HomeMy WebLinkAbout2152 ResolutionCITY OF PASCO, WASHINGTON RESOLUTION NO. a\5 a A RESOLUTION of the City Council of the City of Pasco, Washington, declaring its intention to enlarge the boundary of Local Improvement District No. 126 to include one additional parcel of property and to make street improvements not included in the original scope of work to the additional parcel and a second parcel of property currently within Local Improvement District No. 126 and to assess the cost and expense of carrying out those additional improvements against only the two parcels of property specially benefited thereby, and notifying all persons who desire to object to the additional improvements to appear and present their objections at a hearing before the City Council to be held on October 3, 1994. WHEREAS, by Ordinance No. 3010 adopted April 18, 1994, the City Council of the City of Pasco, Washington (the "City Council") ordered the improvement of Broadmoor Parkway, including grading, base course, asphalt concrete surfacing, drainage facilities, all other work necessary therefor or incidental thereto, illumination, curbs and gutters and sidewalks, and WHEREAS, the City Council since has determined that the boundaries of the district should be enlarged and improvements not included in the original scope of work be made on the additional property; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, as follows: Section 1. It is the intention of the City Council of the City of Pasco, Washington, to enlarge the boundary of Local Improvement District No. 126 ("LID No.' 126") to include one additional parcel of property and to make street improvements not included in the original scope of work to that parcel and a second 0146801 WP parcel of property, currently within LID No. 126, as such properties are described in Exhibit A, attached hereto and by this reference made a part hereof, by providing gra4ing, base course, asphalt concrete surfacing, drainage facilities, illumination, curbs and gutters and sidewalks, all on the east side of Road 100, between the south line of Section 8 Township 9 North, Range 29, East Willamette Meridian to the south line of Broadmoor Parkway (the "Additional Improvements"). All of the foregoing Additional Improvements shall be in accordance with the plans and specifications therefor prepared by the City Engineer of the City and may be modified by the City as long as that modification does not affect the purpose of the Additional Improvements. Section 2. The total estimated cost and expense of the Additional Improvements is declared to be $ 250,000 and the entire cost and expense of the Additional Improvements shall be borne by and assessed against only the two parcels specially benefited by the Additional Improvements included in LID No. 126. Actual assessments may vary from estimated assessments as long as they do not exceed a figure equal to the increased true and fair value the Additional Improvements add to the property. Section 3. The City Clerk is authorized and directed to give notice of the adoption of this resolution and of the date, time and place fixed for the public hearing to both owners or reputed owners of the two parcels of property by mailing such notice at least 15 days before the date fixed for public hearing to the owners or reputed owners of the property as shown on the rolls of the 0146801 WP 2 Franklin County Assessor at the address shown thereon, as required by law. This resolution also shall be published in at least two consecutive issues of the official newspaper of the City, the date of the first publication to be at least 15 days prior to the date fixed for the public hearing. Section 4. All persons who may desire to object to the Additional Improvements are notified to appear and present those objections at a hearing before the City Council to be held in the Council Chambers in the City Hall in Pasco, Washington, at 7:30 p.m. on Monday, October 3, 1994, which time and place are fixed for hearing all matters relating to the Additional Improvements and all objections thereto and for determining the method of payment for the Additional Improvements. All persons who may desire to object thereto should appear and present their objections at that hearing. Any person who may desire to file a written protest with the City Council may do so within 30 days after the date of passage of the ordinance ordering the Additional Improvements. The written protest should be signed by the property owner and should include the legal description of the property for which the protest is _ filed and that protest should be delivered to the City Clerk. Section 5.
