HomeMy WebLinkAbout2005 ResolutionRESOLUTION NO. a005 A RESOLUTION declaring the Pasco City Council's intent to maintain the City's policy regarding outside sewer connectwns to be tied to outside utility agreements that assure and effectuate the annexation or future annexatwn of the property involved. WHEREAS, m 1979 the Pasco City Council adopted Ordinance No 2065 which requires that the provision of water and/or sewer service to real property outside the City limits be conditioned upon the execution of such documents as deemed necessary by the City Manager or his designee to assure and effectuate the annexation or future annexation of the property involved, and WHEREAS, penodically since that time the Franklin County Board of Commissioners have initiated discussion with the City to extend City sewer service to unincorporated West Pasco (Riverview) without annexation or the signing of documents to assure future annexation of the property served, however the City has consistently maintained the position set forth m Ordinance No 2065, and WHEREAS, current proposals by the County Commissioners m negotiations with the City of Pasco officials for the provision of sewer service to West Pasco are based upon sewer service without the assurances of annexation or future annexation required by Ordinance No 2065 and the laws of the State of Washington, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES RESOLVE AS FOLLOWS: §1. The Pasco City Council publicly declares its continuing support and commitment to the policy set forth in §1 of Ordinance No 2065 of the City of Pasco which provides in pertinent part that The owner for any property for which an application or request for initial connection to the water system (as provided in ch 13 36) or the provision of water and/or sewer service through the connection or reconnection or the extension of the city water or sewer system to serve property located in whole or in part outside the existing corporate limits of the city shall be required to execute such documents as deemed necessary by the City Manager or his designee to assure and effectuate the annexation or future annexation of the property involved §2.
