CALL TO ORDER
Meeting called to 'order at 8 00 P M bY Mayor Pro -Tem; Eql 'Snider
ROLL CALL
By City Clerk Councilmen present were S K Adams, Beverly Green, Charles
Grigg, Ira Schmidt and E A Snider Councilman Bill Wilkins was absent from
II/ the meeting due to illness ' Also present were Leland F Kraft, City Manager,
Dennis De Felice, City Attorney, Tom Criscola, Director of Finance, James Ajax,
City Engineer, John Hastig, Assistant City Engineer, Ted 'Johnson and Alan Lobdell,

ELECTION OF MAYOR
Ballotiroj for the election of Mayor (M'aYor Bailie resigned, effective 12/31/80)
commenced First ballot indfdated three (3) votes for E I A Snider and two (2)
votes for Sferl-Adaris Mr Adams moved that a unanimous ballot be cast for E A Snider
as Mayor of Pasco Seconded by Mr Schmidt Motion' carried by roll call vote of
five (5) E A SNIDER declared Mayor
Mr Snider thanked the councilmembers for their vote of confidence and stated that
succeeding Mr Bailie was going to be "a tough act to follow"
Balloting for the election of Mayor Pro Tern commenced First ballot indicated
three (3) votes for Ira Schmidt, one (1) vote for Sterl Adams and one (1) vote
for Beverly Green IRA SCHMIDT declared Mayor Pro Tem

Mr Adams moved that Consent Agenda be approved Seconded by Mr Schmidt
Motion carried by roll call vote of five (5) Consent items are as follows
a) Approval of Minutes Approve minutes of regular and special meetings,
held December 15th and 22nd respectively
b) Bills To approve General Claims in the amount of $538,503 15, claim
warrant nos 25680 through 25833
c) Hearing Pate - Adoption of Energy Code To fix 8 00 0 r , Monday,
February 2, 1981, in the Council Chambers at City Hail as the time
and place for a public hearing to consider local adoption of the
Washington State Energy Code and appropriate penalties for vio7ation
thereof
d) Golf Course Rezone (R-1 to C-1-1 1 ) To fix 8 00 P onday, January 19,
1981, in the Council Chambers at City Hall as the :ime and place for a
public hearing to consider the Planning Commission recommendation to
rezone 25 acres in the northwest corner of the Municipal Golf Cours2

MAYOR SNIDER DECLARED THE PUBLIC HEARING OPEN TO CONTINUE THE PUBLIC HEARING ON
FINAL ASSESSMENT ROLL ON L I D NO 106 -
It was noted that the hearing had been duly published and posted There were no
written communications received
Dile to the fact that two of the five councilmen present had an interest in the ,
area, they agreed to step down and not participate However, the City Attorney
stated the Council could invoke the Doctrine of Necessity so that all present could
vote on proposed L I D Both Councilman Grigg and Schmidt felt they could be fair .
and impartial without any problem
Mr James Ajax reported that work on the project is now essentially complete A
few clean up items remain to be done The final total cost, including extra work
agreements is $758,178 52 The total preliminary cost was $860,880 00 Due to
an HUD Block Grant in the amount of $367,974 00, the actual assessed amount for
the final assessment roll is $390,204 52 The preliminary roll was $497,906 00
This amounts to a reduction of 22% in the final roll If specials and extra
work agreements are left out and we look only at the general roll, we find the
preliminary general roll was $477,787 30 The final general roll is $343,041 04
This amounts to a reduction of 28 2% in the general roll Many property owners
in this area received this reduction due to the fact that they had no specials
or extra work agreements
Due to acquisition of land for a park between "B" Street and Ainsworth, 7th
Pvenue and 7th Lane from the County, along with other City-owned property, the
cost to the City is $44,629 22 This cost is included in the L I D

It was noted that the hearing had been duly published and posted There were no
written communications
Mr James Ajax reported that on August 18, 1980, the City of Pasco passed
Ordinance No 2183, creating L I D No 111 This L I D was in response to
a petition from local residents and business people in the area The original
estimate of the total cost of the project was $63,323 54 The project was
accomplished under a change order with the contractor for L I D No 107, with
change order total price of $49,750 25 A final total general assessment is
$45,881 37, with a total of special items of $12,944 26 for a grand total of
$58,825 63 The final general assessment roll is approximately 92 4% of the
preliminary assessment roll

FINAL ASSESSMENT HEARING
It was noted that the Hearing had been duly published and notifications
mailed to each property owner, as prescribed by law The City Attorney asked
the City Clerk if she was in receipt of an Affidavit of Publication and an
Affidavit of Mailing prior to P 00 P M , January 5, 1981 The reply was affirmative

In the fall of 1979, by Resolution No 1256, the City of Pasco mandated construction
of sidewalks on Sylvester Street from 20th Avenue to Road 28 After the legal
challenge of this action was denied by the Courts, the construction was commenced
and now has been completed The final total construction cost of the project
was $69,419 80 Total project cost, including all legal requirements, is
$82,957 83 Of this amount, citizens are being required to pay $77,067 73,when
the City's share of $5,890 10 is substracted By adoption of Resolution No 1393
, on December 11, 1980, City Council set the public hearing for January 5, 1981
Subsequent to the adoption of that Resolution, the required legal advertisement
and notice to property owners involved have been performed by the Engineering
Department

PIRLIC NEARING - Continued
Final project costs have exceeded preliminary project costs by 39 4% The
increase is primarily due to clauses necessary in the contract to allow
delayed award due to the lawsuit filed against the City in the matter Additional
unanticipated costs also arose due to legal interpretation of State and PMC
requirements as to advertising, etc , knowing of potential challenges
Mr Ajax concluded bystating he felt the assessments were fair and that the
property had been benefited to the amount it had been assessed
Mr Roy Strode expressed dissatisfaction over assessment due to the fact that
he was being charged for 123 83 feet of curb, gutter and sidewalk, when according
to his measurements, he only had 114 feet Staff replied that measurement of123 83
feet was physical measurement and his higher assessment was due to his lot being
lower than grade thus requiring more asphalt Mr Ajax expressed willingness to
meet with Mr Strode and re-measure his property, and if an error had been made,
the City would pick up the tab for the difference
Mr John Tucker gave verbal presentation and presented the following written
protest (John & Rose Mary Tucker, 2612 U Sylvester)
"Our property has a horseshoe driveway which gives us double entrance
and exits We spoke with the contractor prior to his completion of our
portion of the assessment We were told that for no extra charge, we
could have the entrances and exits replaced with some type inferior
material that would probably last two or three years, but if we wanted
to pay extra, we could have material put in that would be more permanent
Our reply was that we only wanted our driveway returned to their original
state We were charged 51,200 extra Not only is the extra charge
ridiculous, the workmanship is shoddy We are not even zoned into the
City of Pasco We will discuss this matter at the meeting "
Mr Ajax responded that he could not answer for any comment the contractor may
have made, however, more asphalt was needed at Mr Tucker's property because it
was lower than grade Mr Ted Johnson, Associate Fngineer, stated he spoke to
Mr Tucker and told him they could put in a graveled driveway, but Mr Tucker
insisted on asphalt To this, Mr Tucker asked, "Can you legally put in a
graveled driveway when we, had a 30-year old asphalt driveway which was still
usable?" Mr Ajax then responded that the sidewalks had been put in on public
right of way even though residents were officially in Franklin County
Mr Victor Zeller, 2620 W Sylvester, gave verbal presentation and submitted the
following written protest
"I have a cyclone fence 48 inches high and the sidewalk is 20 inches
in height You have created a safety hazard by putting the sidewalk
at this height There are about 24 inches of the fence above the side-
walk, there are sharp wires sticking up along the top of the fence
When they were putting in the sidewalk, the form kicked out, causing
about an 8 inch bulge, pushing into my fence I informed the foreman
of the job and he said it would be taken care of I also informed Mr
Ted Johnson, who is with the City Engineering Pepartment Mr Johnson
said they would landscape the part of the sidewalk alongside my parking
lot None of this was ever done Your estimate was about 51,700 and
I received a statement for $2,183 70 - how did you arrive at this figure?"
Mr Ajax again went over assessment process and informed Mr Zeller that work
done on the Sylvester Street Sidewalk was guaranteed for one year under the
Contractor's bond Staff will look into Mr Zeller's complaint

SYLVESTER STREET SIDEWALK PUBLIC HEARING
"My client, Richard Ryder, hereby files a formal written objection to the
final assessment of S3,043 08 levied against property owned by him situate
in the County of Franklin, State of Washington, and described as follows
W 1/2 W 1/2 NE 1/4 NW 1/4 W 1/2
SE 1/4, Section 25, T9N, R29EWM
The grounds for the objection are
1 The original preliminary assessment adopted by the Council on July 18,
1980, under Resolution No 1256 indicated that the estimate for the work would
be $2,295 00 for 165 feet including a driveway The final assessment exceeds
by more than 10% the preliminary assessment and is for only 147 feet of sidewalk
with no driveway
2 The charge of $415 24 for asphalt should not be charged against the
property owner since the asphalt was used by the construction crew to shore up
a portion which had given away underneath the sidewalk This problem was due
solely to the contractor's workmanship
3 The sidewalks were constructed on land upon which the City of Pasco
neither has an easement nor any ownership rights The City of Pasco has con-
structed the sidewalk on land owned by Pick Ryder and, therefore, cannot collect
the assessment of $3,043 08 from Dick Ryder since the sidewalk was not built on
either City-owned land or land upon which the City of Pasco has an easement
Please present this letter of objection, on behalf of Richard Ryder, to the City
Council at the time of the hearing on the Assessment Roll at 8 00 P M , January
5, 1(181 in the Council Chambers of City Hall of the City of Pasco

Lee Kraft, City Manager, supported the efforts of our City Engineer, stating that
this had been a difficult project, however, the City felt the property had been
benefited to the amount assessed

MAYOR SNIDER DECLARED THE PUBLIC HEARING OPEN ON NORTHWEST PASCO ANNEXATION
PREZONE
It was noted that the Hearing had been duly published and notifications to property
owners in a timely manner had been made
Mr Gary Crutchfield, Director of Community Development, stated that staff had met
with property owners in August (all owners were notified) to discuss the preparation
of Preliminary Zoning to be reviewed by the Planning Commission The general con-
census of that meeting was that the interchanges be recognized for commercial
potential and the balance be preserved in large ownerships until the basic utilities
are extended The benefits of this approach included better planning for utility
and street layouts and PUD's as well as avoiding premature escalation in property
values (taxes)
Staff recommended assignment of C-1-D at both interchanges (comparable acreage) and
R-T for balance of undeveloped large ownerships The property along Argent Road and
Court Street already developed was recommended for zoning classification similar to-
the existing development The Planning Commission, after a public hearing on
October 2, 1980, recommended the Council establish the Preliminary Zoning recommended
by staff A few changes in the pre-zone map were requested during the Council's
December 1st hearing - staff's response to each of those requests is contained in
Attachment F

NORTHWEST PASCO ANNEXATION - Continued
The Council should determine, in order
1) If further hearings are desirable (if so, the hearing should be
continued to a date certain)
2) What, if any, changes in the Pre-Zone Map are deemed appropriate
3) Whether or not to approve the proposed Pesolution (with attached map)
establishing the proposed zoning for the Northwest Pasco Annexation
Mr Crutchfield acknowledged correspondence from Wayne Wilson, Robert Brown
and Glenn Walkley and supplied copy of his response to each for the council's
perusal
In regard to zoning, the Wilson property (example) is presently zoned by Franklin
County as "Agriculture," the County Agriculture zone does not permit subdivisions
other than for farm labor The City's R-T zone is a temporary or "holding zone"
which is specifically designed and intended to be assigned to large parcels of land
which have urban development potential, but which do not, yet, have appropriate
urban services available The five-acre minimum requirement of the R-T zone is
specifically designed and intended to avoid premature divisions of large parcels
When adequate urban services can be demonstrated, the appropriate urban density
will be assigned to the land through the rezone process The process is identical
to the process presently employed by Franklin County
Further, Mr Crutchfield stated he had heard from Mrs Mary Gallant, owner of property
south of Glenn Walkley, and she, too, would prefer agriculture designation presently
given

At this point, Mr Crutchfield introduced Mr Sandy Mackey, Attorney for the
City of Pasco, who gave a history of proceedings thus far He acknowledged corres-
pondence from Attorneys in California, representing the Marjorie Stewart estate,
opposing location of Poad 100 Interchange They are going on record as wanting
it back to original location A petition signed by thirteen (13) property owners
in area had been submitted to the Boundary Review Board He reminded the council
that issue before the Council this evening was
, 1) Approve Environmental Impact Statement
2) Adopt map that staff has suggested or modified
He stated the Road 100 Interchange had been established by Franklin County and
Department of Transportation The City of Pasco concurred with alignment given
Mr Mackey again reiterated the zoning proposed and various uses He felt the
plan established a middle ground and would not change the life style of any
resident in the proposed annexation area For individuals interested in pursuing
the services of Richland, Mr Mackey stated that they had no plan available at the
present time

Further, if Resolution is adopted, it would read as it'has been presented to you
down to the language, BE IT BE RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO,
the following paragraph would be added
1) That the EIS is approved and determined to be adequate for the purpose of
pre-annexation zoning for the area indicated below
2) That the zoning map and text referred to below shall apply to the following
property when and if such property is annexed to the City of Pasco, the language
following that is the legal description of the property which is presently proposed
for annexation, as taken from the application to the Boundary Review Board and I
would ask the clerk, specifically, to include that in the Resolution
3) That in adopting the map for property described in Paragraph Two above, it is
the finding of this council that the map is consistent with the Pasco Comprehensive
and the minimum zoning reasonably necessary to accomplish the purposes set forth in
RCW 35A 14 330, and particularly, to promote coordinated development of unbuilt areas

4) May be taken directly from the Resolution proposed to the Council
5) That the zoning text in effect for the property described in Paragraph Two
shall be that zoning specified in Chapter 22 of the Pasco City Code, as amended
6) That there shall be no minimum time following the annexation before changes
may be considered to the zoning specified in Paragraph Four and Five above
Councilman Adams asked Mr Mackey if RT zoning would affect tax structure for
residents in area Mr Mackey replied that there would be no present effect on
people living in area, further, that development was what brought higher taxation
Mrs Jane McPherson, 6513 W Argent, expressed concern that RT zoning would increase
her taxes Staff replied that sub-dividing causes taxes to go up
Mr Wayne Drennan, 1831 Cartmell, stated he owned property at Rd 68 & Argent with
the hopes of relocating his business there With present zoning, that would be
an impossibility Staff replied if annexation occurred, Mr Drennan had the same
option open to him by the City as the County - he could apply for a zone change
Mr Harris reiterated that citizens in his area wanted the commercial zoning and
if they could not get it, we were forcing them to look to Richland for services
Mr Crutchfield countered by stating that Mr Harris' property was zoned agriculture
under the County with potential commercial
Mr David Harris, Road 111, reminded the Council that they needed sewer for
commercial development - why not zone their property commercial now?
Mr Wayne Wilson stated that pep)ple out there had not been included in the
comprehensive plan, further, the Planning Commission didn't give them the courtesy
of asking questions He urged that the hearing be continued until staff had had
an opportunity to meet with all the people He said residents in that area had
devoted many hours to the Comprehensive Plan, and if they couldn't get zoning
they wanted, they were being forced to look to Richland for services in order to
develop their property and pay taxes
Mr Andy Johnson, 1205 Rd 48, urged the Council to postpone adoption of items
presented to them this evening in order to reassess Franklin County's Comprehensive ,
Plan as it relates to land use He felt that sewer and water is the key to expansion
Mr Harry Bair reminded the Council that Pasco is sitting in the most lucrative area
to grow and the City and County should get together and work it out To this
statement, Mayor Snider commended residents of Block 1 who have given freely of their
time and effort to work out an amiacable solution
Mr Charles Hayde supported the City Council and staff for the start they have
made
Mr Sanderson stated the small farmer couldn't make a living on his farm now,
and without services, they were afraid to wait much longer
Mr Eugene Walter expressed sentiment that not all people wanted into the proposed
annexation area, however, he did not want to be part of Richland either
Mr David Wilson stated that the majority of people were not satisfied with the
plan and asked how could they get the City to change to what they wanted Mayor
Snider stated this was only a guideline to get started and the plan was flexible
Mr Anker Larsen commended the council's plan as opposed to the County's and felt
it was less money too

Mr Gary Crutchfield stated that Mr Ryder could not be in attendance this
evening, however, the proposed use was mini-storage facility and the Planning
Commission determined that the requested C-3 zone would not be detrimental
to neighboring properties or developments
Mr Leonard Dietrich questioned access onto Lewis Street at that location and
he was assured area would be ditched so that egress and ingress would be stopped

Ordinance No 2226 was read by title only Mr Grigg moved to adopt Ordinance

Resolution No 1394 was read by title only Mr Grigg moved to adopt Resolution
No 1394, establishing the method of payment of assessments for the Sylvester

Resolution No 1395, accepting work done by Tri City Paving, Inc for work done

RESOLUTION NO 1396 (Proposed Zoning Regulation for Northwest Pasco Annexation)
A RESOLUTION ESTABLISHING THE PROPOSED ZONING REGULATION
FOR THE NORTHWEST PASCO ANNEXATION
Resolution No 1396 was read by title only Prior to motion, the following
verbatim statement was given by Sandy Mackey, Attorney
"Mr Mayor, I would like to suggest for the record so that they have
the proper language - some additions if I may at this time
The Resolution would read as it has been presented to you down to the
language, BE IT BE RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO,
the following paragraph would be added
1) That the EIS is approved and determined to be adequate for the purposes
of pre-annexation zoning for the area indicated below
2) That the zoning map and text referred to below shall apply to the following
property when and if such property is annexed to the City of Pasco, the language
following that is the legal description of the property which is presently
proposed for annexation, as taken from the application to the Boundary Review
Board, and I would ask the clerk,specifically, to include that in the Resolution
3) That in adopting the map for property described in paragraph two above, it is
the finding of this council that the map is consistent with the Pasco Comprehensive
Plan and the minimum zoning reasonably necessary to accomplish the purposes set
forth in RCW 35A 14 330, and particularly, to promote coordinated development of
unbuilt areas
4) May be taken directly from the Resolution proposed to the Council
5) That the zoning text in effect for the property described in paragraph two
shall be that zoning specified in Chapter 22 of the Pasco City Code, as amended
6) That there shall be no minimum time following the annexation before changes
may be considered to the zoning specified in paragraph four and five above "

REQUEST FOR ADDITIONAL CHANGE ORDER AUTHORIZATION PFC4RDING GOLF COURSE
REDEVELOPMENT PROJECT Mr Grigg moved to authorize staff to approve up to
$50,000 in additional change orders for the golf course redevelopment project

APARTMENTS IN C-1 ZONE - 24TH & LEWIS STREET I move to find that the residential
use of the property situated at the northwest corner of 24th & Lewis Street, does not
conflict with the Comprehensive Plan or the public interest and, therefore, authorize
residential development of said property Seconded by Mr Schmidt Motion carried
by roll call vote of five (5)
LEASE AGREEMENT - FDERAL AVIATION ADMINISTRATION Mr Grigg moved to authorize
the Mayor to sign the attached Lease of the Federal Aviation Administration
Seconded by Mrs Green Motion carried by roll call vote of five (5)
MISCELLANEOUS
Mr Grigg moved to hold workshop meeting of the City Council on January 15, 1981,
instead of regularly scheduled one on January 12, 1981 Seconded by Mr Schmidt
Motion carried by roll call vote of five (5)
Mr Adams moved to excuse Councilman Bill Wilkins due to illness Seconded by
Mr Grigg Motion carried
