A RESOLUTION declaring the Pasco City Council's support for more
meaningful and expedited enforcement of juvenile probation curfew
restrictions, and requesting that the Judges and Commissioners of the
Juvenile Court, the Juvenile Court Probation staff and the Benton and
Franklin County Prosecuting Attorneys' offices cooperate to the extent
necessary to make such meaningful enforcement possible
WHEREAS, probation orders issued by the Benton-Franklin County
Juvenile Court currently provide for curfew restrictions, but provide for no
mearungful mechanism for local law enforcement agencies to take violating
juveniles into custody and for a prompt hearing on the violation, and
WHEREAS, the City of Pasco as well as the other cities and
unincorporated areas of Benton and Franklin counties are searching for means to
control youth violence and provide greater controls for the small percentage of
youth who are causing the many problems, and
WHEREAS, the City of Pasco has successfully controlled street
prostitution activities by providing for pretrial release and probation orders
not only restricting the areas of access for such access, but providing that the
violation of such order is a "contempt of court" and directing any local law
enforcement officer to take into immediate custody any person violating such
order, and
WHEREAS, the Pasco City Council believes that such an enforcement
mechanism built into the Juvenile Court Orders would aid local law enforcement
officers and agencies in their effort to reduce juvenile crime and youth
violence, Now, Therefore,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES
RESOLVE AS FOLLOWS.
§1. The Pasco City Council declares its support for inclusion of
provisions in Juvenile Court Probation Orders providing for curfew restrictions,
that the violation of such order is a contempt of court and that local law
enforcement officers observing such violations may make the immediate arrest of
the violator and take the violator into custody
§2. That the Juvenile Court provide for a prompt hearing on the charge
of any such probation violation, ideally on the next court date, but in any event
within 72-hours of the violation
§3 That the Juvenile Court Judges and Commissioners, the Juvenile
Probation staff, and the prosecutors in the Benton and Franklin County
Prosecuting Attorneys' offices use their best efforts to accomplish the above
