A RESOLUTION permanently designating a portion of Court Street as
a no cruising area
WHEREAS, on May 17, 1993 the City Council passed Ordinance No
2934 creating Chapter 10 44 PMC, and
WHEREAS, Chapter 10 44 PMC prohibits cruising in or around a
posted "no cruising" area,
WHEREAS, Chapter 10 44 further provides that no area shall be
permanently designated or posted as a no cruising area except on the passage
of a Resolution by the Council, and
WHEREAS, the City Council upon recommendation of the Chief of
Police has determined that Court Street between 10th Avenue on the East
end, Road 40 on the West has become from time to time so congested by
traffic as to present a reasonable danger of traffic congestion, obstruction of
streets, sidewalks and parking lots due to cruising that such area should be
permanently posted with signs as a no cruising area, and
WHEREAS, the City Council has further considered the recommen-
dations of the committee established by the City Council pursuant to
Resolution No 2086 to study and make recommendations to the City Council
concerning cruising and the recommendation of that committee to
permanently post Court Street as a no cruising area, now, therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON
DOES RESOLVE AS FOLLOWS:
1. That area of Court Street between 10th Avenue on the East and Road
40 on the West shall be posted with signs on a permanent basis designating
the area a no cruising area and subject to the prohibition of PMC 10 44 080
prohibiting cruising in an area posted "no cruising"
Passed by the City Council of the City of Pasco, at a regular meeting
this 18th day of January, 1994

In May of 1993, the City Council enacted an anti-cruising ordinance due to the problems
perennially generated by this activity on Court Street in Pasco At the same time, the Council
established a Cruising Study Committee composed of a cross-section of the community to study
and make recommendations to the City Council concerning "cruising " More specifically, the
Council expressed a desire for the committee to assess the problems associated with cruising
and to recommend an appropriate alternative location and/or means of providing for the
conduct of "cruising" in the community
V DISCUSSION
The Committee met five times beginning in mid-July and ending in late August The committee
was composed of 13 members representing business owners, Pasco High students, young
adults, parents, residents in the affected area, City Council, & the Police Chief Some
members felt that cruising should be permanently banned, while others felt that it was a "fun"
activity that was harmless except for a few troublemakers Possible alternative locations
were discussed with none proving viable It was agreed upon that "cruisers" want to be on a
main thoroughfare with fast food businesses The problems associated with cruising were
discussed and the consensus was that there was no way to permit the cruising while eliminating
the problems While the meetings were ongoing, there was a homicide of a young man that
occurred on Water Follies weekend involving cruisers on Court Street
A list of over 50 activities that are available to youth in the Tn-Cities was compiled The
committee was of the opinion that, rather than being alternatives to cruising, many of these
activities are things that young people like to do, but they also like to cruise Ideas for
"alternatives to cruising" (that would cause young people to cast aside cruising) proved to be
very elusive to the committee
The committee reached a consensus at the final meeting that a viable alternative to cruising (or
even a viable alternative location) could not be determined and that the problems associated
with the activity were unacceptable and a way to curtail them needed to be found It was
agreed that a total ban on cruising was necessary and It was decided to make that
recommendation to the City Council Further, the recommendation was to permanently
designate Court Street as a "no cruising" area and post it accordingly

A) As part of the discussion leading to enactment of Ordinance No 2934,
which established an anti-et insing ordinance, Council expressed a
desire to establish a committee to assess the problems associated with
cruising and i ecommend an appi opliate alteinative location and/or
means of providing to' the conduct of that activity in the community
The discussion also specifically suggested the committee reflect the
following composition business, goveinment, students, parents,
young adults, and the Police Chief

RESOLUTION NO. 2086
A RESOLUTION establishing a committee to study and make recommendations
to the City Council concerning "cruising".
WHEREAS, traffic conditions and the associated congestion of parking
lots at businesses off Court Street between 14th and 28th Avenues in the City of
Pasco has evolved to the point where the City Council has considered banning
cruising on Court Street, and
WHEREAS, the City Council, on May 17, 1993, adopted an ordinance
allowing the Chief of Police to temporarily designate "no cruising" streets and
for the City Council to permanently ban cruising on certain streets, and
WHEREAS, the City Council recognizes that those participating in
cruising include, by a large majority, many good and responsible youth and young
adults who have an earnest interest in improving the conditions surrounding
cruising and abating associated nuisance problems, i e, traffic congestion,
congregation in parking lots, noise, alcohol, litter, fighting and intimidation
of persons not involved in the cruising, but desiring to shop at local
businesses, and
WHEREAS, the City Council has determined it in the best interests of
the City and its youth and young adult population to mutually discuss the
problems associated with cruising and attempt to reach solutions short of totally
banning cruising on designated streets in the City, Now, Therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES
RESOLVE AS FOLLOWS
§1. The Mayor shall appoint with the concurrence of the Council, a
committee to assess the current problems associated with cruising, identify means
for improving the situation and possible alternative locations and times for
cruising and to generally make recommendations to the City Council for mitigating
the current problems
§2 The committee shall consist of two City Council members, two
business operators from the currently affected area on Court Street, two Pasco
High School students, two young adults, two parent representatives, two
representatives from the residential areas immediately adjacent to Court Street
and affected by the current cruising activities, and the Pasco Police Chief
§3 The committee shall commence meeting as soon as practical and
meet as often and frequently as necessary to resolve the current problems in a
timely fashion

ORDINANCE NO.
AN ORDINANCE relating to traffic and adding a new section to Chapter
10 44 of the Pasco Municipal Code
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES
ORDAIN AS FOLLOWS
There is hereby added a new section, 10 44 080, to Chapter 10 44
of the Pasco municipal Code to read as follows
10 44 080 CRUISING (a) No person may cruise, or permit a
motor vehicle in his care, custody or control to be used for cruising
in or around a posted "No Cruising" area
(b) The Police Chief or his designee shall determine when an area
has become so congested by traffic as to present a danger of traffic
congestion, obstruction of streets, sidewalks or parking lots,
impediment of access to shopping centers or other buildings open to
the public, or interference with the use of property or conduct of
business m the area adjacent thereto or that emergency vehicles
cannot respond in that area within a reasonable penod of time The
Police Chief or his designee shall then direct that the no cruising
signs shall be erected or installed and maintained until the
congestion has lessened to an acceptable degree
(c) At reasonable points along a public street to be designated a
no cruising area there shall be posted signs which say "no cruising"
areas
(d) A traffic control point as used in this section means any point
or points within the no cruising area established by the Police
Department for the purpose of monitoring cruising
(e) No area shall be _permanently. designated or _posted as a no
cruising area except upon the passage of a resolution by the Council
(f) In determining whether a person is cruising, a court may
consider not only the conduct of the dnver and his passengers, but
the traffic conditions at the time and the conduct of other drivers
and passengers as well as pedestrians on or adjacent to the public
way The court shall consider such factors as whether or not the
vehicle has passed a traffic control pointing the same direction
within a two-hour penod, whether or not the vehicle has stopped in
the roadway or slowed to a speed of five miles an hour below the speed
limit for any appreciable time, whether or not the driver or
passengers in the vehicle have conversed with others outside the
vehicle, whether or not the vehicle has entered upon private property
solely for the purpose of turning around to proceed in the opposite
direction, and the intended destination and purpose of the driver and
passengers
(g) This section shall not apply to government vehicles, in service
emergency vehicles, taxicabs for hire, buses and other vehicles being
driver for business purposes
§2. This ordinance shall take effect five (5) days after passage and
publication
