A RESOLUTION objecting to Air Quahty Regulations due to wind-blown dust
WHEREAS, the United States Environmental Protection Agency (EPA), on the
basis of the federal Clean Air Act, has established a standard for air quality, known as
the PM 10 Standard, essentially requiring regulation of air emissions in those
geographic areas experiencing airborne particulates m excess of PM 10, and
WHEREAS, the Benton Franklin Clean Air Authority (BFCAA) is a regional
entity composed of local representatives and which is considering local regulations to
restrict air emissions in the community based principally on the PM 10 data gathered
in Benton County, and
WHEREAS, the only time the greater Pasco area experiences poor air quality
or exceeds the PM 10 Standard is due to an occasional wind storm which carries dust
from agricultural fields in the Horse Heaven Hills, and
WHEREAS, potential additional regulation of human activities, and industrial
operations in particular, presents the specter of unnecessary burdens for present and
future businesses and will frustrate appropriate industrial recruitment efforts of the
community, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES
RESOLVE AS FOLLOWS:
Section 1. The BFCAA should place an appropriate monitoring system in the
greater Pasco area so as to gather actual data for the greater Pasco area rather than
rely on extrapolation of data gathered in Benton County
Section 2. The BFCAA should avoid establishing new or enforcing current
regulations which rely on current air quality data
Section 3. The BFCAA should use all resources possible to demonstrate that
windblown dust from agricultural areas should be exempt from the PM 10 Standard
promulgated by the EPA
Section 4. Should the BFCAA fail to fulfill the foregoing objectives, the Board
of Commissioners of Franklin County should withdraw Franklin County and its
municipalities from participation in the BFCAA and establish a separate Franklin
County Clean Air Authority
