HomeMy WebLinkAbout2142 ResolutionATTACHMENT C - RESOLUTION NO av-i A RESOLUTION approving a preliminary plat for Sunny Meadows WHEREAS, R C W 58 17 enables the city to uniformly administer the process of subdividing property for the overall welfare of the community, and, WHEREAS, owners and developers of property situated in the southwest quarter of Section 10, TN, R 29E W M , have requested approval of a preliminary plat, and, WHEREAS, the Planning Commission has reviewed said preliminary plat which is named Sunny Meadows, and, WHEREAS, following a public hearing, the Planning Commission found the proposed plat promoted the general welfare of the community and recommended said preliminary plat be approved with conditions, NOW, THEREFORE, - BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON ORDAIN AS FOLLOWS That the preliminary plat for Sunny Meadows, located in the southwest quarter of Section 10, Township 9 North Range 29 East W M , is hereby approved with the following conditions 1) The northerly alignment of Broadmoor Parkway shall be tapered in the northeast corner of the plat for approximately 800 feet to align the centerline of Broadmoor Parkway with the section line to the east 2) The Amanda Drive access point shall be moved to Robert Court and the northern access point of Robert Wayne Drive shall be moved to Vanette Drive 3) The "Future Commercial" wording shall be removed from Tract "A" and "B" 4) Phasing shall be shown on the plat 5) A minimum of four pedestrian ways 10 feet in width shall be provided for access to the park 6) The necessary right-of-way across the south 165-feet of the southwest quarter of Section 10, T 9 N R 29E shall be acquired for Robert Wayne Drive (60-feet), Road 60 (40-feet) and the north/south road along the west line of the preliminary plat (40-feet) 7) The developer shall be required to obtain the necessary (65-feet) of right-of way for Burden Road on the north side of the proposed center line 8) In addition to developing and improving the interior local access streets of Sunny Meadows, the Developers shall be required to develop and improve two lanes with curb and gutter on the Burden Road alignment The developer shall also develop and improve two lanes with curb and gutter on the APPRC1A1 D AS Greg R bstello, City Attorney Road 60 alignment Curb and gutter shall only be placed on the west side Road 60 shall be graveled the full length of the plat during Phase I The City will accept maintenance responsibility for the graveled roadway The improvements on Burden Road shall be constructed in conjunction with Phase I The remainder of the improvements on Road 60 will be constructed to coincide with the phasing of the plat 9) The Overton Road Easement shall be shown on the preliminary plat The Overton Road easement must be vacated prior to final plat approval for Phases 5, 6 and 7 The developer shall be responsible for working with affected property owners to effectuate vacation of the ingress and egress for Overton Road PASSED by the City Council of the City of Pasco this ,5--- ,.S ..: day of ,1994 , -- ro --ftrn It, y t.,c -13L,Felice, Ma or Char le..5 K 1 I bcArc, ATTEST Catherine Seaman, Deputy C ity Clerk FOR City Counci TO Gary Crutchfiel ' AGENDA REPORT NO 75 410 DATE 6/29/94 anager WORKSHOP REGULAR 6/29/94 . FROM David I --)5- c-? l)SerratT,—Commumty Development Director SUBJECT PRELIMINARY PLAT APPROVAL - Sunny Meadows (MF #94-39-PP) I REFERENCE(S) A Memo To City Manager B Resolution #2140 C Alternate Resolution II ACTION REQUESTED OF COUNCIL/STAFF RECOMMENDATIONS Motion I move to approve Resolution No , approving the preliminary plat for Sunny Meadows III FISCAL IMPACT NONE IV HISTORY AND FACTS BRIEF A On June 9, 1994, the Planning Commission conducted a public hearing for the purpose of review and developing recommendations for the preliminary plat of Sunny Meadows B Following the conduct of a public hearing, the Planning Commission determined that with certain conditions, the preliminary plat could be recommended for approval C The next step in the development process is to have the preliminary plat reviewed and approved by the City Council D Upon approval of the preliminary plat, the developer can commence necessary engineering work for the design of street and utility improvements V DISCUSSION See attachment "A" for DISCUSSION VI OTHER COMMENTS VI ADMINISTRATIVE ROUTING ATTACHMENT A MEMORANDUM June 29, 1994 TO: Gary Crutchfield, City Manager FROM: David I McDonald, Community Development Director SUBJECT: Sunny Meadows Preliminary Plat Approval At the last two council meetings there was considerable discussion and concern expressed about the Sunny Meadows Project principally by county residents who are fearful of losing access to their properties The developer of Sunny Meadows was fully aware of the need for preserving access to the adjoining county subdivision when Sunny Meadows was laid out There has been no effort made on the part of the developer to block or eliminate access to any adjoining property Robert Wayne Drive as well as Road 60 will provide more direct routes to the county subdivision in question Ultimately, the improvements that will be made with the Sunny Meadows development will provide far superior access than is currently available To further allay concerns, language was placed within Resolution 2140 to ensure the Overton Road easement would remain in place until such time as acceptable alternative access routes were provided Resolution 2140 requires the developer to acquire the necessary right-of-way for the north half of Burden Road and the north-south connecting streets This resolution also requires the developer to improve Burden Road during the first phase and improve Road 60 to coincide with phasing of the plat Overton Road would remain in place and undisturbed until Phases 5, 6, and 7 To obtain relinquishment of that road easement the developer would have to provide the necessary access Resolution 2140 would ensure existing access would be protected, but requires both the developers and adjoining property owners to collectively work on how and when the Overton Road easement would be vacated 1...' 1., The concerned property owners, through their attorney, have indicated they can secure the necessary signatures to abandon the Overton Road easement under certain conditions Those conditions being an improved roadway on the Burden Road alignment and a graveled roadway on the Road 60 alignment that would be maintained by the City According to the attorney for the residents "this would provide a complete resolution of the access issue, and therefore would substantially benefit the developers as well as others concerned" The concerned property owners have requested additional language be provided in a resolution to guarantee a maintained graveled road for Road 60 during the first phase of this development While the maintenance of a graveled road may be a small price to pay to facilitate development and release encumbrances on property for future development, the proposal is not without some pitfalls Graveled roads are considered substandard development in the City and may cause the City to take additional liability if maintenance was accepted There would be a small annual cost (approximately $1500) to maintain the graveled road and there's no guarantee when this maintenance responsibility would end After the last council meeting staff visited with the concerned property owners and proposed developer to reach a solution to the apparent impasse over the development of Sunny Meadows As a result of that discussion, the developer confirmed that he would be willing to provide a graveled road on the Road 60 alignment at no cost to the City The concerned property owners reaffirmed what their attorney had stated, that they would relinquish their rights to Overton Road if Road 60 was graveled and maintained by the City during the first phase of this development Staff has provided an alternate resolution that contains additional language related to graveling Road 60 and having that roadway maintained by the City Council has the option of bringing Resolution 2140 up for a vote again or placing a new resolution on the table for consideration
