A RESOLUTION of the Pasco City Council requesting the Board Franklin
County Commissioners take immediate steps to comply with its
obligations under the Interlocal Agreement for the adoption of a
county-wide planning policy and to enable compliance by both Franklin
County and the City of Pasco with the requirements of RCW 36.70A.210
for county-wide planning policies.
WHEREAS, Franklin County, the Port of Pasco, the City of Mesa, the City
of Connell, the Town of Kahlotus, and the City of Pasco, all entered into an
mterlocal agreement titled FRAMEWORK AGREEMENT FOR THE ADOPTION OFTHE
COUNTY-WIDE PLANNING POLICY dated January, 1992, for the purpose of a
coordinated development of a county-wide planning policy required by RCW
36 70A 210, and
WHEREAS, RCW 36 70A 210 requires that no later than July 1, 1992, the
legislative authority of the county shall adopt a county-wide planning policy
according to the process provided by said agi eement, and after holding a public
hearing or hearings on the proposed county-wide planning policy, and
WHEREAS, under said agreement Franklin County has the responsibility
to, "prepare the agendas and notices of committee meetings", and
WHEREAS, the County has failed to call or provide notice or agenda for a
committee meeting since December 17, 1991, and
WHEREAS, the county-wide planning policy is required to address the
implementation of a county comprehensive plan and designation of urban growth
areas within the county, but Franklin County has failed to take steps towards the
designation of such boundaries with the City of Pasco and the other parties to
the county-wide planning policy interlocal agreement, despite the requirements of
the act and the City of Pasco's submittal to Franklin County on December 30,
1991, of a proposed urban growth boundary for the City of Pasco, and
WHEREAS, this lack of due diligence by the Board of Franklin County
Commissioners in pursuing the adoption of county-wide planning policies through
the coordinated effort set forth in the interlocal agreement not only
substantially jeopardizes the ability of Franklin County and the cities therein
to meet the July 1, 1992, deadline set forth in RCW 36 70A 210(2)(e), but opens
the opportunity for the imposition of sanctions on the county or the cities
within the county, as specified in RCW 36 70A 340, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES
RESOLVE AS FOLLOWS.
§1. That the Board of Franklin County Commissioners immediately call for

the meeting of the County-Wide Plannmg Policy Committee composed of the
junsdictions set forth in the Interlocal Agreement for the Adoption of the
County-Wide Planning Policy and take all reasonable and diligent actions to meet
the July 1, 1992, deadline set forth in RCW 36 70A 210(2)(e)
§2. That Franklin County meet and consult with the City of Pasco to
designate the urban growth area in which the City of Pasco is located so that the
county-wide plarming policies related to the adoption of urban growth boundaries
can be addressed in the required county-wide planning policy
§3. Time is of the essence. The City of Pasco, its designees to the
county-wide planning committee and its staff shall make their attendance at all
meetings and the preparation of documents necessary thereto a pnonty so that
the City of Pasco may continue to exercise its good faith efforts to meet the
requirements of RCW 36 70A 210, to which the City of Pasco is obliged by the
decision of the Board of Franklin County Commissioners to choose to adopt a
comprehensive land use plan under RCW 36 70A 040

A RESOLUTION OF FRANKLIN COUNTY , ADOPTING THE INTERIOCAL
AGREEMENT ESTABLISHING THE PROCESS FOR THE DEVELOPMENT OF THE
COUNTY-WIDE PLANNING POLICY TO COMPLY WITH REENGROSSED SUBSTITUTE
HOUSE BILL 1025.
WHEREAS, growth planning in Franklin County requires the
concerted and coordinated efforts of all government entities; and
WHEREAS, Reengrossed Substitute House Bill 1025 requires
Franklin County to adopt a County-wide Planning Policy in
cooperation with the cities and towns; and
WHEREAS, the County convened a meeting of representatives from
all the Durisdictions within Franklin County for the purpose of
establishing a collaborative process that will provide the
framework for the adoption of a County-wide Planning Policy;
NOW, THEREFORE,
BE IT RESOLVED BY THE Board of County Commissioners of
Franklin County:
Section 1. The collaborative process that provides a
framework for the adoption of a County-wide Planning Policy, as set
forth in that INTERLOCAL AGREEMENT - FRAMEWORK AGREEMENT FOR THE
ADOPTION OF THE COUNTY-WIDE PLANNING POLICY and by this reference
incorporated herein, is approved.
Section 2. The proper officers of Franklin County are hereby
authorized and directed to execute that Interlocal Agreement -
Framework Agreement for the Adoption of the County-wide Planning
Policy.
INTERLoCAL AGREEMENT
FRAMEWORK AGREEMENT FOR THE ADOPTION OF THE
COUNTY-WIDE PLANNING POLICY
This agreement is made and entered into between Franklin County, herein after referred
to as the "County", and Port of Pasco herein after referred as the "Port" and the City
of Mesa, the City of Connell, the Town of Kahlotus, and the city of Pasco, all
hereafter referred to as the Municipalities
The purpose of this agreement is to establish a cooperative framework for the
development of county-wide planning policies as required by Reengrossed substitute
Fouse Bill 1025
WhEREAS, the Washington State Legislature has provided for interlocal agreements as
established in Chapter 39 34 R C W , and,

WHEREAS, the county, Port and the Municipalities are planning under the Growth
Management Act, and,
WHEREAS, the County, the Port and the Municipalities believe the coordinated
development of a county-wide planning policy is necessary to ensure consistency among
the various plans and regulations needed for compliance with the Growth Management Act,
NOW, TFEREFORE, in consideration of the mutual benefits to be derived from this
agreement, the County, the Port, and the Municipalities agree as follows
1) CREATION OF A COUNTY-WIDE PLANNING POLICY COMMITTEE A County-wide Planning
Policy committee (The Franklin County Growth Management Coordinating Committee)
is to direct and review the drafting of a county-wide planning policy and make
recommendations to the parties of this agreement for the establishment of policy
guidelines The committee shall consist of twelve members, with each party to
this agreement appointing two representatives by whatever means the party
desires At least one representative from each party to this agreement shall be
an elected official The term of each committee member shall be determined by
the party for which he or she serves as a representative A quorum of the
committee shall consist of seven members with at least five of the six
jurisdictions present
The Franklin County Growth Management Coordinating Committee may invite other
agencies to participate in and cooperate in the County-wide Planning Policy
process These agencies will be designated as associate members and will not
have voting privileges Associate members may include representatives from the
Fire Districts, school Districts, Port Districts (other than the Port of Pasco),
Soil Conservation District, Public Utility District, The Big Bend Electrical
Cooperative, Washington State Department of Natural Resources, Washington State
Department of Transportation, and other similar agencies that can add to the
development of County-wide Planning Policies under the direction of the Franklin
County Growth Management Coordinating Committee Overall coordination of
Franklin County Growth Management Coordinating Committee work shall be the
responsibility of the Franklin County Planning Department Subcommittees may be
established to work on specific policies, and may utilize outside groups,
consultants, and sources as the commttee deems necessary and appropriate Costs

associated with coordination and any public hearings for the adoption of the
County-wide Planning Policy shall be the responsibility of the County. The
County will prepare the agendas and notices of committee meetings. In order to
facilitate policy review, the technical group as created in Section 3 may prepare
issue papers for policies to be included in a County-wide Planning Policy.
Documents prepared as a part of this agreement will be provided to each
jurisdiction by the County and additional copies will be the responsibility of
each jurisdiction
2) DURATION This agreement shall become effective upon execution of all the
units of government and party to this agreement This agreement shall
remain in force and effect until the completion of comprehensive plans and
development regulations by the parties under the Growth Management Act.
3) POLICY COMMITTEE SUPPORT The parties to this agreement hereby designate the
established planning staffs within the County as a technical group that will
support the efforts of the Franklin County Growth Management Coordinating
Committee in completion of its charge The technical group will work under the
direction of the Franklin County Growth Management coordinating Committee
4) TIME FRAME The tentative time frame for the development of the County-wide
Planning Policy, as required by RESEB 1025, is shown by Attachment 1 of this
agreement The time frames are subject to revisions as tasks are accomplished
and/or undertaken
5) ELEMENTS OF THE POLICY The County-wide Planning Policy will Include, as a
minimum, policies addressing the following
A Policies to implement RCW 36 70A 110 (Urban Growth Areas). 10 and 20 year
population forecasts and distribution,
_— B. _ Policies for promotion of contiguous and orderly development and the
provision of urban services to such development;
C. Policies for siting public capital facilities of a county-wide or state-
wide nature,
D Policies for county-wide transportation facilities and strategies;
E Policies that consider the need for affordable housing, such as housing
for all economic segments of the population and parameters for its
distribution;
F Policies for joint county and city/town planning within urban growth
areas;
G Policies for county-wide economic development and employment,
H An analysis of the fiscal impacts;

Other policies as identified by the Franklin County Growth Management
Coordinating Committee
6) RATIFICATION Ratification of the County-wide Planning Policy Document will
require the affirmative response of all general purpose governments that are
parties to this agreement Demonstration of ratification will be by execution
of an interlocal agreement
7) MEDIATION If ratification of the County-wide Planning Policy can not be
achieved between any two parties, then the following procedure shall be followed
One official of each government disputing the planning policy, shall meet and
elect a third person who is a professional mediator This committee shall then
recommend a mediated resolution to each of the governmental units Expenses
Incurred through the mediation process shall be paid for by the entities in
dispute
8) AMENDMENTS Amendments to this agreement may be proposed by the County, the Port
or the Municipalities and shall be adopted by affirmative resolution by all the
parties to this agreement Any amendment to this agreement shall remain in force
and effect until the completion of comprehensive plans and development
regulations by the parties under the Growth Management Act
SEVERABILITY If any of the provisions of this agreement are held illegal,
invalid, or unenforceable, the remaining provisions shall remain in full force
and effect
10) FILING A copy of this agreement shall be filed with the Secretary of State,
County Auditor, and the,City/Town Clerk.
11) EFFECTIVE DATE AND DURATION OF AGREEMENT This agreement shall be effective
immediately upon the signing of all parties and shall remain in effect until the
completion of the Growth Management Act.
IN WITNESS WhEREOF, this agreement hasbeen executed by each member jurisdiction as
evidenced by signature pages affixed to this agreement
