RESOLUTION NO. a\51
A RESOLUTION of the City Council of the City of
Pasco, Washington, declaring its intention to enlarge the
boundary of Local Improvement District No. 128 and to
make additional improvements not included in the original
scope of work to the additional property and to assess
the cost and expense of carrying out those improvements
against the entirety of Local Improvement District No.
128, and notifying all persons who desire to object to
the improvements to appear and present their objections
at a hearing before the City Council to be held on
October 3, 1994.
WHEREAS, by Ordinance No. 3032 adopted July 5, 1994, the City
Council of the City of Pasco, Washington (the "City Council")
ordered the improvements in the Pasco Processing Center, including
construction of curbs, gutters, streets, waterlines, sanitary and
industrial sewer lines, storm drainage, illumination and other work
necessary therefor and incidental thereto; and
WHEREAS, the City Council since has determined that the
boundaries of the district should be enlarged and improvements not
included in the original scope of work be made on the additional
property; _
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO,
WASHINGTON, as follows:
Section 1. It is the intention of the City Council of the
City of Pasco, Washington, to enlarge the boundary of Local
Improvement District No. 128 ("LID No. 128") and to make additional

improvements not included in the original scope of work to the
newly added property as such property is described in Exhibit A,
attached hereto and by this reference made a part hereof, the
additional work includes excavation, grading, base course and
asphalt paving on Foster Wells Road and SR-395 (the "Additional
Improvements").
All of the foregoing Additional Improvements shall be in
accordance with the plans and specifications therefor prepared by
the City Engineer of the City and may be modified by the City as
long as that modification does not affect the purpose of the
Additional Improvements.
Section 2. The total estimated cost and expense of the
Additional Improvements is declared to be $50,000 and the entire
cost and expense of the Additional Improvements shall be borne by
and assessed against the property specially benefited by the
Additional Improvements included in LID No. 126 which embraces as
nearly as practicable all property specially benefited by such
Additional Improvements. Actual assessments may vary from
estimated assessments as long as they do not exceed a figure equal
to the increased true and fair value the Additional Improvements
add to the property.
Section 3. The City Clerk is authorized and directed to give
notice of the adoption of this resolution and of the date, time and
place fixed for the public hearing to both owners or reputed owners
of the property by mailing such notice at least 15 days before the
date fixed for public hearing to the owners or reputed owners of
the property as shown on the rolls of the Franklin County Assessor

at the address shown thereon, as required by law. This resolution
also shall be published in at least two consecutive issues of the
official newspaper of the City, the date of the first publication
to be at least 15 days prior to the date fixed for the public
hearing.
Section 4. All persons who may desire to object to the
Additional Improvements are notified to appear and present those
objections at a hearing before the City Council to be held in the
Council Chambers in the City Hall in Pasco, Washington, at 7:30
p.m. on Monday, October 3, 1994, which time and place are fixed for
hearing all matters relating to the Additional Improvements and all
objections thereto and for determining the method of payment for
the Additional Improvements. All persons who may desire to object
thereto should appear and present their objections at that hearing.
Any person who may desire to file a written protest with the City
Council may do so within 30 days after the date of passage of the
ordinance ordering the Additional Improvements. The written
protest should be signed by the property owner and should include
the legal description of the property for which the protest is _
filed and that protest should be delivered to the City Clerk.
Section 5. The City Engineer is directed to submit to the
City Council on or prior to October 3, 1994, all data and
information required by law to be submitted.

The legal descriptions for the areas to be Included shall be as follows
That portion of the public rights-of-way for Foster Wells Road
and SR-395, located in Sections 5, 6, 7 and 8 Township 9
north Range 30 east Willamette Meridian, described as
follows, That portion of Foster Wells Road beginning at the
easterly right-of-way line of SR-395, Thence southwesterly a
distance of 2,773 83 feet as measured along the centerline of
Foster Wells Road and terminus of that description together
with that portion of the right-of-way for SR-395 lying within
the northwest quarter of Section 8 Township 9 north Range
30 east Willamette Meridian
