S K Adams, Beverly Green, Charles Grigg, Ira Schmidt and E 4 Snider Councilmen J C Bailie and Bill Wilkins were absent from the meeting (excused) Also present were Lee Kraft, City Manager, Dennis De Felice, City Attorney, Tom Criscola, Finance Director, James Ajax, City Engineer, John Hastig, Asst City Engineer, Richard Erickson, Director of Parks A Recreation, Webster Jackson, Administrative Assistant, Gary Crutchfield, Director of Community Development and Ted Johnson, Associate Engineer CONSENT AGENDA Mr Grigg moved to approve 'Consent Agenda, as corrected in Workshop Session Seconded by Mr Schmidt Motion carried by roll call vote of five (5) Consent items are as follows a) Approval of Minutes To approve minutes of regular and special meetings, held November 17th and 24th respectively b) Bills To approve General Claims in the amount of $1,349,127 10, claim warrant nos 25403 through 25539 To approve Payroll Claims in the amount of $211,549 00, payroll warrant nos 40102 through 40444 c) Temporary Relocation of Detoxification Facility To confirm that the Community Alcohol Services Association may use the vacant office building at the northeast corner of 3rd & Clark for a period not to exceed 18 months, until the new detoxification facility at 7th & Ainsworth is constructed and occupied d) East Pasco Neighborhood Facility Lease Agreements To authorize the Mayor to sign a lease agreement with the Mid-Columbia Mental Health Center, Inc , for space at the East Pasco Neighborhood Facility, with the lease to run for a term of one year to expire on December 31, 1981 e) Resolution No 1386 A Resolution accepting utility easements from Pasco School District f) Resolution No 1387 To approve Resolution No 1387, ratifying Collective Bargaining Agreement with International Association of Firefighters, Local No 1433, for a period of January, 1981 through December, 1983 g) Resolution No 1388 To approve Resolution No 1388, vacating a portion of Ainsworth Street within the City of Pasco (Deter) h) South of "A" Street L I D No 106 To set Monday, December 15, 1980, at 8 00 P M , as the date and time for the hearing on the proposed final assessment roll for L I D No 106 1) / Hopkins Street L I P No 111 To set Monday, January 5, 1981, at 8 00 P M , as the date and time for the hearing on the proposed final assessment roll for L I D No 111 3) Proposed Utility Rate Increase To set December 15, 1980, at 8 00 P M , as the time and date for a public hearing on the proposed utility rate adjustments and increases k) Setting a Budget Workshop Regarding the 1981 Preliminary Budget To set a council workshop on the 1981 Preliminary Budget for Thursday, December 4, 1980, at 7 30 P M , City Hall, in the Conference Room in the Administrative Assistant's Office MINUTES PASCO CITY COUNCIL RFGULAR MEFTING DECEMBER 1, 1980 CONSENT AGENDA - Continued 1) Hearing Date - Supplemental Budget To set a public hearing on the supplemental budget for 8 00 P M , Monday, December 15, 1980 m) Appointment to Parks & Recreation Advisory Council To appoint Mr Grant Stringham to the Park and Recreation Advisory Council to fill the unexpired term of James Weyers, which will expire on February 2, 1983 n) Councilman Wilkins' Absence Owing to Illness To excuse Council- man Wilkins from attendance at the December 1st Council Meeting because of his illness PUBLIC HEARINGS MAYOR PRO TEM SNIDER DECLARED THE PUBLIC HEARING OPEN ON THE PRELIMINARY 1981 BUDGET CITIZENS ATTENDING THF HEARING HAVE THE RIGHT TO PROVIDE WRITTEN AND/OR ORAL COMMFNTS AND ASK QUESTIONS CONCERNING THE ENTIRE BUDGET, OR ANY PORTION THEREOF, AND THE RELATIONSHIP oF REVENUE SHARING ENTITLEMENT FUNDS TO THE ENTIRE BUDGET OR HOW SAID FUNDS MIGHT BE USED IT IS PROPOSED TO USE THE REVENUE SHARING FUNDS TO OFFSET THE COST OF PUBLIC SAFETY (POLICE) It was noted that the hearing had been duly published and posted There were no written communications Mrs Lydia Sisk, 1747 N 7th, asked the status of proposed Pearl Street Park between 5th & 7th Avenues She was concerned for the safety of small children playing there and encouraged the council to reconsider this request Mayor Pro Tern Snider thanked Mrs Sisk for her concerns and reiterated that our revenues had diminished with inflation, and at the present time, we were $250,000 short of meeting present level of services For benefit of audience, the City Manager gave a brief run-down of anticipated revenues from which the 1981 proposed budget had been projected Mr Howard McGee suggested that Revenue Sharing Funds be used for capital improvements only rather than public safety The City manager concurred this would be a good idea, however, all cities were in the same position and had become dependent on Revenue Sharing funding for operating capital Following three (3) calls from Mayor Pro Tern Snider for further comments from the floor, either for or against, the Public Hearing was declared closed MAYOP PRO TEM SNIDER DECLARED THE PUBLIC HEAPING OPEN TO RECEIVE COMMENTS REGARDING PROPOSED ZONING REGULATION OF THE NORTHWEST PASCO ANNEXATION It was noted that the hearing had been duly published and posted There was a communication from Richard & Pamela Colburn, commending the Planning Commission for their foresight in the orderly growth of West Pasco He cited three reasons why they felt area west of Rd 100 should be retained as a residential community 1) The immediate area is currently developed with a large number of homes designed and develoned only for low density residential use which would be substantially impaired by commercial or high density development 2) The 1-182 freeway constitutes a natural barrier to separate the residential development southeast of the freeway from the commercial and high density development on the northside of the freeway 3) There is no planned direct access to the freeway in this region from the south side of the freeway and all access to this area would be from Court Street which is not adequate for commercial or high density development He further requested that the Council reject Les Brown's (Richland Realtor) proposed change in the land use man and retain the residential character of the area Mr Gary Crutchfield, City Planner, pointed out proposed annexation area and stated that staff had met with property owners in August, 1980 to discuss the preparation of preliminary zoning to be reviewed by the Planning Commission The general concensus of that meeting was that the interchanges b. recognized for commercial potential and the balance be preserved in large ownerships until Continued Next Rage MINUTES PASCO CITY COUNCIL REGULAR MEETING DECEMBER 1, 1980 PUBLIC HEARING - Continued the basic utilities are extended The benefits of this approach included better planning for utility and street layouts and PUD's as well as avoiding premature escalation in property values Staff recommended assignment of C-1-D at both interchanges (comparable acreage) and R-T for balance of undeveloped large ownerships The property along Argent Road and Court Street already developed was recommended for zoning classifications similar to the existing development The Planning Commission, after a public hearing on October 2, 1980, recommended the Council establish the Preliminary Zoning recommended by staff Another hearing must be conducted by the City Council regarding the Preliminary Zoning, it is scheduled for January 5, 1981 If the Council feels any changes should be made in the Commission's recommendation, they should be noted this evening in order to prepare for the January hearing Mrs Ruth Wilson, Unit 84, opposed zoning on their property as she felt they had some of the best residential property in Franklin county and 5 acre tracts would freeze up their property She favored smaller parcels of land and preferred Franklin County's plan for area Mr Crutchfield responded by stating that the zoning was in a "holding" pattern until the utilities are furnished, further, Franklin County's plan is not zoning, but Comprehensive Plan Mr Glen Walkley requested that 55 acres of his land,located in the northwest part of Section 12 be excluded from the annexation as it was a farm and being used as such He stated that part of his farm was in Open Space, therefore, not being used for development purposes Mr Wayne Wilson asked how long it would be before utilities are available He felt there was nwincentive for annexation if utility service was several years away To this question, Mr Ajax gave a brief report on proposed implementation of sewer service in the Riverview and West Pasco area and cost of such improvement Mr Wilson then stated, "you still have not convinced me - why don't you turn us loose to go where we can get the services?" Mr David Harris questioned why the City could undertake such a costly venture when, earlier in the meeting, they were stating that they had no money He reminded the council that people in West Pasco had been assured that they would not be annexed unless they asked for it and he knew of no one who favored it Staff replied that a number of residents favored annexation as a means of getting sewer service to their property The City engineer gave a brief statement of possible funding through State grants which might be available Mr Bob Southwick concluded that it sounded like the people of Pasco were buying somthing the County did not want and he was a property owner in the City and County as well Following three (3) calls from rayor Pro Tem Snider for further comments from the floor, either for or against, the Public Hearing was declared closed ENVIRONMENTAL IMPACT STATEMENT - NORTHWEST PASCO ANNEXATION Mr Crutchfield drew attention to proposed Environmental Impact Statement and plan for the area Mr Russell Smith, Manager of South Columbia Irrigation District, felt there was a conflict of interest in the Environmental Impact Statement He felt the statement should include a cooperative effort between the City and Irrigation District Mr Crutchfield stated he would be meeting with Mr Smith next week to resolve any misunderstandings Gary Crutchfield(explained the entire hearing process to the audience and what steps are to be taken next Another public hearing regarding preliminary zoning will be held January 5, 1981 Following three calls for further comments from the floor, either for or against, the Public Hearing was declared closed RECESS 9 10 RECONVENED 9 20 MINUTES PASCO CITY COUNCIL REGULAR MEETING DECEMBER 1, 1 980 PUBLIC HEARINGS MAYOR PRO TEN' SNIDER DECLARED P-IE PUBLIC HEAPING OPEN ON THE PROPOSED FINAL ASSESSMENT ROLL FOR L I P NO 107 It was noted that the Hearing had been duly published as required by law One opposing communication was received from Robert Southwick, 1332 West Irvin(' Mr James Ajax, City Engineer, reported the final assessment roll at 80% of preliminary estimate Certain areas wanted their street wider in order to angle park so this and other improvements increased the final assessment roll, however, it was still below the preliminary estimate Mr Bob Southwick, 1332 W Irving, asked why he couldn't pave his parking strip so he would not have the constant maintenance of it Mayor Pro Tern Snider stated this would be coming up later in the agenda and asked Mr Southwick to remain Mr Ajax commended Ted Johnson, Associate Engineer, for his conscientious effort and contribution to L I D projects This sentiment was supported by Mayor Pro Tem Snider, who had worked with Mr Johnson during his tenure with the City Following three calls from Mayor Pro Tem Snider for further comments from the 9oor, either for or against, the Public Hearing was declared closed THE PUBLIC HEARING WAS DECLARED OPEN TO CONSIDER THE VACATION OF THE SOUTH HALF OF THE NORTH/SOUTH ALLEY IN BLOCK 7, MEN'S ADDITION TO PASCO, SITUATED IN THE NORTHEAST QUARTER OF SECTION 32, T9N, RANGE 30 EWM It was noted that the Hearing had been duly published and posted There were , no adverse communications Mr Crutchfield reported that Mr Gant and Mrs Veberes had petitioned the Council to vacate the south half of the north/south alley in Block 7 Both tracts of land are presently vacant and the south half of the alley is unused City water in this area is provided via the east/west alley alignment, sewer stops at the center of the north/south alley Telephone service does not require maintenance of the alley POD service presently extends south of "B" Street to the center of the north/south alley, PUD requests an easement be maintained to allow for potential extension of overhead service to southerly portion of tracts All of the north/south alley in Blocks 6 and 8 have been vacated Following three (3) calls for further comments from the floor, either for or against, the Public Hearing was declared closed OR ORDINANCE NO 2208 (L I D No 107) AN ORDINANCE OF THE CITY OF PASCO, PASNINGTON, APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO 107 FOR THE IMPROVEMENT OF THE WEST HALF OF THE SOUTH- EAST QUARTER OF SECTION 30, T9N, R30 ENV, LYING SOUTH OF SYLVESTER STREET, NORTH OF LEWIS STREET, NEST OF 1:0TH AVENUE, AND EAST OF 14TH AVENUE WITHIN THE CITY OF PASCO, WASHINGTON 1 Ordinance No 2208 was read by title only Mr Adams moved that Ordinance No 2208 be approved Seconded by Mr Schmidt Motion carried by roll call vote of five (5) ORDINANCE NO 2209 (Block 7, Owen's Addition) AN ORDINANCE VACATING A PORTION CF A CEPTAIN ALLEY IN THE CITY OF PASCO Ordinance No 2209 was read by title only Mr Schmidt moved that Ordinance No 2209 be adopted Seconded by Mr Grigg Votion carried by roll call vote of five (5) I 1 MINUTES PASCO CITY COUNCIL REGULAR MEETING DECEMBER 1, 1980 ORDINANCES ORDINANCE NO 2210 (Supplemental Budget Ordinance - 1ST READING) AN ORDINANCE AMENDING THE 1980 ANNUAL BUDGET OF THE CITY OF PASCO BY PROVIDING A SUPPLEMENT THERETO, BY APPROPRIATING AND REAPPROPRIATING REVENUE, BY PROVIDING TRANSFER AND EXPENDITURE AUTHORITY, BY ADJUSTING THE EXPENDITURE PROGRAM OF VARIOUS FUNDS AND BUDGETS WITHIN FUNDS, AND DECLARING AN EMERGENCY Ordinance No 2210 was given a first reading Second and final reading will be given December 15, 1980 ORDINANCE NO 2211 AN ORDINANCE RELATING TO THE ASSESSMENT LIEN FOR REQUIRED - SIDEWALK, CURB AND GUTTER CONSTRUCTION Ordinance No 2211 was read by title only Mr Grigg moved that Ordinance No 2211 be adopted Seconded by Mr Schmidt Motion carried by roll call vote of five (5) ORDINANCE NO 2212 (Funding for Relocation of Golf Course) AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, RELATING TO CONTRACTING INDEBTEDNESS, PROVIDING FOR THE BORROWING OF A TOTAL OF NOT TO EXCEED $450,000 AND ISSUING AND SELLING NEGOTIABLE LIMITED TAX GENERAL OBLIGATION BONDS TO PAY PART OF THE COST OF RELOCATING THE CITY'S MUNICIPAL GOLF COURSE TO CITY PROPERTY TO THE EAST OF THE EXISTING GOLF COURSE, AND AUTHORIZING THE ISSUANCE OF INTEREST BEARING WARRANTS DRAWN UPON THE "PASCO MUNICIPAL GOLF COURSE REDEVELOPMENT FUND" HERETOFORE CREATED PENDING THE SALE OF SUCH GENERAL OBLIGATION BONDS AND THE RECFIPT OF OTHER FUNDS TO BECOME AVAILABLE THEREFOR Ordinance No 2212 was read by title only Mr Schmidt moved that Ordinance No 2212 be adopted Seconded by Mr Grigg Motion carried by roll call vote of five (5) ORDINANCE NO 2213 (New Rates for Golf Course) AN ORDINANCE RELATING TO PARKS AND RECREATION AND AMENDING ORDINANCE NO 1913 BY SETTING NEW RATES FOR THE GOLF COURSE Ordinance No 2213 was read by title only Mr Adams moved that Ordinance No 2213 be adopted Seconded by Mr Schmidt Motion carried by roll call vote of five (5) RESOLUTIONS RESOLUTION NO 1389 (Planting Strips) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PASCO, ESTABLISHING A POLICY FOR ALLOWING IMPROVEMENTS TO PLANTING STRIPS WITHIN THE CITY OF PASCO Resolution No 1389 was read by title only Mr Schmidt moved that Resolution No 1389 be adopted Seconded by Mr Grigg Mr Dick Erickson, Director of Parks & Recreation, felt this was a good Resolution and would allow their Department to use discretion on a neighborhood by neighborhood basis He encouraged Mr Southwick (who had spoken earlier) to come into their office and make application for the improvement of his planting strip Main motion carried by roll call vote of four (4) Mrs Green voting no Snider, Mayor Pro Tem MINUTES PASCO CITY COUNCIL REGULAR MEETING RESOLUTIONS - Continued RESOLUTION NO 1390 (Enforcement of Building/Fire Codes) DECEMBER 1, 1980 A RESOLUTION DECLARING THE INTENT OF THE CITY COUNCIL OF THE CITY OF PASCO TO ENFORCE THE OCCUPANCY PROVISIONS OP THE UNIFORM BUILDING COPE AMP orimm FIPF CODE WITHIN THE CITY OF PASCO Resolution No 1390 was read by title only Mr Schmidt moved that Resolution No 1390 be adopted. Seconded by Mrs Green Motion carried by roll call vote of five (5) NEW BUSINESS SPECIAL PRESENTATION BY COUNCILMAN IPA SCHVIPT A large latchwork wall hanging with the City of Pasco decal on it was presented to the City of Pasco by Ira and Rita Schmidt Mrs Schmidt designed and made the gift which represented many hours of tedious work She responded that "she was proud of Pasco and wanted a memento of the upcoming Centennial to display " Mayor Pro Tem Snider, on behalf of the Council and Staff, thanked Mr & Mrs Schmidt for their beautiful gift and commended their community spirit AUTHORIZATION TO SELL FOUR POLICE CARS Mr Grigg moved that staff be authorized to advertise for bids and sell three (3) 1979 Chevrolet Police Cruisers and one (1) 1976 Dodge Coronet, which have been replaced, subject to a minimum price of $1,500 eadh, or average of each, on the three 1979 Chevrolets, and $200 on the 1976 Dodge Seconded by mr Schmidt Motion carried by roll call vote of five (5) AUTHORIZATION TO CPLL FOR BIDS - TRAFFIC SIGNS Mr Grigg moved to authorize staff to call for bids on traffic regulatory signs, street name signs, and construction warning signs, together with necessary appurtenances Seconded by Mr Schmidt Motion carried by roll call vote of five (5) EXCUSFr PRSENCE OF COUNCILMEN Mr Grigg moved that Chet Bailie (on official business in Atlanta, Georgia) and Bill Wilkins (ill in Kadlec Hospital) be excused from meeting of December 1, 1980 Seconded by Mr Adams Motion carried by roll call vote of five (5) ADJOURNMENT Meeting adjourned at 10 15 P velyn Wells, City Clerk PASSED and APPROVED this r'day of /0:161,..e.40/ , 1980
