Clerk Councilmen present were S K Adams, J C Bailie, Beverly Green, Charles Grigg, Ira Schmidt and E A Snider Councilman Bill Wilkins was absent from the meeting Also present were Lee Kraft, City Manager, Dennis De Felice, City Attorney, Larry Noland, Assistant Finance Director, James Ajax, City Engineer, Richard Erickson, Director of Parks & Recreation, Webster Jackson, Administrative Assistant and Gary Crutchfield, Director of Community Development CONSENT AGENDA Mr Snider moved that consent agenda be approved Seconded by Mr Grigg Motion carried by roll call vote of six (6) Consent items are as follows a) Bill Approval ' To approve General Claims in the amount of $1,322,705 67, claim warrant nos 24802 through 24976 b) To approve Payroll claims in the amount of$218,496 39, claim warrant nos 39571 through 39743 c) To write off $4,520 95 Water/Sewer bad debts and refer the accounts to the Collection Agency d) Approval of minutes To a:It-wove minutes of regular and special meetings, held September 15th and 22nd respectively i e) Resolution No 1373 A Resolution establishing a council policy regarding Park Capital Improvement Planning in Piverview Area of West Pasco f) 1980 Utility Rate Study To confirm Mayor Bailie's appointment of Councilmembers Adams, Schmidt and Grigg to serve as a Council Committee to meet with staff on development of Water Rate Study g) Addendum to the 1977 Comprehensive Water Plan - A Study of the High Pressure Zone Servicing East, North and West Pasco To confirm and approve of the contract with CH2V-Hill, Consulting Engineers, place for a public hearing to consider the Planning Commission's recommendation regarding the Campbell Rezone PUBLIC HEARINGS BLOCK GRANT PUBLIC HEARING MAYOR BAILIE DECLARED THE PUBLIC HEARING OPEN FOR THE PURPOSE OF AMENDING THE FY-80 ENTITLEMENT BLOCK GRANT APPLICATION FOR THE USE OF GRANT FUNDS TO ASSIST LOW INCOME HOMEOWNERS RESIDING WITHIN THE WEST OF 20TH L I D PROJECT AREA It was reported that the Hearing had been duly published and posted There were no written communications received Mr Webster Jackson reported that the purpose of this amendment is two fold, first, the City amended its FY-79 Block Grant application back in July in order to use $57,000 for the Senior Center and $4,000 to settle an outstanding Urban Renewal claim for a total of $61,000 It was thought at that time that the excess from Library Area Storm Drain Project and program income from the sale of Urban Renewal land would be sufficient to allow the use of the $61,000 from FY-79 Program As it turned out, we need to return $21,000 to the Library Area Project The second is to add the "West of 20th Avenue L I D " to the FY-80 Program and allocate $40,000 to be used to assist low-income homeowners with their assessments Following three (3) calls from Mayor Bailie for further comments from the floor, either for or against, the public hearing was declared closed Mr Snider moved to approve the amendment of the City's FY-80 Entitlement I Application and authorize the City Manager to execute it and submit it to the appropriate agencies for approval Seconded by Mr Grigg Motion carried by roll call vote of six (6) MAYOR BAILIE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER AMENDMENT OF CHAPTER 17 32 (Sign Code) OF THE PASCO MUNICIPAL CODE It was reported that the Hearing had been duly published and posted There were no written communications received Mr Gary Crutchfield suggested the use of Board of Adjustment as Hearing Body, further, that he had drafted a proposed amendment which provides that wall signs may be larger if approved by the Board of Adjustment through special permit process The amendment includes standards to be used by the Board of Adjustment in reviewing any such application A brief discussion was held on whether or not the Board of Adjustment should be the final authority After a thorough explanation, the Council concurred with original logic Following three (3) calls from Mayor Bailie for further comments from the floor, either for or against, the Public Hearing was declared closed MAYOR BAILIE DECLARED THE PUBLIC HEARING OPEN ON PROPOSED USE OF ENTITLEMENT PERIOD TWELVE REVENUE SHARING FUNDS It was reported that the Hearing had been duly published and posted There were no written communications received It is estimated that $328,400 will be received during the next fiscal year All entitlement monies received to date have been appropriated Citizens attending the public hearing have the right to provide written and oral comments and suggestions with respect to possible use of Entitlement Funds Following three (3) calls from Mayor Bailie for further comments from the floor, either for or against, the public hearing was declared closed MINUTES PASCO CITY COUNCIL REGULAR MEETING ORDINANCES ORDINANCE NO 2189 AN ORDINANCE RELATING TO SIGNS AND AMENnING SECTION 17 32 040 OF THE PASCO MUNICIPAL CODE OCTOBER 6, 1980 Ordinance No 2189 was read by title only Mr Snider moved that Ordinance No 2189 be adopted Seconded by Mr Grigg Motion carried by roll call vote of six (6) ORDINANCE NO 2190 AN ORDINANCE FIXING THE AMOUNT OP THE An VALOREM TAX LEVIES, THE PAYMENT OF PRINCIPAL AND INTEREST UPON THE GENERAL BONDED INDEBTEDNESS OF THE CITY OF PASCO FOR THE FISCAL YEAR 1981, THE AMOUNT FOR DEPOSIT TO THE LOCAL IMPROVEMENT GUARANTY FUND FOR 1981, LEVYING THE ANNUAL AD VALOREM TAXES OF THE CITY OF PASCO FOR THE FISCAL YEAR 1981, AND A PORTION OF THE SAME TO CERTAIN FUNDS POR CERTAIN PURPOSES Ordinance No 2190 was read by title only Mr Grigg moved that Ordinance No 2190 be adopted Seconded by Mr Snider Motion carried by roll call vote of six (6) ORDINANCE NO 2191 AN ORDINANCE PROVIDING FOR THE ISSUANCE OF LOCAL IMPROVEMENT DISTRICT NO 111 WARRANTS, SETTING THE RATE OF INTEREST FOR SAID INTEREST BEARING WARRANTS, AND NAMING PEOPLES NATIONAL BANK AS THE LENDING INSTITUTION Ordinance No 2191 was read by title only Mr Grigg moved that Ordinance No CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM R-1 LOW DENSITY RESInENTIAL TO R-2 MEDIUM DENSITY RESIDENTIAL, AS CONDITIONED BY CONCOMITANT AGREEMENT Ordinance No 2192 was read AN ORDINANCE RELATING TO ZONING AND CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM R-1 LOW DENSITY RESIDENTIAL TO R-2 MEDIUM DENSITY RESIDENTIAL, AS RESOLUTIONS RESOLUTION NO 1374 A RESOLUTION OF THE CITY OF PASCO ENDORSING AND URGING APPROVAL BY THE VOTERS OF REFERENDUM 38 ON NOVEMBER 4, 1980 Resolution No 1374 was read in its entirety by Councilman Snider Mr Snider moved that Resolution No 1374 be adopted Seconded by Mr Grigg Motion carried by roll call vote of six (6) RESOLUTION NO 1375 f A RESOLUTION OF THE CITY OF PASCO ENDORSING AND URGING APPROVAL BY THE VOTERS OF REFERENDUM 39 ON NOVEMBER 4, 1980 Resolution No 1375 was read in its entirety by Councilman Snider Mr Snider moved that Resolution No 1375 be adopted Seconded by Mr Schmidt Motion carried by roll call vote of six (6) UNFINISHED BUSINESS FIRESIDE ANNEXATION Mr Snider moved that the following language be placed on November 4, 1980 ballot regarding Fireside Annexation Seconded by Mr Grigg Motion carried by roll call vote of six (6) City of Pasco Annexation Proposition "Shall the land described in the City of Pasco Ordinance No 2172, Resolution No 1358 be annexed into the City of Pasco?" Annexation - Yes Annexation - No NEW BUSINESS NORTHWEST PASCO ANNEXATION - AUTHORIZATION TO RETAIN SPECIAL COUNSEL Mr Grigg moved to authorize the City Manager to retain special legal counsel for the proposed Northwest Pasco Annexation, in an amount not to exceed $3,000 and, further, direct that a supplement appropriation be prepared for said expense Seconded by Mr Snider Motion carried by roll call vote of six (6) COURT STREET OVERLAY - 4th to 14th Mr Snider moved to award construction contract for the Court Street Overlay (4th to 14th),to the low bidder, L W Vail Company, Inc in the amount of $31,725 00, all in response to their proposal, as submitted and further, authorize the Mayor to sign the contract documents on behalf of the City Seconded by Mr Adams Motion carried by roll call vote of six (6) MINUTES PASCO CITY COUNCIL OCTOBER 6, 1980 REGULAR MEETING NEW BUSINESS - Continued BID RESULTS - MEMORIAL SWIMMING POOL Mr Snider moved to award the bid for the additions and modifications to Memorial Swimming Pool to Deminsion Construction, Inc and Ditzler Mechanical Contractors, in the amount of $191,491 plus State Sales Tax, which includes the basic bid and Alternates 2, 4, 5, 6 and 8 Seconded by Mr Schmidt Motion carried by roll call vote of six (6) ADJOURNMENT Meeting adjourned at 8 25 P M 0"4ce Chet Bailie, Mayor PASSED and APPROVED this C) day of , 1980
