HomeMy WebLinkAbout2153 ResolutionFelice, Mayor RESOLUTION NO. 2153 A RESOLUTION fixing the time and place for a public hearing to consider vacation of the east 15' of Railroad Avenue from 1-182 to the Foster Wells Rd WHEREAS, from time to time in response to petitions or in cases where it serves the general interest of the city, the City Council may vacate rights-of-way, and WHEREAS, R C W 35 79 requires public hearings on vacations to be fixed by Resolution, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO: That a public hearing to consider vacation of the east 15' of Railroad Avenue lying northerly of 1-182 to the southerly nghtOof-way line of Foster Wells Road, will be held before the City Council of the City of Pasco in the Council Chambers of the City Hall, 412 West Clark Street, Pasco, Washington, at the hour of 7 30 p m, on the 7th day of November, 1994 That the City Clerk of the City of Pasco give notice of said public hearing as required by law PASSED by the City Council of the City of Pasco this 3rd day of October, 1994 AT 1E,ST Catherine Seaman, Deputy City Clerk AP N' OVED • T e •nnn Rubstel o, City Attorney AGENDA REPORT NO 95 DATE 9/28/94 . 4. 111:111 FOR: City Council TO: Gary Crutchfiel nager Richard J Smit Community and conomic Developme t 1 WORKSHOP REGULAR 10/3/94 FROM: David I McDonald, City Planner SUBJECT STREET VACATION- Portion of Railroad Avenue from 1-182 to the Foster Wells Rd (MF #94-67-V) I. REFERENCE(S): A Vicinity Map B Proposed Resolution II. ACTION REOUESTED OF COUNCIL/STAFF RECOMMENDATIONS: MOTION: I move to approve Resolution No (21S 3 , fixing 7 30 PM, November 7, 1994 as the time and place for a public hearing to consider the proposed vacation III. FISCAL IMPACT NONE IV. HISTORY AND FACTS BRIEF A The Franklin County P U D has requested the city vacate the east 15' of Railroad Avenue from 1-182 to foster Wells Rd for the purpose of locating an electrical transmission line B State law requires that more than 2/3 of the abutting property owners sign the vacation petition to make it valid Because the vacation request does not the not meet the statutory requirement the P U D is requesting the city initiate the street vacation process for this portion of Railroad Avenue C Staff would recommend the City Council initiate the street vacation process through the passage of a resolution which would fix a public hearing to consider the vacation The earliest regular City Council meeting available for a public hearing (which provides the statutory 20-day hearing notice), is November 7, 1994 V DISCUSSION A Normally the P U D places their improvements in the rights-of-way, but due to the size of the transmission line and the potential for the city to request the improvements in the right-of-way be moved (at the providers expense), the P U D has requested the vacation The P U D would like the area retained as an easement so obtaining easements from the individual owners is not necessary VI ADMINISTRATIVE ROUTING VICINITY MAP inn nn ..... us =.......a: .... ..........................
