RESOLUTION NO. 2110
A RESOLUTION declaring the intention of the Pasco City Council to
jointly regulate the rates for basic service, equipment and installation charged
by TCI Cablevision of Southeast Washington, with the Cities of Kennewick
and Richland, Washington
WHEREAS, the Cable Act of 1992 allows franchising authorities to
regulate rates for basic service, equipment and installation charges and to do
so jointly with other municipalities, and
WHEREAS, Pasco, Kennewick and Richland Washington each
franchise TCI Cablevision of Southeast Washington within their municipal
boundaries, and
WHEREAS, the Pasco City Council believes that it would be in the best
interests of its citizens to jointly regulate the rates for basic service, equipment
and installation charges with Richland and Kennewick, now, therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON
DOES RESOLVE AS FOLLOWS:
1. The cities of Pasco, Kennewick and Richland Washington should
jointly seek certification of the franchising authority to regulate basic cable
service rates, equipment and installation charges through the filing of FCC
Form 328
2. The Mayor of the City of Richland is authorized to sign FCC Form
328 on behalf of the City of Pasco
3. The Pasco City Council believes that TCI Cablevision of Southeast
Washington is not subject to effective competition based upon the definition
for effective competition set forth in FCC Form 328
4. The Pasco City Council intends to adopt and administer jointly with
the cities of Richland and Kennewick regulations with respect to basic cable
services that are consistent with the regulations adopted by the FCC pursuant
to 47 USC Section 543 (b)
5. Together, the cities of Pasco, Kennewick and Richland Washington
have the personnel to administer such regulations
6. The Pasco City Council has the legal authority to adopt regulations
consistent with those regulations adopted by the FCC pursuant to 47 USC
Section 543 (b)
Passed by the City Council of the City of Pasco, at a regular meeting
this 7th day of February, 1994
