RESOLUTION NO 2343 A RESOLUTION authorizing a waiver of the requirement of the availability of City sewer service for the issuance of a building permit on certain terms and conditions WHEREAS, PMC 16 06 010 requires the availability of both City water and sewer service as a perquisite to the issuance of a building permit, and WHEREAS, lot 2 of short plat 84-04 (1609 Road 42) does not have access to the sanitary sewer system and the building would be completed prior to sewer service being available in Ruby Street, and WHEREAS, the City Council, under the authority granted to it in PMC 16 06 030 and 040, has determined that in fairness to the property owner, development should be permitted utilizing an approved septic tank on the lot until the availability of sewer to the property, Now, THEREFORE, BE TT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO Section 1 The Pasco City Council grants, upon the conditions stated herein a waiver of the requirement of the availability of City Sewer service to lot 2, short plat 84-04 A Septic tank must receive the required approvals from the Benton-Franklin Health Department, B The property owner sign a Utility Waiver Agreement C This waiver shall expire upon connecting to the gravity line i n Ruby Street PASSED by the City Counci of A e City of Pasco this 17th day of November, 1997 ATTEST Catherine D Seaman Deputy City Clerk APPRO3E1 AS TO FORM City Attorney UTILITY SERVICE WAIVER AGREEMENT (CHAPTER 16 06 PMC) The undersigned is the owner of the real property situated in Franklin County, Washington at 1609 Road 42, being described as Short Plat 84-04, Lot 2 The undersigned has made application for waiver of the utility service requirements of Chapter 16 06 PMC and the Pasco City Council has by motion approved said waiver conditioned upon the undersigned making the following agreements with the City which the undersigned does hereby freely and voluntarily make a The undersigned grants to the City a full power of attorney to sign owners name to a petition for the formation of a local improvement district or a utility local improvement district for the construction of water and/or sewer lines (in the 4100 block of the proposed Ruby Street) for the providing of water and/or sewer service to the real property described above and further agrees not to protest the formation of such a LID or UL ID whether commenced by petition or by resolution b The undersigned covenants that in the event a water and/or sewer line is constructed by private development on property abutting the property described above, the undersigned will pay to the developer a pro-rata share of the development costs which shall to the extent necessary for equity be based on benefits to the real property described above c In the event a public water line and/or sewer line is constructed as provided in paragraphs no a and b the above, the undersigned shall if directed to do so by the City, connect to such public water and/or sewer line in lieu of private systems d The above covenants to the City shall run with the land and be binding on the owner, on the undersigned, his day of Given under my hand and official seal this , 19 97.
