RESOLUTION NO. 1995
A RESOLUTION accepting work by Emory and Emory, Inc. under
contract for Project No.90-2-07
WHEREAS, the work performed by Emory and Emory, Inc. under
contract for Project No.90-2-07 has been examined by the City
Engineer and the City Engineer has found that all work required
by the contract has been performed in apparent compliance with
the applicable project specifications and drawings, and
WHEREAS, it is the City Engineer's recommendation that the
City of Pasco formally accept the contractor's work and the
project as complete, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO:
That the City Council concurs with the City Engineer's
recommendation and thereby accepts the work performed by Emory
and Emory, Inc. under contract for Project No. 90-2-07 as being
completed in apparent compliance with the project specifications
and drawings, and
Be it further resolved that the City Clerk is hereby
directed to notify the Washington State Department of Revenue
of this acceptance, and
Be it further resolved that the final payment of retainage
being withheld pursuant to applicable laws, regulations and
administrative determination shall be released upon satisfaction
of same and verification thereof by the City Engineer and
Director of Finance.

SUBJECT: Engineers Report Accepting Reservoir Landscaping
Project No. # 90-2-07
Council authorized the call for bids on October 1, 1990.
Bids were opened on October 17, 1990 and were rejected because
they were 25% over the Engineer's Estimate.
The project was re-advertised in February of 1991.
Council awarded the contract on April 15, 1991.
Award was made to Emory and Emory Inc. in the amount of $97,745.56.
Notice to proceed was issued on April 30, 1991.
The first working day charged to the project was May 6, 1991 and
work was substantially complete on August 22, 1991. Original
contract time expired on July 2, 1991 and there were four change
orders which extended time eleven working days to July 18,1991.
The contractor submitted an additional claim for 49 working days
claiming time for delays in relocation of existing City
facilities, delays relating to interference from other
contractors working in the area, and for extra work requested but
not contained in the original contract. The City and Contractor
could not agree on the exact extent of the delays or time
required for extra work and negotiated a time extension of 16.5
days extending contract time to noon on August 12, 1991. This
left the contractor 10.5 days over contract time for which
liquidated damages will be assessed.
There were five change orders issued for this project increasing
the contract amount by $ 2,954.27.
The final contract cost was $ 100,193.58 less liquidated damages
of $2,625.00 for a total of $97,568.58.
The project was completed substantially in conformance with the
project specifications and I recommend the project be accepted.
