A RESOLUTION authonzmg the City of Pasco to modify and amend the State Revolving Fund (SRF) Loan Agreement L9400013 m the amount of 23 7 million dollars between the State of Washington Department of Ecology and the City of Pasco WHEREAS, the City of Pasco m 1994 identified the need for waste water capital projects, and the complete financing assistance from the state and other local funds was not known until the project started to be completed, WHEREAS, the City has now identified the overall funding assistance received from the different state and local funds and Amendment Number 4 to the SRF Loan Agreement L9400013 m the amount of 23 7 million dollars mcorporates and formalizes the projects which are eligible to be under the 23 7 million SRF Loan, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO; that the City of Pasco is authorized to amend the SRF Loan Agreement L9400013 m the amount of 23 7 million dollars, a copy of which is attached hereto and incorporated herein as Exhibit A ATTEST: Deputy City Clerk APPROVED AS TO FORM: Leland B City Attorney LOAN AM EN DM ENT NO. 4 10 STATE REVOLVING FUND (SW) LOAN AGREEM EN I' L9400013 BETWEEN THE STATE OF WASHINGTON DEPARTMENT OF ECOLOGY AND THE CITY OF PASCO PURPOSE 10 amend the above-referenced loan agreement between the Dept (Anent of Ecology, (DEPARTMENT) and the city of Pasco (RECIPIENT), for the RECIPIENT'S Wastewater Facilities Pi oject The scope of the pi oject has been modified based on the Facility Plan approved by the DEPAR1MEN r and loan applications and pi oject elements previously submitted for funding consideration by the RECIPIENT These modifications accommodate a repriontization of projects and a redirection of available funds provided by the DEPARTMENT to the RECIPIENT under tins agreement in the following mannei 1 The West Pasco project is i educed in scope and the remaining funds will be iedirected to the pump station and collection system project in East Pasco, 2 The proposed West Pasco trunk sewer system will not be extended beyond Road 56 at the present time due to insufficient iesidential densities, and 3 An outfall extension with diffuser is added to comply with permit requirements and watei quality based effluent limits This amendment will not result in an increase or dem ease in loan funds and the loan interest rate remains as previously amended 1T IS MUTUALLY AGREED that the loan agi cement is amended as follows II.
