A RESOLUTION approving the loan of the sum of three million eight
hundred two thousand seven hundred seventy-nine dollars from the State of
Washington, Department of Ecology for waste water facility improvements
WHEREAS, pursuant to its authority under RCW Chapter 90 50A, the
State of Washington, Department of Ecology has offered to loan the City the
sum of three million eight hundred two thousand seven hundred seventy-
nine dollars to help finance the City of Pasco Waste Water Facilities
Improvements Project, and
WHEREAS, the City of Pasco has the authority to enter into a loan
agreement with the State of Washington, Department of Ecology for such
purposes and desires to borrow said funds at the interest rate offered, and
WHEREAS, the Pasco City Council has upon the advice of its staff
determined that said loan is in the best interests of the City and the terms and
conditions for said loan as set forth in the attached loan agreement are
acceptable to the City, now, therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON
DOES RESOLVE AS FOLLOWS:
1. The loan of three million eight hundred two thousand seven
hundred seventy-nine dollars from the State of Washington, Department of
Ecology, for City of Pasco Waste Water Facilities improvements upon the
terms and conditions set forth in the attached loan agreement are hereby
accepted by the City and the Mayor is authorized to sign the same on behalf of
the City of Pasco

Motion I move to adopt Resolution No approving a loan in
the amount of $3,802,079 00, from the Washington State
Department of Ecology, to be used for the upgrade of the
Wastewater Treatment Plant

This is the first loan we have applied for and received from the
Washington State Department of Ecology, for the upgrade of the
treatment plant This is a 20-year loan at 4 5 per cent annual interest
On May 27, 1994, we will learn if we were successful with the first
centential grant application The reason I am pointing this out is
because we don't want to bid on the first phase until we know how
much money we have That will be answered on May 27th The
optional bid packages are ready to go

declaring its intention to or-
der the improvement of lay-
ing asphalt for new streets
installing sanitary sewers
and street lighting east of
Utah Avenue to Elm Ave-
nue and North of Highland
Street to Sheppard Street
and to create a local im
provement district to as
sess the cost and expense
of carrying out those im
provements apainst the
properties specially bene
fited thereby and notifying
all persons who desire to
object to theAmprovements
to appear and present their
objections at a hearing be-
jore the_City Council to be
held on July 17 -2000--
BE IT RESOLVED BY THE
CITY COUNCIL OF THE
CITY OF PASCO
WASHINGTON as follows
Section 1 It is the intention
of the City Council of the
City of Pasco Washington
to order the improvement
of the properties within the
area described in Exhibit A
attached hereto and by this
reference made a part
hereof by the laying of as
phalt for new streets
installing sanitary sewers
and street lighting east of
Utah Avenue to Elm Ave-
nue and North of Highland
Street to Sheppard Street
All of the foregoing im-
provements shall be in
accordance with the plans
and specifications therefor
prepared by the Public
Works Department of the
City and may be modified
by the City as long as that
modification does not affect
the purpose of the im-
provements
Section 2 The total es-
timated cost and expense
of the improvements is de-
clared to be $447 444 37
and the entire cost and ex-
pense of the improvements
shall be borne by and as-
sessed against the prop-
erty specially benefited by
the improvements to be in-
cluded in a local im-
provement district to be
established embracing as
nearly as practicable all the
property specially benefited
by the improvements Ac-
tual assessments may vary
from estimated assess
ments as long as they do
not exceed a figure equal
to the increased true and
fair value the im
provements add to the
property
Section 3 The City Clerk is
authorizeJ and directed to
give notice of the adoption
of this resolution and of the
date time and place fixed
for the public hearing to
each owne, or reputed
owner of any lot tract par
cel of land or other property
within the proposed local
improvement district by
mailing suchtnotice at least
fifteen days before the date
fixed for public hearing to
the owner or reputed owner
of the property as shown
on the rclls of the Franklin
County Assessor at the ad-
dress shown thereon as
required by law The City
Clerk also is authorized
and directed to give notice
of the adoption of this
resolution and of the date
time and place fixed for the
public hearing to each
owner or reputed owner of
any lot tract parcel of land
or other property outside of
the proposed local im
provement district that is
required by the Federal
Housing Administration as
a condition of loan
qualification to be con-
nected to the proposed im-
provements by mailing
such notice at least 15
days before the date fixed
for the public hearing to the
owner or reputed owner of
the property as shown on
the rolls of the County
Assessor at the address
shown thereon as required
by law This resolution also
shall be published in its
entirety in at least two
consecutive issues of the
official newspaper of the
City the date of the first
publication to be at least 15
days prior to the date fixed
for the public hearing
Section 4 All persons who
may desire to object to the
improvements are notified
to appear and present
those objections at a hear
ing before the City Council
to be held in the Council
Chambers in the City Hall
in Pasco Washington at
7 00 p m on Monday July
17 2000 which time and
place are fixed for hearing
all matters relating to the
improvements and all
objections thereto and for
determining the method of
payment for the im
provements All persons
who may desire to object
thereto should appear and
present their objections at
that hearing Any person
who may desire to file a
written protest with the City
Council may do so within
30 days after the date of
passage of the ordinance
ordering the improvements
in the event the local im
provement district is
formed The written protest
should be signed by the

linclude the legal

and that protest should be
delivered to the City Clerk
Section 5 The Public
