HomeMy WebLinkAbout2169 ResolutionPASCO RESOLUTION NO. a 1G9 FRANKLIN COUNTY RESOLUTION NO A J OINT RESOLUTION of the Pasco City Council and the Board of Franklin County Commissioners establishing a procedure for the resolution of impasse in contract negotiations WHEREAS, the members of the Pasco City Council and the Board of Franklin County Commissioners both agree that their inability to timely resolve negotiations on critical and significant contractual matters affecting both directly and indirectly the administration of criminal justice in Franklin County has resulted in wasted resources and strained relationships, and WHEREAS, both parties desire to establish a process for conflict resolution through the use of a third party non-binding mediation process allowing the parties to present their viewpoints and arguments in a positive and constructive manner hopefully leading to a mutually agreeable resolution of their disagreement, now, therefore, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON AND THE BOARD OF FRANKLIN COUNTY COMMISSIONERS BOTH DO HEREBY RESOLVE AS FOLLOWS 1. In all matters involving the negotiation of a new agreement or the application or interpretation of an existing agreement with a monetary value of $25,000 00 or more where the efforts of the City and the County have failed to reach agreement, either the Pasco City Council or the Board of Commissioners for Franklin County may by resolution, declare an impasse in their negotiations causing the third party mediation process set forth below to be utilized 2. A copy of the resolution shall be sent to the Pasco City Manager or the Chairman of the Board of Franklin County Commissioners, as the case may be, and to Washington Arbitration and Mediation, Inc , Seattle, Washington, or such other independent mediation service or professional as the parties may agree Washington Arbitration and Mediation, Inc or such other mediation service or professional shall then timely arrange with both the Pasco City Council and the Board of Franklin County Commissioners for a mediation session concerning the matters in dispute The City and the County shall jointly agree on a Mediation Service panel Mediator within twenty (20) days of receipt by the non-issuing party of the Resolution Declaring Impasse or the Mediator shall be selected by the Mediation Service Both the Pasco City Council and the Board of Franklin County Commissioners shall use their best good faith efforts to cooperate with the Resolution No. a \ C,c1 Pag e 1 of 2 Catherine D Seaman Deputy City Clerk Approved As To Form: ubstello rney Ci Sue Miller Chairman Neva Cork Commis independent Mediator in making timely arrangements for the mediation session The mediation session shall be held at a location in Franklin County with sufficient room for both the Pasco City Council and the Board of Franklin County Commissioners and allow seating for the public to the extent such mediation sessions are required to be open to the public under the State Open Meetings Act 3.
