PASCO CITY COUNCIL
REGULAR MEETING NOVEMBER 3, 1980
CALL TO ORDER
Meeting called to order at 8 00 P M by the Honorable Chet Bailie, Mayor
ROLL CALL
By City Clerk Councilmen present were S K Adams, J C Bailie, Beverly Green,
Ira Schmidt and E A Snider Councilmen Charles Grigg and Bill Wilkins were excused
from the meeting Also present were Lee Kraft, City Manager, Tom Criscola,
Director of Finance, James Ajax, City Engineer, Webster Jackson, Administrative
Assistant and Gary Crutchfield, Director of Community Development
CONSENT AGENDA
Mr Snider moved that Consent Agenda be approved Seconded by Mr Schmidt
Motion carried by roll call vote of five (5) Consent items are as follows
a) Approval of Minutes Minutes of regular and special meetings, held
October 20th and 27th respectively
b) Bills To approve General Claims in the amount of $1,380,708 40, claim
warrant nos 25111 through 25262
To approve Payroll Claims in the amount of $213,543 19, payroll warrant nos
39748 through 40097
To write off $1,961 40 ambulance bad debts and refer the accounts to the
collection !agency
c) Sale of Damaged Police Car, '79 Chevrolet To authorize staff to call for
bids for the sale of a damaged 1979 Chevrolet Police Cruiser, Serial No
IL69L9C183920, and to sell the vehicle to the highest bidder subject to a
minimum bid price of $900 00
d) Apartments in Commercial Zone To find that the land situated on the north
side of Marl ie Street, between Road 24 and Road 26, and presently zoned C-1
is not suited for commercial development and, in consideration of Comprehensive
Plan policies, the use of said land is more appropriate for higher density
residential development and is in the public interest and is, therefore,
approved
e) Procedure for Change Orders at the Golf Course To provide the City Manager
authority to approve all change orders on the Golf Course Remodeling Project
on the recommendation of the Golf Course Architect, to an aggregate of
$90,000, with the understanding that any change orders exceeding the
$90,000 limit shall be taken to the City Council for approval
f) Hearing Date for Murray Rezone - 80-52-Z To fix 8 00 P M , Monday,
November 17, 1980, in the Council Chambers at City Hall as the time and
place for a public hearing to consider the Planning Commission's recommendation
for the Murray rezone application
PUBLIC HEARINGS
MAYOR BAILIE DECLARED THE PUBLIC HEARING OPEN FOR THE PURPOSE OF CONSIDERING
APPLICATION FOR CONTINUANCE OF NOM-CONFORMING USE - ELMO'S BOOKSTORE
It was noted that the Hearing had been duly published and posted Legal counsel
for Elmo's Bookstore was also advised of proceedings
Following three (3) calls from Mayor Bailie for further comments from the floor,
either for or against, the Public Hearing was declared closed

Mr Snider moved to approve a permit for continuance of a non-conforming use for
Elmo's Bookstore, pursuant to Pasco Municipal Code, Chapter 22 72 020(2), with the
terms and conditions to be those attached to this agenda report Seconded by
Mr Schmidt MOtion carried by roll call vote of four (4) Councilman Adams
voting no

PUBLIC HEARING - Continued
Mr Snider moved that the City Council approve of the plans and specifications
presented by Elmo's Bookstore for the refacing of the bookstore building, which
plans are those presented to the City Council at workshop on October 27, 1980 and,
further, the City Council requires that the sign be placed on the building shall

be flush with the building facade Seconded by Mr Schmidt Motion carried by
roll call vote of four (4) Councilman Adams voting no
VISITORS
PRESENTATION TO BRYCE HALL - PLANNING COMMISSION A Certificate of Appreciation
was prepared for Mr Bryce Hall, expressing the City Council's appreciation for
his service on the City Planning Commission Mr Hall was unable to be present
to receive award so Mayor Bailie will give it to him personally

AN ORDINANCE VACATING A PORTION OF 32ND AVENUE IN THE CITY
OF PASCO
Ordinance No 2173 was read by title only Mr Snider moved that Ordinance No
2173 be approved Seconded by Mr Adams Motion FAILED by roll call vote of
four (4) Mr Bailie voting yes
ORDINANCE NO 2199 (Hopkins Street)
AN ORDINANCE AMENDING SECTION 2 OF OPPINANCE NO 2191 BY CHANGING
THE RATE OF INTEREST FOR THE INTEREST BEARING WARRANTS ON LOCAL
IMPROVEMENT DISTRICT NO 111
Ordinance No 2199 was read by title only Mr Snider moved that Ordinance No
2199 be approved Seconded by Mrs Green Motion carried by roll call vote
of five (5)
ORDINANCE NO 2200 (McGrath Zoning Assignment)
AN ORDINANCE RELATING TO ZONING AND ASSIGNING THE MUNICIPAL
ZONING CLASSIFICATION TO CERTAIN REAL PROPERTY ANNEXED TO THE

COMMUNITY OF GOVERNMENTAL AND PRIVATE ENTITIES TO SUPPORT
ENERGY FAIR '83
Resolution No 1379 was read by title only Mr Schmidt moved that Resolution

RESOLUTION NO 1380
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PASCO EXPRESSING
DISAPPROVAL OF BENTON-FRANKLIN PUBLIC HEALTH DISTRICT BOARD OF
DIRECTORS RROPOSED 1981 ALLOCATIONS FORMULA BASED ON GROSS REVENUE

RESOLUTION NO 1381
A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF PASCO TO
ENTER INTO AN AGREEMENT WITH THE PORT OFIPASCO
Resolution No 1381 was read by title only Mr Snider moved that Resolution
No 1381 be adopted Seconded by Mr Schmidt Motion carried by roll call
vote of five (5)
UNFINISHED BUSINESS
APARTMENTS IN COMMERCIAL ZONE (Schuelein) Mr Snider moved to find the
proposed residential use of Lots 31 and 32, Block 15, Gerry's Addition not
contrary to the Comprehensive Plan and the public interest and, therefore,
authorize the proposed residential use of said property Seconded by Mr
Schmidt Motion carried by roll call vote of four (4) Mr Adams voting no
NEW BUSINESS
APPOINTMENT - ALTERNATE TO BENTON-FRANKLIN DISTRICT BOARD OF HEALTH Mayor
Bailie appointed Ira Schmidt as alternate council member to Board of Health
and asked the council's concurrence Mr Snider moved to concur with Mayor
Bailie's appointment Seconded by Mrs Green Motion Carried
PERMANENT PAVEMENT MARKING PROJECT Mr Snider moved to award the construction
contract for the permanent pavement marking project, City Project No 77-4-03,
to the low bidder, Pacemaker Industries, Inc of Spokane, in the amount of
$50,347 52, and further, authorize the Mayor to execute the contract documents
Seconded by Mr Adams Motion carried by roll call vote of five (5)
