A RESOLUTION OF THE PASCO CITY COUNCIL, DECLARING ITS INTENTION TO ORDER THE IMPROVEMENT OF CERTAIN STREETS: THE IMPROVEMENT OF WHICH IS TO BE PAID IN FULL OR IN PART BY THE LEVY AND COLLECTION OF ASSESSMENTS UPON THE PROPERTY WITHIN THE PROPOSED IMPROVEMENT DISTRICT DESCRIBED HEREIN: AND NOTIFYING ALL PROPERTY OWNERS WHO MAY DESIRE TO OBJECT THERETO TO APPEAR AND PRESENT THEIR OBJECTIONS AT A PUBLIC MEETING OF THE CITY COUNCIL TO BE HELD APRIL 19, 1993. WHEREAS, the Pasco City Council after having considered the formation of a local improvement district for the improvement of Rd. 24 from Lewis Street to Hopkins Street, Frontage Road from Hopkins Street to 20th Avenue, and Lewis Street from a point 500 feet west of the intersection of Road 24 to a point 500 feet east of Road 24, all in the City of Pasco, and having duly deliberated the passage of a resolution stating the intent of the City Council to proceed with the formation of the local improvement district and concluding that the passage of such resolution is in the public interest; NOW, THEREFORE, BE IT RESOLVED BY THE PASCO CITY COUNCIL AS FOLLOWS: 1) It is the intention of the Pasco City Council to order the improvement of Rd. 24 from Lewis Street to Hopkins Street , Frontage Road from Hopkins Street to 20th Avenue, and Lewis Street from a point 500 feet west of the intersection of Road 24 to a point 500 feet east of Road 24. It is proposed that the streets be improved in accordance with standards established by the City of Pasco. The improvement to Frontage Road and to Road 24 shall include grading, base course, asphalt concrete surfacing, curbs, gutters, sidewalks, illumination, landscaping, water and sewer lines, drainage facilities and all other work necessary in connection therewith and incidental thereto. The work on Lewis Street shall include curb, gutter and drainage modifications, landscaping, and sidewalks. All work shall be in accordance with the plans and specifications prepared by the City of Pasco, Department of Public Works, and approved by the City Engineer. 2) The cost of such improvements shall be borne by and assessed against the properties specifically benefited by such improvement and included in the local improvement district to be established, embracing as near as may be, all of the property specifically benefited by such improvement. Actual assessments may vary from assessment estimates so long as they do not exceed a figure equal to the increased true and fair value the improvement or street lighting adds to the property. Notice of Public Hearing Page 2. 3) It is the intention of the City Council of the City of Pasco, Washington, to create a local improvement district to include for the purpose of assessment, the properties described as follows: Beginning at the southeast corner of Section 25, Township 9 North, Range 29 East, W.M. thence N 01 degrees 39' 07" E along the east line of said section 25, a distance of 407.00 feet; thence N 89 degrees, 38' 20" W a distance of 40.01 feet to the west boundary of 20th Avenue and the true point of beginning; thence N 89 degrees 38' 20" W a distance 250.00 feet to the SE corner of Lot 3 of short plat 75-2; thence N 89 degrees 38' 20" W a distance of 116 feet to the SE corner of Lot 5, Block 3 Eagle Estates No. 2; thence continuing N 89 degrees 38' 20" W a distance of 130 feet to the centerline of Road 22; thence N 01 degrees 39' 07" E along the centerline of Road 22 a distance of 56.11 feet; thence N 89 degrees 38' 20" W a distance of 30 feet to the SE corner of Lot 21, Block 2, Eagle Estates No. 2; thence continuing N 89 degrees 38' 20" W along the southerly lot lines of Lots 21 and 6, Block 2, Eagle Estates No. 2 a distance of 267.2 feet to the centerline of Road 23; thence S 01 degrees, 39' 07" W along the centerline of Road 23 a distance of .7 feet; thence N 89 degrees 38' 20" W a distance of 30 feet to the SE corner of Lot 7, Block 1 Eagle Estates No. 2; thence continuing N 89 degrees 38' 20" W a distance of 118.34 feet to the SW corner of Lot 7, Block 1 Eagle Estates No. 2; thence N 01 degrees 41' 10" E a distance of 304.50 feet to the northeast corner of short plat 87-03; thence N 89 degrees 46' 20" W a distance of 328.20 feet to a point; thence N 64 degrees 14' 00" W a distance of 168.00 feet to a point on the easterly line of Eagle Estates; thence N 01 degrees 41' 10" E a distance of 440 feet more or less to the center line of Hopkins St.; thence N 89 degrees 46' 20" W along the centerline of Hopkins St. to the southerly projection of the westerly line of the W. 1/2 of the SE 1/4 of the NW 1/4 of the SE 1/4 ; thence N 01 degrees 28' 13" E along said westerly line of the west 1/2 of the SE 1/4 of the NW 1/4 of the SE 1/4 to the centerline of R/W of way of Lewis St; thence south 66 degrees 55' 22" E along the R/W centerline of Lewis Street to its intersection with the northerly projection of the westerly R/W line of 20th Avenue ; thence south along the west R/W line of 20th Avenue to the true point of beginning. 4) All persons who may desire to object to the improvements herein mentioned are hereby notified to appear and present such objections at a meeting of the City Council, to be held in the Council Chambers of the City Hall, Pasco, Washington, at 8:00 p.m., April 19, 1993, which time and place are hereby fixed for hearing matters relating to said improvements and all objections thereto and for determining the method of payment for said improvements. eFelice, Mayor APP ubstello, City Attorney Notice of Public Hearing Page 3. 5) The City Engineer is hereby directed to submit to the City Council on or prior to April 19, 1993, the preliminary estimates, assessment roll, and other information required by RCW 35.43.130. 6) The City Clerk shall cause this resolution to be published in at least two consecutive issues of the Tr-City Herald, the first publication to be at least fifteen (15) days before the day fixed for the public hearing. 7) A copy of this Notice/Resolution together with the estimated cost of the proposed improvement shall be mailed by the City Engineer to the owners or reputed owners of all lots, tracts, and parcels of property to be specifically benefited by the improvements, as shown on the rolls of the County Assessor by March 29, 1993.
