A RESOLUTION approving a three year jail contract with Franklin
County, and in the alternative requesting mediation pursuant to Pasco
Resolution No 2169, a joint Resolution with Franklin County
WHEREAS, the City and the County have been unable to come to
terms on an agreement for jail services despite negotiations, offers and
counter-offers since the last negotiated agreement expired, and
WHEREAS, the City's last counter-proposal to the County incorporated
the contract terms and conditions recently agreed to between the City of
Kennewick and Benton County, but contained a forty dollar per prisoner day
rate instead of the forty-five dollar per prisoner day rate contained in the
Kennewick/Benton County agreement due to the lower operating costs of the
Franklin County Correctional Facility, and
WHEREAS, the Franklin County Commissioners have responded by
the insistence upon a forty-five dollar per prisoner day rate, which the City
Council continues to believe is unjustified by the expenditure budget of
Franklin County for the Franklin County Correctional Facility, and
WHEREAS, the City Council, however, in recognition of the need for
the City and the County to come to agreement and further recognizing the
precarious financial condition of Franklin County has determined that in the
best interest of it citizenry a final attempt at compromise be made on the daily
prisoner rate issue, which appears to be the only issue still keeping the parties
from agreement, and
WHEREAS, an offer of forty-three dollars per prisoner day for 1995,
forty-five dollars per prisoner day for 1996 and forty-seven dollars per
prisoner day for 1997 will provide Franklin County with additional revenue
and provide both the City and the County with greater certainty and budget
planning over the next three years, now, therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO
RESOLVE AS FOLLOWS:
1. That certain agreement for use of jail facilities, attached hereto and
incorporated herein by this reference as if specifically set forth, is approved by
the City Council and the Mayor is authorized to sign the same

2. The City Manager shall cause the agreement, in duplicate original, to
be sent to the Franklin County Commissioners for their approval and
signature
3 In the event the Franklin County Commissioners fail to approve the
agreement, the Pasco City Council hereby declares pursuant to Pasco
Resolution No 2169 and Franklin County Resolution No 95-309 an impasse
in their negotiations for a successor agreement for use of jail facilities and
initiates hereby, the third party mediation process set forth in said
Resolutions
4. A copy of this Resolution shall be delivered by the Pasco City
Manager to the Franklin County Commissioners for their consideration and
action
Passed by the City Council of the City of Pasco, at a regular meeting
this 3 day of April, 1994
