HomeMy WebLinkAbout10-20-1980 MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING OCTOBER 20, 1980 CALL TO ORDER Meeting called to order at 8 00 P V by the Honorable E A Snider, Mayor Pro Tern ROLL CALL By City Clerk Councilmen present were S K Adams, Beverly Green, Charles Grigg, Ira Schmidt and F A Snider Councilmen Wilkins and Baille were absent from the meeting (excused) Also present were Lee Kraft, City Manager, Dennis Pe Felice, City Attorney, Tom Criscola, Finance Pirector, James Ajax, City Engineer, John Hastig, Asst City Engineer and Gary Crutchfield, Director of Community Development CONSENT AGENDA Mr Adams moved to approve Consent Agenda Seconded by Mrs Green Motion carried by roll call vote of five (5) Consent items are as follows a) Approval of Minutes To approve minutes of regular meeting, held October 6, 1980 b) Bills To approve General Claims in the amount of $310,475 39, claim warrant nos 24980 through 25110 c) Lease Agreement - Walters Baseball Field To authorize City Manager to sip the Lease Agreement between the City and the Pasco American Little League, leasing Walters Baseball Field d) Wehe Street Site Screen To authorize staff to appropriate $2,625 from WPPSS Funds for the repair of the Wehe Street site screen and landscaping the area e) Resolution No 1376 A Resolution fixing the time and place for a public Ihearing to consider vacation of a portion of a certain alley within the City of Pasco f) Appointment to Board of Adjustment To re-appoint Dave Squires to a five-year term on the Board of Adjustment, which will expire on November 19, 1985 PUBLIC HEARINGS MAYOR PRO TEM SNIDER PECLARED THE PUBLIC HEARING OPEN TO CONSIDER ZONING TO BE ASSIGNED SUBSFOUENT TO ANNEXATION OF THE PROPERTY, GENERALLY LOCATEP AT TH 7 NORTHWEST CORNER OF THE INTERSECTION OF 36TH AVENUE AMP rOUPT STREET It was reported that the Hearing had been duly published and posted There were no adverse communications received The Planning Commission, after a second meeting with McGrath's, recommended that the parcel containing the existing 4-plex be classified R-2 (Medium Density Residential), further, the Commission recommended that the corner parcel (containing a single family dwelling) be classified C-1 only if conditioned by concomitant agreement to limit the uses thereon to professional offices Mr Grigg moved to direct staff to prepare appropriate Ordinance, as recommended by the Planning Commission, for City Council consideration on November 3, 1980 Seconded by Mr Schmidt Motion carried by roll call vote of five (5) Following three (3) calls from Mayor Pro Tern Snider for further comments from the floor, either for or against, the Public Hearing was declared closed MINUTES PASCO CITY COUNCIL REGULAR MEETING OCTOBER 20, 1980 PUBLIC HEARINGS MAYOR PRO TEM SNIPER DECLARED THE PUBLIC HEARING OPEN FOR THE PURPOSE OF REZONING LOT 16, BLOCK 7, GANTENBEIN'S ADDITION FROM R-2 to R-3 (Cassens Rezone) It was reported that the Hearing had been duly published and posted There was one (1) adverse communication from Mr George Nilson, opposing proposed zone change It was concluded that the City is nresently executing a Housing Rehabilitation Program within this neighborhood as a specific target area To date, six homes have qualified for receipt of up to $5,000 worth of rehabilitation improvements This program is planned to be extended to this neighborhood In 1981 also Therefore, the Planning Commission, after conducting a public hearing, concluded the requested rezone to R-3 would be a detrimental influence to the established and surrounding lower density residential uses, the property can be developed under the present R-2 zone Mr Warren Cassens defended zone change from a positive standpoint whereby he would be building structures to beautify area and add a tax base to the City He argued that at his Planning Commission Hearing, four spectators in audience had been in favor and one against his proposal In conclusion, he felt he would be putting a building in a decaying neighborhood Mr Grigg suggested referring this back to the Planning Commission for a recommendation on the entire area rather than spot zoning approach He voiced concern that extreme high density next to a residential area would create more traffic Mr Snider stated that options appeared to be to let multi-type dwelling be built and improve the area p or let the land stay vacant as it has been for at least 33 years that he knew of Mr Grigg reiterated that he was for progress, however, it should be on a planning basis Councilmen Green and Adams voiced support of zone change and did not feel it would be a detriment to the neighborhood Following three (3) calls from Mayor Pro Tem Snider for further comments from the floor, either for or against, the Public Hearing was declared closed Mayor Pro Tern Snider directed staff to prepare necessary Ordinance for consideration of the Council on November 3, 1980 MAYO PRO TEM SNIDER DECLARED THE PUBLIC HEARING OPEN TO REZONE LOTS 1 & 2, BLOCK 7, GANTENBEIN'S ADDITION TO PASCO, FROM R-2 to R-3 (Cassens Rezone) It was reported that the hearing had been duly published and posted. There was one adverse communication from George Nilson, opposing zone change Mr Cassens is petitioning for zone change as he wants to erect an additional 4-plex on the unused portion of the two lots and the Planning Commission, after public hearing, concluded the requested rezone to R-3 would be a detriment to the established and surrounding lower density residential uses Further, it should be noted that the existing 4-plex has been placed on the two lots in such a manner as to leave nearly half of the two lots vacant and unimproved The Commission concluded that the property owner's decision to develop the property in that manner is not sufficient reason to justify the rezoning of the land to R-3 Mr rassens again argued that he would be adding an improvement to the area and provide adequate housing for the low income at the same time Following three (1) calls from Mayor Pro Ten Snider for further comments from the floor, either for or against, the public Hearing was declared closed Mr Adams moved that staff be directed to prepare necessary Ordinance for consideration of the Council on November 3, 1980 Seconded by Mr , Schmidt Motion carried MINUTES PASCO CITY COUNCIL REGULAR MEETING OCTOBER 20, 1980 PUBLIC HEARINGS - Continued MAYOR PRO TEM SNIDER DECLARED THE PUBLIC HEARING OPEN TO REZONE BLOCK 17, RIVERSIDE ADDITION TO PASCO FROM R-2 to R-3 (Larson Rezone) It was noted that the Hearing had been duly published and posted There were no adverse communications received Mr Larson has requested the rezone of his triangular shaped block of land situated at the northwest corner of S 8th Avenue and Ainsworth The Planning Commission, after public hearing, has recommended the rezone be granted with the limitation,— of building heights to not exceed 25 feet, as conditioned by Concomitant Agreement Mrs Rhonda Peterson, Realtor, favored the zone change to further enhance and develop the area Mr Jerry Larson favored zone change as he felt it would be a good buffer zone between residential and high density area Following three (3) calls from Mayor Pro Tern Snider for further comments from the floor, either for or against, the Public Hearing was declared closed Mr Grigg moved to direct staff to prepare an appropriate Ordinance, as recommended by the Planning Commission for City Council consideration on November 3, 1980 Seconded by Mr Adams Motion carried by roll call vote of five (5) MAYOR PRO TEM SNIDER DECLARED THE PUBLIC HEARING OPEN TO CHANGE ZONE ON TWO ACRES, LYING ABOUT 300 FEET WEST OF 25TH AVENUE AND EXTENDING ABOUT 600 FEET NORTH FROM WEST "A" STREET, FROM I-1 to RMH-2 (Warren Rezone) It was noted that the Hearing had been duly published and posted There was a petition presented, supporting petitioner, Earl Warren 1 Mr Warren has requested rezone of his property in the vicinity of 26th Avenue and "A" Street from Light Industrial to Mobile Home Park The existing contractor's plant (an industrial use) would become a lawful non-conforming use (which can be transferred to new owner) if the RMH-2 zone is assigned Although staff recommended the rezone to RMH-2 include the adjacent small parcel not owned by Mr Warren, but zoned I-1, does not represent a significant problem in light of the proposed development of a mobile home park as opposed to subdivision Assignment of the RMH-2 zone and development of a mobile home park on the subject property will leave one small parcel immediately north of the existing mobile home park east of the subject property Industrial use of that one remaining parcel will depend on the private access road for access to and from "A" Street, and will pass through the two small home parks This would appear to be an undesirable if not unsafe situation Following three (3) calils from Mayor Pro Tem Snider for further comments from the floor, either for or against, the Public Hearing was declared closed MAYOR PRO TEM SNIDER DECLARED THE PUBLIC HEARING OPEN TO REZONE LOTS 22 - 25 AND THE WEST 10 FEET OF LOT 26, ALL IN BLOCK 3, REPLAT OF KURTH'S ADDITION TO PASCO, FROM R-1 to C-1 1 (Campbell Rezone) It was noted that the hearing had been duly published and posted There were no adverse communications received Dr Campbell's present office/clinic is situated in an R-1 zone at the edge of the residential neighborhood The Planning Commission, after public hearing, concluded the C-1 zone would be appropriate only if conditioned by Concomitant Agreement to restrict the permitted C-1 uses to professional offices, the intent of the condition is to protect the established residential uses in the immediate vicinity In light of the proximity of the property to the signalized intersection of 14th and Sylvester, the collector street function of 14th Avenue, and the ability of the particular use to function as a buffer between the signalized intersection and the established residential uses along Nixon Street, the use of the property for doctor office/clinic appears to further the goals and policies of the Comprehensive Plan VINNTES PASCO CITY COUNCIL REGULAR MEETING OCTOBER 20, 1980 PUBLIC HEARINGS - Continued Following three (3) calls by Mayor Pro Tern Snider for further comments from the floor, either for or against, the Public Hearing was declared closed Mr Grigg moved to direct staff to prepare an appropriate Ordinance, as recommended by the Planning Commission, for City Council consideration on November 3, 1980 Seconded by Mr Schmidt Motion carried by roll call vote of five (5) , MAYOR PRO TEM SNIDER DECLARED THE INFORMAL PUBLIC HEARING OPEN ON ELIMINATION OF ON-STREET PARKING COURT STREET (Jth to 14th) FOR THE PURPOSE OF INSTALLING TWO-WAY LEFT HAND TURN LANE City Engineer, James Ajax, reported that Court Street will be overlayed next week and he had been approached about eliminating parking on Court Street from 4th to 14th Now is the time to consider such an undertaking so that proper striping could be made upon completion of the overlay He stated that 15 accidents had occurrred in this area as opposed to 8 from 14th to 20th where parking is prohibited A petition favoring elimination was received from the following Jim Woodhead, Coast to Coast Store, James Baggett, A & W Restaurant, Robert Leaper, Empire Paint & Floorcoverinq, H Remy, Dairy pueen, Lyle Schmidt, Sheridan Center, Robin Pischel, Family Deli, Robert Pischel, Commercial Rentals, Jerry Smith, Greenlee Funeral Home and Pete & Sheela Overlie Other interested persons include Charles Hines, Chuck's Barber Shop, Fran Thomas, C Thomas Realty, and Jack Simons, Shakey's Pizza Parlor Mr Earl Steele, Mrs Lillie Riemath and Mr Art Schindler opposed the elimination of parking on Court Street Following three (3) calls from Mayor Pro Tern Snider for further comments from the floor, either for or against, the Informal Hearing was declar'ed closed RECESS 9 10 P r RECONVENED 9 15 P M VISITORS Mrs Jean Williams, member of PRIDF, urged the Council to pass proposed Drug Paraphernalia Ordinance She gave demonstration of "toylike" objects used to further the Use of drugs and stressed the importance of knowing what your children are doing Mr Warren Oassens expressed concern that with requirements for beautification, etc , one could hardly put a 4-plex on 6,000 sq ft He suggested that planting strip be used as part of required landscaping, as evidenced at 1st & Margaret This will be discussed further at Workshop Meeting on November 10, 1980 OR ORDINANCE NO 21 96 (Warren Rezone) AN ORDINANCE RELATING TO ZONINC AND CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM I-1 LIGHT INDUSTRY TO RMH-2 MOBILE HOME PARK Ordinance No 2196 was read by title only Mr Schmidt moved that Ordinance No 2196 be adopted Seconded by Mr Adams Motion carried by roll call vote of five (5 ) ORDINANCE NO 2197 AN ORDINANCE OF THE CITY OF PASCO PROHIBITING PARKING ON CERTAIN STREETS BY AMENDING SECTION 10 56 080 Or THE PASCO MUNICIPAL CODE (Court Street) 1 Ordinance No 2197 was read by title only Mr Schmidt moved to adopt Ordinance No 2197, which as the effect of eliminating on-street parking between 4th and 14th Avenues on Court Street Seconded by Mr Grigg Mr Adams moved to table Ordinance No 2107 for further study Seconded by Mrs Green Motion FAILrD BY the following vote YES Adams, Green NO Grigg, Snider and Schmidt s MINUTES PASCO CITY COUNCIL REGULAR MEETING ORDINANCES - Continued OCTOBER 20, 1980 Main Motion FAILED by the following roll call vote YES Schmidt, Snider and Grigg NO Green & Adams (The City Attorney ruled that it took a vote of four to pass an Ordinance) ORDINANCE NO 21 98 AN ORDINANCE OF THE CITY OF PASCO RELATING TO THE PUBLIC HEALTH, SAFETY, AND WELFARE, DEFINING AND MAKING UNLAWFUL THE USE, POSSESSION, SALE, DELIVERY, OR MANUFACTURE OF DRUG PARAPHERNALIA AND PROVIPING FOR ITS FORFEITURE BY ADDING A NEW CHAPTER DESIGNATED AS CHAPTER 9 75 TO THE PASCO MUNICIPAL CODE Ordinance No 2198 was read by title only Mr Adams moved that Ordinance No 2198 be adopted Seconded by Mr Schmidt Motion carried by roll call vote of five (5) RESOLUTIONS RESOLUTION NO 1377 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PASCO, EXPRESSING THE STRONG INTEREST OF THE CITY FOR AN EXPEDITIOUS COMPLETION OF THE INTERSTATE 1-182 BRIDGE ACROSS THE COLUMBIA RIVER Resolution No 1377 was read by title only Mr Adams moved that Resolution No 1377 be adopted Seconded by Mr Schmidt Motion carried by roll call vote of five (5) UNFINISHED BUSINESS APARTMENTS IN COMMERCIAL ZONE Mr Grigg moved to find the proposed residential use of Lots 31 and 32, Block 15, Gerry's Addition to be contrary to the Comprehensive Plan and the public interest and, therefore, deny the proposed residential use of said property Motion died for lack of a second Mr Schmidt moved to find the proposed residential use of Lots 31 and 32, Block 15, Gerry's Addition not contrary to the Comprehensive Plan and the public interest and, therefore, authorize the proposed residential use of said property Seconded by Mrs Green Motion FAILED by the following roll call vote YES Green, Snider and Schmidt NO Adams & Grigg (City Attorney ruled it takes 4 votes to pass) Mayor Pro Tern get legal opi NEW BUSINESS Snider questioned validity of vote, therefore, City Attorney is to ion on his decision APPOINTMENT - PLANNING COMMISSION Mr Schmidt moved to appoint FRANK THOMSEN to fill unexpired term of Bryce Hall on the Planning Commission The term of office will expire on February 2, 1982 Seconded by Mr Adams Motion Carried MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL JOINT MEETING WITH CHAMBER OF COMMERCE Mr Grigg moved to hold a joint Christmas Open House with the Chamber of Commerce on the afternoon of December 15, 1980 Seconded by Mr Schmidt Motion carried JOINT MEETING WITH PLANNING COMMISSION It was suggested to hold a joint workshopJ meeting with the Planninl Commi -ssion-and work out differences which may exist Mr Snider requested that in the future, he would like to see an Ordinance prepared for consideration subsequent to every zone change request so that the Council may take necessary action at the time, whether it be pro or con SPECIAL MEETING OF THE CITY COUNCIL Mr (Criigg mbved that a special meeting of the City Council be held on October 27, 1980, to reconsider the elimination of parking on Court Street (City Attorney will get legal opinion on 3 -
