HomeMy WebLinkAbout2262 ResolutionRESOLUTION NO a:C< A RESOLUTION approving a preliminary plat for Island Estates WHEREAS, RCW 58 17 enables the city to uniformly administer the process of subdividing property for the overall welfare of the community, and, WHEREAS, owners and developers of property situated in the southwest quarter of Section 9, Township 9 North, Range 29 East W M have requested approval of a preliminary plat, and, WHEREAS, the Planning Commission has reviewed said preliminary plat which is named Island Estates, and WHEREAS, following a pubhc hearing, the Planrung Commission found the proposed plat promoted the general welfare of the commumty and recommended said prehmmary plat be approved with conditions, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO: That the preliminary plat for Island Estates located in the southwest quarter of Section 9, Township 9 North, Range 29 East W M, is hereby approved with the following conditions 1) At the time lots are developed all abutting rights-of-way shall be developed to City standards This includes but is not limited to water and sewer lines, curb, gutter, sidewalks, and streets 2) At the time Phase #1 is developed the developer shall dedicate and improve to city standards the "Valdez" right-of-way from the northern boundary of Phase #1 to the connection with Sandifur Parkway 3) At the time Phase #1 is developed the developer shall dedicate and improve to city standards the eastern 40 feet of the southwest quarter section of 9-9-29 ("Rd 76") The pavement shall be no less than 24 feet in width - -4) - - At the time Phase #2 is developed the developer shall dedicated and improved to City standards the northern 51 feet of the southwest quarter section of 9-9-29 ("Sandifur Parkway") These improvements shall be similar to the established pavement and landscaping pattern on Sandifur Parkway 5) At the time Phase #3 is developed the developer shall dedicate and improve to city standards that portion of "Galiano" lying within Phase #5 6) Prior to the completion of each phase abutting Sandifur Parkway and Road 76 (Phases 1, 2, 4, 5 and 6) the developer shall mstall fencing to separate Sandifur Parkway and Road 76 from abutting lots Said fencing shall be 6-ft in height, wooden and sight obscuring The City may make repairs or replace the fencing as needed Property owners adjoining said fence shall be responsible for payment of all costs associated with maintenance and upkeep These fencing requirements shall be noted clearly on the face of the final plat (s) ity City of Pasco this 19th day of August 1996 Charles D Kilbury, 'of 7) Access shall be prohibited onto Sandifur Parkway and Road 76 by means of deed restrictions or statements on the face of the final plat(s) 8) The developer shall pay the City a "common area maintenance fee" of $200 per lot upon issuance of all building permits for homes These funds shall be placed m a fund and used to finance the maintenance of lands on Sandifur Parkway The City shall accept maintenance responsibility for landscaping abutting Sandifur Parkway at such tune as all maintenance fees for each individual phase abutting Sandifur Parkway have been paid in full For example, when all fees have been paid for Phase # 2, the City will accept maintenance responsibility for the section of Sandifur Parkway which abuts Phase #2 of the project 9) A 10 foot bikeway shall be provided and improved in the vicinity of lots 33 to 35 of Phase # 1 10) The developer shall pay the City a park impact fee of $300 per lot Payment shall be as follows a) A lump sum of $69,500 (695 lots x $100), such sum to be used by the City for a neigborhood park south of Sandifur Parkway, and, b) $200 per lot upon issuance of building permits for each lot in Phase 1-6 (total amount due is $200 x 695 lots = $139,000) Catherine D Seaman, Deputy City Clerk APPROVED AS TO FORM L__— a=-------" Leland B Kerr, Interim City Attorney
