HomeMy WebLinkAbout2077 ResolutionCITY OF PASCO, WASHINGTON RESOLUTION No. a0-11 A RESOLUTION of the City Council of the City of Pasco, Washington; declaring its intention to order the improvement of 18th Avenue from A Street to Lewis Street and Lewis Street from 18th Avenue to a point approximately 300 feet east of 18th Avenue and to create a local improvement district to assess a part of the cost and expense of carrying out those improvements against the properties specially benefited thereby, and notifying all persons who desire to object to the improvements to appear and present their objections at a hearing before the City Council to be held on June 7, 1993. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, as follows: Section 1• It is the intention of the City Council of the City of Pasco, Washington, to order the improvement of the properties described below by the improvement of 18th Avenue from A Street to Lewis Street (including grading, sidewalks, drainage facilities, water, base course, asphalt concrete surfacing, curbs, gutters and sewer stubs and all other work necessary therefor or incidental thereto) and Lewis Street from 18th Ayenue to a point approximately 300 feet east of 18th Avenue (including curbs, gutters and sidewalks and all other work necessary therefor or incidental thereto). All of the foregoing improvements shall be in accordance with the plans and specifications therefor prepared by the City Engineer and may be modified by the City as long as that modification does not affect the purpose of the improvements. 0079856 01 -1- The properties specially benefited by the improvements and proposed to be included in a local improvement district are included within the following described property: Beginning at the intersection of the centerlines of 18th Ave. and West A Street; thence west along the centerline of West A Street to its intersection with the southerly projection of the west lot line of Lot 3, Short Plat 84-4; thence northerly along the southerly projection of the west lot line extended, and continuing northerly along the west line of said Lot, Short Plat 84-4, to the south west corner of Lot 2, Short Plat 84-4; thence northerly along the west line and the west line extended of said Lot 2 to the intersection with the centerline of West Lewis Street; thence southeast long the centerline of West Lewis Street to its intersection with the northerly projection of the east line of Lot 24, Block 4, Helms Addition; thence south along the east line extended and the east line to the southeast corner of Lot 24; thence south along a line to the northeast corner of Lot 9, Block 4, Helms Addition; thence south along the east line and east line extended of said Lot 9 to the centerline of West A Street; thence west along the centerline of West A Street to the Point of Beginning. Section 2. The total estimated cost and expense of the improvements is declared to be$ 49,361.00 and, except for the City's paying for the equivalent of one inch of the asphalt concrete surfacing, the entire cost and expense of the improvements shall be borne by and assessed against the property specially benefited by the improvements to be included in a local improvement to be established embracing as nearly as practicable all the property specially benefited by the improvements. Actual assessments may vary from estimated assessments as long as they do not exceed a figure equal to the increased true and fair value the improvements add to the property. Section 3. The City Clerk is authorized and directed to give notice of the adoption of this resolution and of the date, time and place fixed for the public hearing to each owner or reputed owner of any lot, tract, parcel of land or other property within the proposed local improvement district by mailing such notice at least 15 days before the date fixed for public hearing to the owner or reputed owner of the property as shown on the rolls of the Franklin , County Assessor at the address shown thereon, as required by law. This resolution shall be published in at least two consecutive issues of the official newspaper of the City, the date of the first publication to be at least fifteen days prior to the date fixed for the public hearing. Section 4. All persons who may desire to object to the improvements are notified to appear and present those objections at a hearing before the City Council to be held in the Council Chambers in the City Hall in Pasco, Washington, at 8:00 p.m. on June 7, 1993, which time and place are fixed for hearing all matters relating to the improvements and all objections thereto and for determining the method of payment for the improvements. All persons who may desire to object thereto should appear and present their objections at that hearing. Any person who may desire to file a written protest with the City Council may do so within 30 days after the date of passage of the ordinance ordering the improvements in the event the local improvement district is formed. The written protest should be signed by the property owner and should include the legal description of the property for which the protest is filed and that protest should be delivered to the City Clerk. 0079856 01 -3- Mayor Section 5. The City Engineer is directed to submit to the City Council on or prior to June 7, 1993, all data and information required by law to be submitted. At the May 3, 1993 council meeting, the city council passed a resolution setting a public hearing date of June 7, 1993 for a public hearing to pass an ordinance creating an L.I.D. for 18th Avenue. By law, a copy of that resolution must be published in the Tr-City Herald in two consecutive issues. The first publication being at least 15 days prior to the date of that hearing. It would be my recommendation that you publish that resolution not later than the 22nd and the 23rd of May. In addition to the publication of that resolution, we also need to prepare an ordinance for the creation of the L.I.D. It is my intention to contact George Mack to prepare the ordinance but we will need to resolve handling of interim financing in order to give that information to him. It is imperative we discuss this at your earliest convenience.
