RESOLUTION NO a )3 477
A RESOLUTION accepting a ten percent annexation petition and
providing a determination on the territory to be
annexed and whether simultaneous zoning and the
assumption of bonded indebtedness will be required
WHEREAS, owners of property, located between the east City
limits and SR-12, as indicated in Exhibit "A" attached hereto, have
initiated action to annex to the City of Pasco, and,
WHEREAS, the City Council of the City of Pasco has reviewed the
annexation petition and has determined annexation of the territory
would further orderly growth of the City and is in the best interest of the
community, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, DO RESOLVE AS
FOLLOWS
A) That the City will accept the proposed territory to be
annexed as described and depicted on Exhibit "A" attached hereto
B) That the territory to be annexed will be zoned
simultaneous with annexation in accordance with Council Resolution
2122
C) That the annexation area will not be required to assume
any portion of existing City bonded indebtedness
PASSED by the City Council of the City of Pasco this 6th day of
June, 1994

Motion I move to approve Resolution No , accepting the Port
annexation petition and providing a determination on
zoning and indebtedness

IV HISTORY AND FACTS BRIEF
A The Port of Pasco has submitted a petition to initiate annexation
of the Big Pasco Industrial Complex In addition, the City presently
serves water to the Chevron Tank Farms and a representative of
Chevron Pipeline Corporation also signed the petition requesting
annexation
B Upon receipt of a ten percent (10%) annexation petition, the City
is required by law to set a date for a meeting to determine
1) Whether the City will accept the proposed annexation,
2) Whether the City will require simultaneous adoption of zoning,
and,
3) Whether the City will require the property to assume all or a
portion of existing City indebtedness
C Upon acceptance of the initial ten percent (10%) petition and
action on the foregoing issues, the petitioners would be authorized to
circulate a sixty (60%) petition to be returned to the City for
appropriate action to annex the property
V DISCUSSION
The 60% petition that is authorized to be circulated upon acceptance of
the 10% petition is to include language related to zoning requirements
and indebtedness It has been the past practice of the City to not
require simultaneous zoning or the assumption of existing
indebtedness on annexations The proposed resolution attached hereto
contains language consistent with the past practice on indebtedness,
however at the request of the Port, zoning will ocur simultaneous with
annexation
Prior to action on the sixty percent (60%) petition, the Boundary Board
will have to review the proposed annexation
