RESOLUTION NO.17()C 3
A RESOLUTION accepting a ten percent annexation petition and
providing a determination on the territory to be
annexed and whether simultaneous zoning and the
assumption of bonded indebtedness will be required.
WHEREAS, owners of property, located south of Court
Street and west of the city limits, as indicated in Exhibit "A"
attached hereto, have initiated action to annex to the City of
Pasco; and,
WHEREAS, the City Council of the City of Pasco has
reviewed the annexation petition and has determined annexation of
the territory would further orderly growth of the city and is in
the best interest of the community; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, DO RESOLVE AS
FOLLOWS
A) That the city will accept the proposed territory to be
annexed as described and depicted on Exhibit "A" attached hereto.
B) That the territory to be annexed will not require
simultaneous adoption of zoning regulations. Zoning will be
determined through a public hearing process with input from
affected property owners
C) That the annexation area will not be required to
assume any portion of existing city bonded indebtedness
D) That the installation of curb, gutter and sidewalk
will not be required in the annexation area as a condition of
annexation
PASSED by the City Council of the City of Pasco this 7th
day of September, 1993.
EXHIBIT "A"
PROPOSED ANNEXATION AREA
That part of Township 9 North Range 29 East Willamette
Meridian described as follows
Beginning at a point on the south right-of-way West Court Street
said point being the northwest corner of Lot 4, Block 1 Arbee's
Addition located in Section 26, Township 9, Range 29 E W.M.;
Thence easterly along the south R/W line of Court Street to its
intersection with the east R/W line of Road 40; Thence south
along said R/W line a distance of 302 feet, more or less; Thence
easterly on a line parallel to the north line of Section 26, T. 9
N.,R 29E,WM adistance of 1000 feet, Thence southerly on a
line parallel to the east line of said section a distance of 330
feet, more or less, to the north line of Sparta's First Addition
and a point 295 feet west of the east line of said section;
Thence east along said north line of Sparta's First Addition 255
feet, more or less, to the westerly R/W line of Road 36; Thence
south along said R/W line to the south line of Lot 6 Matheson's
First Addition, Thence east along the south line projected 10
feet more or less to the west R/W line of Road 36; Thence south
along the said west R/W line of Rd 36 to its intersection with
the south R/W line of Henry Street, Thence west along said south
R/W line of Henry Street to its intersection with the east R/W
line of Road 37, Thence southerly along said east R/W line of
Road 37, to the intersection of the easterly projection of the
southerly lot line of Lot 18, Block 8 of the Corrected plat of
Riverview Terrace; Thence west along said southerly projection to
the south east corner of Lot 18, Block 8 of the Corrected plat
of Riverview Terrace; Thence west along the south lines of lots
18, 17, 16, 15, 14, 13, 12, 11, and 10 to the east R/W line of
Road 40, Thence west along the extended south lot line of said
Lot 10, to the west R/W line of Road 40, Thence north along the
west R/W line of Road 40 to its intersection with the south line
of Henry Street; Thence west along the south R/W line of Henry
Street to its intersection with the east line of the northwest
quarter of the southwest quarter of the northeast quarter of said
Section 26, Thence north along the east line of the northwest
quarter of the southwest quarter of the northeast quarter and the
east line of the southwest quarter of the northwest quarter of
the northeast quarter and the east line of the northwest quarter
of the northwest quarter of the northeast quarter of said Section
26 to the intersection with the easterly projection of the south
line of of the plat of Arbee's Addition, Thence west along the
said projection of the south line of Arbee's Addition to the
southeast corner thereof, Thence continuing west along the south
line said Arbee's Addition to the southwest corner thereof;
Thence north along the west line of said Arbee's Addition to the
northwest corner thereof, said point being the northwest corner

IV HISTORY AND FACTS BRIEF
A West Pasco residents from the area shown and described in
the attachments, have submitted a petition to initiate
annexation to the city
B Upon receipt of a ten percent annexation petition, the
city is required, by law to set a date for a meeting to
determine -
1) Whether the city will accept the proposed annexation,
2) Whether the city will require simultaneous adoption of
zoning, and,
3) Whether the city will require the property to assume
all or a portion of existing city indebtedness
C. Upon acceptance of the initial ten percent petition, and
action on the three issues in Item B above, the
petitioners would be authorized to circulate a sixty
percent petition to be returned to the city for
appropriate action to annex the property.
V DISCUSSION
The 60% petition that is authorized to be circulated upon
acceptance of the 10% petition is to include language
related to zoning requirements and indebtedness. It has
been the past practice of the city to not require
simultaneous zoning or the assumption of existing
indebtedness on annexations. The proposed resolution
attached hereto contains language consistent with past
practice
The initiating petition (10% petition) asked the Council to
consider (in addition to items in B above) whether or not
the city would require the installation of curb, gutter and
sidewalk While this is not a question the Council is
statutorily required to consider, it is one the
petitioners were interested in

The city has not made a practice of requiring curb, gutter
and sidewalk in newly annexed areas However, out of
concern for pedestrian safety, there may be situations
where I,the city may want to order sidewalks to be
constructed This could very well happen on Court Street,
Road 36 and perhaps Road 40. To preserve the option of
addressing future pedestrian safety concerns, the attached
resolution only addresses the three statutory questions.

NOTICE OF INTENTION TO COMMENCE ANNEXATION PROCEDURES
TO. The City Council of the City of Pasco
412 West Clark Street
Pasco, Washington 99301.
Councilmembers:
The undersigned, who are the owners of not less than ten percent
in value, according to the assessed valuation for general
taxation of the property for which annexation is sought, hereby
advised the City Council of the City of Pasco that it is the
desire of the undersigned owners of the following area to
commence annexation proceedings:
The property herein referred to is descrined on Exnibit "A"
attached hereto and is depicted on Exhibit "B" further attached
hereto.
It is requested that the City Council of the City of Pasco set a
date not later than sixty days after the filing of this request
for a meeting with the undersigned to determine:
(1) Whether the City Council will accept the proposed
annexation;
(2) Whether the City Council will require the adoption of zoning
for the proposed area; and
(3) Whether the City Council will require the assumption of
existing city indebtedness by the area to be annexed;
(4) Whether the City Council will require the installation of
curb gutter and sidewalk;
It is the desire and petition of the undersigned property owners
that the city follow past practices and not require the
assumption of existing indebtedness and additionally, that there
be no city mandated installation of curn gutter, sidewalk or
local access street improvements.
