HomeMy WebLinkAbout2141 Resolution, Mayor ox\ RS 1C n lbukr( Al IEST RESOLUTION NO. cZ_t\ A RESOLUTION fixing the time and place for a public hearing to consider vacation of certain alley rights-of-way within the city WHEREAS, from time to time in response to petitions or in cases where it serves the general interest of the city, the City Council may vacate rights-of-way, and WHEREAS, R C W 35 79 requires public hearings on vacations to be fixed by Resolution, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO: That a, public hearing to consider the vacation of the north/south alleys in Blocks, 136 and 137 Pasco Land Company's First Addition, will be held before the City Council of the City of Pasco in the Council Chambers of the City Hall, 412 West Clark Street, Pasco, Washington, at the hour of 7 30 pm, on the 1st day of August, 1994 That the City Clerk of the City of Pasco give notice of said public hearing as required by law PASSED by the City Council of the City of Pasco this 5th day of July, 1994 , Catherine Seaman, Deputy City I k APPRO Gre Rubstello, City Attorney AGENDA REPORT NO 78 FOR: City Council DATE 6/30/94 TO. REFERENCE(S): A Vicinity Map B Proposed Resolution II. ACTION REQUESTED OF COUNCIL/STAFF RECOMMENDATIONS: MOTION. I move to approve Resolution No , fixing 7 30 PM, August 1, 1994 as the time and place for a public hearing to consider the proposed vacation III. FISCAL IMPACT: NONE IV. HISTORY AND FACTS BRIEF. A Bobby Gilbert and Nancy McGregor, property owners representing 66% of the abutting private property of the alley in Block 137 and 100% of the abutting private property of the alley in Block 136 have submitted a petition requesting the vacation of these alleys B State law requires that more than 2/3 of the abutting property owners sign the vacation petition to make it valid Because the vacation request for the alley in Block 137, does not the not meet the statutory requirement the applicants are requesting the city initiate the street vacation process for this alley The petition does meet the statutory requirements to proceed with the vacation of the alley in Block 136 C Staff would recommend the City Council initiate the street vacation process through the passage of a resolution which would fix a public hearing to consider the vacation The earliest regular City Council meeting available for a public hearing (which provides the statutory 20-day hearing notice), is August 1, 1994 V.
