, the property owner that led the defeat of the proposed L.I.D. 112, stated that he supported L.I.D. 115. MINUTES PASCO CITY COUNCIL SPECIAL MEETING June 25, 1981 PUBLIC MEETING: (continued) Also, Ted Johnson, Associate Engineer, received telephone calls today from: John Ells, 824 W. Nixon, Pasco and Frank Thomsen, 918 N. 7th Place, Pasco. For the record Mr. Ells and Mr. Thomsen support L.I.D. 115. Mr. Clare Creston questioned if there is a percentage of property tax used for the maintenance and repair of our city streets. Mayor Snider directed this question to Lee Kraft, City Manager. Mr. Kraft stated that there is not a statute that allocates property tax money for the use of maintenance and repair of streets. The funds for street maintenance and repair is received primarily from State gas taxes. At this time a gentlemen from the audience questioned if the Council can give some type of guarantee that funds will be available to make the necessary repairs on the streets when needed. Mayor Snider expressed that he felt that the City does have a responsibility toward the maintenance and repair of our City streets; however, this Council can not bind a future Council to this. Councilman Grigg pointed out that the City Council needs input from the residents to give Council an idea on what direction they are to take. That all the public would have to do is ask what has been put aside for the repair and maintenance of roads. It was pointed out that for this year's budget, only $15,000 was set aside for roads and that this L.I.D. will cost $187,000 if it passes. Councilman Wilkins supported Councilman Grigg and Mayor Snider. James Ajax, City Engineer, stated that there were no adverse written communications received on this L.I.D. However, there is still a thirty (30) day protest period should any property owner wish to protest. All protests are to be sent to City Clerk, P.O. Box 293, Pasco, WA 99301. Following three (3) calls from Mayor Snider for further comments from the floor, either for or against, the public hearing was declared closed. ORDINANCE NO. 2277: AN ORDINANCE ORDERING THE IMPROVEMENT OF THE SYLVESTER PARK AREA ALL IN ACCORDANCE WITH RESOLUTION NO. 1434 OF THE CITY COUNCIL; ESTABLISHING LOCAL IMPROVEMENT DISTRICT NO. 115; PROVIDING THAT PAYMENT FOR THE IMPROVEMENT BE MADE BY SPECIAL ASSESSMENTS UPON THE PROPERTY IN THE DISTRICT, PAYMENT BY THE MODE OF "PAYMENT BY BONDS"; AND PROVIDING FOR THE ISSUANCE AND SALE OF LOCAL IMPROVEMENT DISTRICT WARRANTS REDEEMABLE IN CASH AND LOCAL IMPROVEMENT DISTRICT BONDS. Ordinance No. 2277 was read by title only. Mr. Schmidt moved to adopt Ordinance No. 2277, which had the effect of creating L.I.D. No. 115, commonly referred to as the "Sylvester Park Area Street Improvement L.I.D." Seconded by Mr. Wilkins. Motion carried by roll call vote II of seven (7). Mr. Grigg moved to confirm and make as a matter of formal record, the fact that the City of Pasco has agreed and committed that the final assessments on L.I.D. NO. 115 will not exceed the preliminary assessments and, further, that strictly on a voluntary basis property owners will be allowed to make monthly installments toward their full annual L.I.D. assessments. Seconded by Mrs. Green. Motion carried by roll call vote of seven (7). Meeting adjourned at 8:35 p.m. Snider, Mayor Susan K. McCoy, Deput PASSED and APPROVED thi day of , 1981. Block Grant monies from the $173,000 established, to assist certain low income resident property owners in L.I.D. No. 112 in paying their L.I.D. assessments and to transfer said $40,000 into L.I.D. No. 115 for the same purpose. It should be noted that this reprogramming will not deprive anyone qualifying for H.U.D. assistance in L.I.D. No. 112, but rather and only that the amount of money originally programmed into L.I.D. No. 112 exceeded the amount needed. Seconded by Mr. Wilkins. Motion carried by roll call vote of seven (7). FURTHER BUSINESS: There will be an Executive meeting Monday, June 25, 1981, to discuss personnel and this will not be an open meeting. ADJOURNMENT: ATTEST:
