REGULAR MEETING SEPTEMBER 2, 1980
CALL TO ORDER
Meeting called to order at 8 00 P M by the Honorable Chet Bailie, Mayor
ROLL CALL
By City Clerk Councilmen present were S K Adams, J C Bailie, Beverly Green,
Ira Schmidt and Bill Wilkins Councilmen Charles Grigg and E A Snider were absent
from the meeting (excused) Also Present were Leland Kraft, City Manager
Tom Criscola, Director of Finance, James A -lax. City Engineer, John Hastig, Assistant
City Engineer, Dick Erickson, Director of Parks/Recreation Webster Jackson,
Administrative Assistant,: Gary Crutchfield, Director of Community Development and
Ken Neilsen, Data Processinn Supervisor
CONSENT AGENDA
Mr Adams moved that Consent Agenda be approved Seconded by Mr Schmidt Motion
carried by roll call vote of five (5) Consent items are as follows
Approval of Minutes To approve minutes of renular and special meetinns,
held Aunust 18th and 25th, respectively
Bills To annrove General Claims in the amount of 758,230 70, claim
warrant nos 2A536 through 2 1t652
Residential Structure in C-1 Zone (Hamilton, 80-38) To authorize the
pronosed A-plex at the SE corner of Ath Lane and "A" Street (in a C-1
zone) and to confirm that it is in harmony with the Comprehensive Plan
and not contrary to the public interest and, further, to authorize
construction of a A-plex on Lots 30 - 32, Block A, Gray's Amended Addition
Urban Renewal Land Sale To approve the sale of Lots 392, 393 and 39A, Block
12, Terrace Heights Addition, to Mr Rudy Tomich for '4 1 .230 00
Red Lion Banquet Facility - Certificate of Occupancy To nrant the
Red Lion/Thunderbird Corporation a temporary occupancy permit for a
period Of 60 days and extending from month to month thereafter, as 'Ion('
as Red Lion is pursuinn legal action in the court to net the Amoco Service
Station removed from its premises
Resolution No 1369 )5 Resolution accepting the work done by Ray Poland

Resolution No 1370 A Resolution abandoning a sewer line within the
Utility Easement on the vacated alley and street between Front Street and
Main Street from Holden Street to the vacated Marvin Street
Remodelinn of Memorial Swimminn Pool To authorize staff to call for bids
for the remodelinn of Memorial Swimming Pool

Hater & Sewer Rate Study To authorize City Engineer Jim Alax to compile and
develop a water and sewer rate study with the understanding that Mr Ajax will
be compensated for off-duty time snent in compiling the study
PUBLIC HEARINGS
MAYOR BAILIE DECLARED THE PUBLIC HEAPING OPEN TO CONSIDER ANNEXATION OF A
3/A ACRE PARCEL AT THE NY CORNER OF 36TH AVENUE . AND COURT STREET
It was noted that the Hearinn had been duly odblished and posted as required by
Law There were no adverse communications received
Mr Gary Crutchfield, City Planner, stated that subsequent to failure of a larner
annexation proposal, Mr & Mrs McGrath petitioned the City Council to annex a
3/4 acre parcel at the NU corner of 36th & Court The Boundary Review Board
(October, 1 0 79) granted a one-year blanket anoroval cf qualified annexations
within the Road 36 sanitary sewer service area, established by agreement between
the City and County under Auditor's File 378988
The City Mananer reported that Mr Grinn had asked him to convey his sentiments
that under the circumstances, the McGrath property should assume the bonded
indebtedness
Mr Crutchfield defended petitioner's reouest by statinn that they had been given
Preliminary approval by the City a year ano therefore should not have to assume
any bonded indebtedness

AN ORDINANCE RELATING TO ANNEXATION AND ANNEXING A TRACT OF LAND
TO THE CITY OF PASCO (McGrath Annexation)
nrdinance No ?18A was read by title only Mr Schmidt moved that Ordinance No
218A he adooted Seconded by Mr Wilkins Motion carried by roll call vote of
five (5)
ORDINANCE NO 2185
AN OPDINANCF RELATING TO 70NING AND CHANGING THE ZONING CLASSIFICATION
OF CERTAIN PEAL PROPERTY wITHIN THE CITY OF PASCO FROM C-1 (Retail
Business) TO R-3 (High Density Residential) (Bonneville Street)
Ordinance No 2185 was read by title only Mr Schmidt roved that Ordinance No
2185 be adopted Seconded by Mr Wilkins
Councilman Adams voiced his onnosition to downnradinn any zoninn unless it was at
the request of the Property owner
Mr Gary Crutchfield stated that the one change recommended by the Planning
Commission and heard by the City Council on August 18th included chancing the
Present C-1 zone on the north side of Bonneville Street immediately west of
18th Avenue to P-3 Since the public hearinn on Aunust 18th, Mr Clark (owner of
the office buildinn at the northwest corner of 18th & Bonneville has contacted
staff and renuested that his 3 lots not be changed to R-3 Assuminn the Council
wishes to effect a consistent policy renardinn down-zone actions initiated by the
Planninn Commission, staff has taken the liberty to prepare an Ordinance which
would channe the present C-1 7one assinned to the existinn A-plexes to R-3, but
would leave the C-1 zone assinned to Mr Clark's property

UNFINISHED BUSINESS
REVISION OF SFMI-FINPL PAYMENT - PROJECT NO 78-3-0 4 , LEWIS STREET AND PROJECT
NO 78-3-10, COURT STREET
Mr Schmidt moved to approve the Revised Semi-Final Payment No 6 and Revised
Final Quantities for Proiect No 78-3-04 and 78-3-10, Proiects previously
accepted by Council Resolution No 1357 Seconded by Mr Wilkins Motion
carried by roll call vote of five (5)
NEW BUSINESS
OFF PREMISE SIGNS IN THE DOWNTOWN APEA The following correspondence was re-
ceived from Gary Crutchfield, Director of Community Development
"The recent complaint regarding the off- premise sign for Phil's High
Chaparrel Restaurant on Lewis Street has revealed a lack of enforcement
of a section of the sign code regarding off-premise signs in the down-
town area Specifically, Section 17 56 120 (PMC) prohibits off premise
signs within the downtown area unless a special Permit is granted by the
Board of Adiustment for an off premise directional sign Further Section
17 52 010 (PMC) requires any nonconforming sign existing on July 6, 1971
to be removed within five years from the date the Sign Code was adopted
The Building Division has checked their records and indicate no record of
enforcement of these sections of the Sinn Code nor any record of special
permits beinn nranted It is now approximately four years beyond the
date of compliance spelled out under Ordinance No 1 4 J1 in 1970 Rather
than charge Off in an effort to enforce the Code requirement, I felt it
prudent to present the issue to vou for possible Council discussion
Essentially, there are several nonconforming off-premise sinns within the
specified downtown area that should have been removed before 1976 or which
should have been granted a special permit by the Board of Adiustment be-
fore 1976 Administratively, we can survey the downtown area and inventor/
the nonconforminn off-premise signs, notify the owners of the nonconforming
status, and provide a short time frame (30 days) to remove them or apply
for a special permit Since this action might nenerate a few phone calls to
Councilmen, it may be wise to inform the Council at a Workshop meeting prior
to carryinn out enforcement plans "
Mr Jack Graham, owner of Pasco Motor Inn, presented the Council with a written
rebuttal to enforcement and urged the Council to allow Mr Williams to continue
his operation by the addition of advertising He could not see where the directional
sign was a hindrance to any business in the downtown area
It was the concensus of the Council that they should abide by present Ordinance in
effect, and encouraned Mr Graham to apply for a special permit from the Board of
Adjustment
'Mr Schmidt moved to provide a 60-day period of time, dating from September 2,
1980, for the affected downtown property owners with offendinn off-premise directional
signs to remove the signs or apply for a special Permit from the Roard of Adiustment
Seconded by Mr wilkins Motion carried by roll call vote of five (5)
MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL
Council raised concern over broken nlass in front of Frank's Grill Staff will
check this out

Mrs Green moved that the City Mananer be authorized to enter into Finder's Fee
Agreements for any sale of the Golf Course pronerty at a fee not to exceed
1 1/2% Seconded by Mr Wilkins Motion carried by roll call vote of five (5)

UORKSHOP ITEMS - Continued
**Council discussed memorandum from Planning Commission, regarding zoning
studies made in August It was concluded that staff should prepare a
code amendment for consideration which would require property owners to
rezone commercial land if they wanted to build apartment structures
