REGULAR MEETING
FEBRUARY 2, 1981
CALL TO ORDER
Meeting called to order at 8 00 P M by Mayor Pro Tern, Ira Schmidt
ROLL CALL
By City Clerk Councilmen present were S K Adams, Beverly Green, Charles
Grigg, Ira Schmidt and Bill Wilkins Councilman/Mayor E A Snider was absent
from the meeting (excused - illness) Also present were. Lee Kraft, City Manager,
Dennis De Felice, City Attorney, Tom Criscola, Finance Director, James Ajax, City
Engineer, Acting Police Chief, Capt Dennis Kasparek, Webster Jackson, Administrative
Assistant and Gary Crutchfield, Planner
CONSENT AGENDA
Mr Grigg moved that Consent Agenda be approved Seconded by Mr Wilkins Motion
carried by roll call vote of five (5) Consent items are as follows
a) Approval of Minutes To approve minutes of regular meeting, held
January 19, 1981
b) Bills To approve general claims in the amount of $429,233 59, claim
warrant nos 25966 through 26146
To approve payroll claims in the amount of $142,327 90, payroll warrant
nos 7,331,581 - 7,331,739 and 7,368,764 - 7,368,929
c) Public Transit To approve the Benton-Franklin Governmental Conference
Calendar of Events, submitted to the Council at the Workshop Meeting on
Tuesday, January 27, 1981, by George Kloeppel, Executive Director of
the Benton-Franklin Governmental Conference
d) Proposed East Pasco Water Booster Station - Authorization to Negotiate
a Proposed Contract with CI-12M-Hill for Professional Engineering Services
To authorize staff to negotiate a proposed contract for professional
services with CH2M-Hill relating to engineering on the first phase of the
East Pasco Water Booster Station
e) Planning Commission Recommendation - Amendment of Rezone Process To
fix 8 00 P M , Tuesday, February 17, 1981, in the Council Chambers at
City Hall, as the time and place for a public hearing to consider amend-
ment of PMC Chapter 22 88, Amendments and Rezoning
f) Authorization to Call for Bids - Mosquito Spraying Equipment To
authorize the staff to call for bids on a mosquito control applicating
machine
g) Application Fees To fix 8 00 P M , Tuesday, February 17, 1981, in -
the Council Chambers at City Hall, as the time and place for a public
hearing to consider increasing certain application and permit fees
h) Resolution No 1401 A Resolution promulgating guidelines for certain
City Boards and Commissions to respect in the conduct of Quasi-Judicial
public hearings
1 1 Resolution No 1402 A Resolution authorizing the Mayor of the City of
Pasco to enter into an Agreement with the County of Franklin (Park site
at 7th and "C" Streets)
J) Hearing Date - BNL Rezone, R-1 to C-3 To fix 8 00 P M , Tuesday,
February 17, 1981, in the Council Chambers at City Hall as the time
and place for a public hearing to consider the BNL rezone from R-1 to C-3
k) Authorization to Sell Surplus Vehicles - (4) Police Cars To authorize
staff to advertise for bid to sell four 1979 Police patrol vehicles
that have been replaced, subject to a minimum bid of $1,200 Should no
bids be received, the staff is also authorized to negotiate a sale
subject to a minimum sale price of $1,000

To authorize the staff to call for bids on traffic striping paint and glass beads
PUBLIC HEARINGS
MAYOR PRO TEM SCHMIDT DECLARED THE PUBLIC HEARING TO CONSIDER PLANNING
COMMISSION'S RECOMMENDATION TO AMEND THE ZONING CODE REGARDING RESIDENTIAL
USES IN COMMERCIAL ZONES
It was noted that the hearing had been duly published and posted There were
no written communications received
Mr Gary Crutchfield stated that the Planning Commission, at Council direction,
considered amendment of the commercial district use regulations regarding
dwelling units They concluded that commercial districts are disrupted by
apartment buildings, to the financial detriment of the community and immediately
neighboring owners The Commission recommended that dwelling units be permitted
in commercial zones only under certain conditions through the special permit
process, the intent of the conditions are to assure that commercially zoned
property is principally used for commercial development Further, that consideration
should be given to the possibility of apartment buildings in the downtown area
Mr Crutchfield suggested closing the hearing and referring this back to the
Planning Commission for further consideration
Mr Gleyn Bledsoe, Jr , owner of Hallmark Apartments, had reservations about
benefits vs cost He is converting the Hallmark Apartments to Senior Citizen
housing and the banks are reluctant to finance buildings in a non-conforming
status Staff thanked Mr Bledsoe for his input and stated if he could not
be in attendance at future public hearing regarding this matter, he could submit
his input in writing
Mr Grigg moved to return the Code amendment recommendation to the Planning
Commission for further study and modification regarding apartment buildings
which exceed 50% of gross floor area Seconded by Mr Adams Motion carried
by roll call vote of five (5)
MAYOR PRO TEM SCHMIDT DECLARED THE PUBLIC HEARING OPEN TO CONSIDER REZONING
THE SE 1/4, SEC 17, NW QUARTER, SEC 21, T9N, R30 EWM FROM C-3 to I-1
It was noted that the Hearing had been duly published and posted There was one
(1) communication received from James C Holland, requesting that Short Plat
78-11 be deleted from the proposed zone change
Mr Gary Crutchfield declared that several property owners had jointly proposed
to establish an "industrial park" in the area commonly referred to as the Columbia
East area (NE of the Oregon Avenue Interchange) The owners, in conjunction with
the Planning Office, have established restrictive covenants to be enforced by the
property owners through their review board These restrictions would apply to all
property zoned I-1 with the covenants assigned by concomitant agreement
The Planning Commission, after public hearing, recommended approval of the rezone
if conditioned to include the covenants and if modified to include all of the
intervening parcels so as to assure a unified and identifiable block of land
operating under the same rules Some of the owners on the west side of Commercial
Avenue chose not to join the rezone application and, consequently, the rezone
should not include any of the Short Plat #78-11 The large parcel east of the
existing RMH-2 zone and owned by Mr Holland has not been included by con-
comitant agreement, as yet Staff recommends and Ordinance for the Council to
consider rezoning the parcels which have submitted concomitant agreements, the
balance of the rezone area (Mr Holland's) should be delayed to include concomitant
agreement

PUBLIC HEARING - COLUMBIA EAST, Continued
Mr Roger Gray, representing two (2) owners in area, supported the proposed
zone change as he had potential businesses wishing to locate in the park, but
they need an industrial zone The finished development would have streets, sewer,
water, curb and gutter It would be an asset to the community and provide needed
jobs as well as tax base
Following three (3) calls for further comments from the floor, either for or
against, the public hearing was declared closed

ADOPTION OF THE WASHINGTON STATE ENERGY CODE AND APPROPRIATE PENALTIES FOR
VIOLATION THEREOF
It was noted that the hearing had been duly published and posted There were no
written communications received
VI'. Gary Crutchfield reported that the Washington State Energy Code was created at
the direction of the legislature by the State Energy Office, however, the Code was
not clearly adopted by the legislatune nor is it clearly an administrative rule
which must be complied with State-wide Hence, the matter has been brought before
the Council The potential benefits of adopting such a code are fairly plain
1 Reduced monthly cost to tenant for energy consumption (electric as well
as gas and oil)
2 Long term reduction of community wide energy consumption
Both of these benefits will become more significant with each year that passes because
I Anticipated decontrol of oil prices will result in higher cost for heating
fuel
2 The cost of electricity will rise annually, as it has been over the past
several years
3 The monthly heating bill paid by a tenant is a direct, non-deductible
expense whereas the cost of energy conservation improvements are tax
deductible
4 As BPA implements an allocation policy which recognizes conservation efforts
and penalizes excessive consumption at the community level, the growth rate
1 of the community could be seriously affected
Staff has met with several local builders They indicated the following objections
1 The Energy Code represents more regulations and additional bureaucracy
2 The increased cost of new construction under the Energy Code will aggravate
the qualification problem being experienced by potential home buyers
3 The Energy Code does not apply to the mobile home industry
Staff concurs with the builders regarding the mobile home problem, indeed, if
the City required all other structures to conform to the Energy Code (which will
result in higher product cost), there will be an increased encouragement of mobile
homes in lieu of conventional structures and, ultimately, the objective of the
Energy Code (reduced energy consumption) will be thwarted
The builders have agreed to address the energy consumption problem through their
local and State Association Staff suggests their efforts be encouraged and aided
where appropriate To that end, staff recommends the Council close the hearing
and defer further consideration of this matter for six months
Mr Charles Waugh, Washington State Energy Office, was introduced and commented
on the Energy Code from an affirmative standpoint and concurred that there were
no penalties involved if not adopted at this time
Following three calls for further comments from the floor, either for or against,
the public hearing was declared closed
Mr Adams moved to suspend further consideration of the Washington State Energy
Code for a minimum of six (6) months Seconded by Mr Grigg Motion carried
by roll call vote of five (5)

MAYOR PRO TEM SCHMIDT DECLARED THE PUBLIC HEARING OPEN ON FINAL ASSESSMENT
ROLL FOR L I D NO 110 (West of 20th Avenue)
work left to be done All final assessments are less than 90% of the preliminary
assessments with the exception of individual property owners who requested and
received extra improvements They were assessed separately for the cost of
improvements
Pictures of the L I D area taken before construction started were presented
for the council's perusal as well as pictures taken after the improvement Mr
Ajax further reported that he had met with a citizen group and representatives
from the Pasco School District to formulate a signing plan for the area With
input received, staff felt confident that the through traffic situation with the
aid of traffic signs and crosswalks will be substantially improved With respect
to assistance to low income property owners, Mr Jackson indicates several individuals
are working with him on obtaining the available grant money
Mr Bill Huibregtse, Consulting Engineer for R R Jump, concurred with statement
of City Engineer and stated there were three areas within the project that they
were unable to get full road right of way, therefore, they were assessed accordingly
Total final assessment roll was $1,462,76l 86 as opposed to preliminary roll of
S1,655,930 00 His conclusion was that the property had been benefited to amount
assessed
The following letter of opposition was received from Robert & Tami Kuzinskie,

" We wish to submit the following protest on the basis of a number
of points
1 The assessment form requests from the Kerskakes, some $2,900 for a
street The street was already in existence All that was done was
repaving I find it difficult to believe the City of Pasco would throw
away that much of the tax payer's money on repaving
2 During the improvement program, our irrigation pipes were jerked loose
from our pump due to a slight miscalculation on the part of the contractors
as to the location of the irrigation pipes beneath the street We were
promised repeatedly that this would be fixed by the contractors (in the
presence of witnesses from the Irrigation District at one point) There
has been no effort to determine the extent of the damage, let along fix it
3 The entrance to our driveway is now a 3-inch drop of from the street and
at one time was high enough to contact with the undercarriage of one of our
automobiles If no real damage was done to the vehicles or the tires, the
psychological strain was and is, rather significant Uhen complaints were
made, we were told, "that's not our problem "
4 No improvements have been made on any property adjacent to ours This
assessment and request for funds is totally amaxing in light of the facts "
rr Ajax responded to allegations by stating this was one of the properties which
did not have full width right of way He assured the Council that irrigation
line and entrance to driveway would be taken care of He, again, reiterated that
property had been benefited by addition of fire hydrants, street improvements and
street lighting
It was noted that the hearing had been published, and notifications sent to
property owners, as prescribed by law II/Mr James Ajax reported that the project was basically completed with only minor

AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON APPROVING AND CONFIRMING
THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO
110 FOR THE IMPROVEMENT OF ROAD 28 FROM SYLVESTER STREET TO BROWN AND
CERTAIN OTHER STREETS WITHIN THE CITY
Ordinance No 2236 was read by title only Mr Grigg moved that Ordinance No

ORDINANCE NO 2237
AN ORDINANCE RFLATING TO THE BOARD OF APPEALS FOR THE UNIFORM
BUILDING CODE BY AMENDING 16 04 020 OF THE PASCO MUNICIPAL CODE
Ordinance No 2237 was read by title only Mr Grigg moved that Ordinance No
2237 be adopted Seconded by Mr Adams Motion carried by roll call vote of
five (5)
NEW BUSINESS
LAND SALE - URBAN RENEWAL AREA Mr Grigg moved to authorize staff to initiate
default proceedings of the Tomich Agreement and re-advertise the land for sale
Seconded by Mr Wilkins Motion carried by roll call vote of five (5)
AGREEMENT FOR 1981 BETWEEN TRI CITIES VISITOR & CONVENTION BUREAU, INC
AND THE CITY OF PASCO Mr Grigg moved that the Mayor sign the agreement between
the Tri Cities visitor & Convention Bureau, Inc and the City of Pasco, for services
to be performed by the Convention Bureau during 1981 Seconded by Mr Wilkins
Motion carried by roll call vote of five (5)
MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL
Mr Grigg moved to excuse Councilman/Mayor Snider's absence due to illness Seconded
by Mr Wilkins Motion carried by roll call vote of five (5)
The City Manager announced the following 1) Tour of City on February 9, 1981
at 9 00 A M 2) There are 14 applicants for the vacant post of councilman
These will be considered in Executive Session on February 9, 1981 3) Pasco has
six (6) firemen starting the Paramedic Program which should be of interest to citizens
COMMENDATION TO OFFICER TERRY TRULSON A letter of commendation was read to Officer
Terry Trul son of the Pasco Police Department by Capt Dennis Kasparek Officer Trul son
aid ed an emotionally disturbed gentleman to seek professional help which was most
appreciated by the young man's parents They, too, sent a letter of appreciation
