HomeMy WebLinkAbout2149 ResolutionCatherine Seaman, Deputy City Clerk ROVED A 1T0 Gre bstel o, City Attorney RESOLUTION NO. 2149 A RESOLUTION fixing the time and place for a public hearing to consider vacation of a certain alley right-of-way within the city WHEREAS, from time to time in response to petitions or in cases where it serves the general interest of the city, the City Council may vacate rights-of-way, and WHEREAS, R C W 35 79 requires public hearings on vacations to be fixed by Resolution, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO. HISTORY AND FACTS BRIEF A Bobby Gilbert and Nancy McGiegor, property owners lepresenting 66% of the abutting pi ivate piopei ty of the alley in Block 137 have submitted a petition iequesting the vacation of this alley B State law iequires that mole than 2/3 of the abutting pioperty owneis sign the vacation petition to make it valid Because the vacation icquest for the alley in Block 137, does not the not meet the statutory requilemcnt the applicants are icquesting the city initiate the sticet vacation process for this alley C The City Council held a public hearing on this mattei on august 1, 1994 at which time the alley in Block 136 was vacated Due to concerns over access to the rear of the Fasteners Inc building the alley in block 137 was not vacated Staff has spoken with Mr Gilbert and the onwners of the Fasteners building about vacating the portion of the alley that would not impact Fasteners access All parties are in aggrement to vacate the alley in the southein half of the block D Staff would lecommend the City Council initiate the street vacation process thiough the passage of a resolution which would fix a public healing to consider the vacation The cal hest regular City Council meeting available for a public hearing (which pi ovidcs the statutory 20-day hearing notice), is October 3, 1994 V.
