A RESOLUTION authorizing the sale of certain properties purchased with Local
Improvement Guarantee Funds and rejecting unacceptable
proposals
WHEREAS, the city previously purchased from Franklin County properties
foreclosed for delinquent general taxes which were also encumbered with City of
Pasco Local Improvement District assessments, and
WHEREAS, the city previously advertised the property for sale, and
WHEREAS, the city desires to sell the property and the City Council believes
the price offered is reasonable considering fair market value, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DOES RESOLVE AS
FOLLOWS
Section 1 Lots 6, 7, 8, 9, 10, Block 30, A M Wehe's Addition in the City of
Pasco is hereby authorized to be sold to Lily of the Valley Church, or their
designee, for the purchase price of One-Thousand Fifty Dollars ($1 050 00) for
each lot, free of local improvement district encumbrance
The deeds for said lots shall contain restrictions limiting for 25 years the
use of the properties to church and accessory uses unless released by the City
Section 2 Lots 15, 16, 17, 18, 19, 20, 21, 21, 22, 23, 24, 25, 26, 27, and 28, Block
11, A M Wehe's Addition, in the City of Pasco is hereby authorized to be sold to
Enrique Munllo, or his designees, for the purchase price of One-Thousand Dollars
($1,000 00) for each lot, free of local improvement district encumbrance
The deeds for said lots shall stipulate that the initial occupants of homes
built on the lots be owner-occupants The deeds shall also contain reverter
clauses stating that should homes not be completed on each lot within eighteen
(18) months, the undeveloped lots shall revert back to the city and the purchaser
shall receive one-half of the purchase price as a refund The city shall grant
extensions for good cause shown if substantial construction is in progress
Section 3 Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 22, 23, 24, 25, 26, 27, 28, Block
4, A M Wehe's Addition in the City of Pasco is hereby authorized to be sold to
Curtis and Judy Giles, or their designees, for the purchase price of One-Thousand
Dollars ($1,000 00) for each lot, free of local improvement district encumbrance
The deeds for said lots shall mandate that the initial occupants of homes
built on the lots be owner-occupants The deeds shall also contain reverter
clauses requiring that one (1) lot be developed with a residential structure within
one (1) year and one (1) additional lot be developed with a residential structure at
six (6) month intervals thereafter Should this schedule not be adhered to, the
undeveloped land shall revert back to the city and the purchaser shall receive
one-half of the purchase price for such lots as a refund The city shall grant
extensions for good cause shown if substantial construction work is in progress

Section 4 Lots 15, 16, 17, Block 8, A M Wehe's Addition, in the City of Pasco
is hereby authorized to be sold to Auturo and Connie Soto, or their designee, for
the purchase price of One-Thousand Three Hundred Dollars ($1,300 00) for each
lot, free of local improvement district encumbrance
The deeds for said lots shall mandate that the initial occupants of homes
built on the lots be owner-occupants The deeds shall also contain reverter
clauses stating that should homes not be completed on each lot within eighteen
(18) months, the undeveloped lots shall revert back to the city and the purchaser
shall receive one-half of the purchase price as a refund The city shall grant
extensions for good cause shown if substantial construction is in progress
Section 5 Proposals submitted by Benard Shaw, Jose and Manuel Chavello,
Nancy A Shaw, and Cejka Family Properties are hereby rejected
Section 6 Conveyance shall be by Local Improvement Assessment Deed
approved by the City Attorney, subject to all easements, restrictions, covenants
and reservation of record and delivered to the purchasers upon receipt of the
cash purchase price Purchaser's shall be responsible for recording and all costs
associated therewith
