HomeMy WebLinkAbout1975 ResolutionAPPROVED AS TO FOR ATTEST 6 A RUB STELLO CATHERINE D SEAMAN RESOLUTION NO. 1 975 ' A RESOLUTION permitting the Bradshaw pnvate sewer and the connection thereto by property owners of the properties over which the pnvate lme passes WHEREAS, m 1989 the City Council agreed to permit a private pressure sewer on Court Street from Road 38 extending to Dr Bradshaw's property west of Road 44 on the condition that Dr Bradshaw's property and certain other properties in the immediate area be first annexed to the City, and WHEREAS, such annexation has taken place, however, the installation of the private sewer on Court Street as originally planned has been found to be unfeasible and economically prohibited, and WHEREAS, an alternative location for the proposed pnvate pressure sewer line to service the Bradshaw property by locating one block north of Court Street on the alignment of Ruby Street is both practical and economically feasible, but requires passing the proposed private line over the property of other property owners also without sewer service It appears reasonable under the circumstances to permit all property owners permitting said private pressure sewer line to pass over their line to connect to the private line provided the conditions set forth m the attached permit/agreement are required, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO RESOLVE AS FOLLOWS: §1. A private pressure sewer line connecting to the City main as shown on the attached diagram is hereby permitted §2. Owners of the Bradshaw property and all owners of real property over which the pnvate pressure sewer line passes shall be permitted to connect to the private line upon the condition that they agree to the terms and conditions of the attached permit/agreement and sign the same prior to connection PASSED by the City Council and APPROVED by the Mayor this ak day of October, 1991 Deputy City Clerk City ttorney SEWER CONNECTION AGREEMENT/PERMIT The City of Pasco grants to the undersigned Property Owner(s) permission to connect to the public sewer main owned and mamtamed by the City of Pasco via a private sewer lme upon the following conditions 1 The undersigned Property Owner(s) understand and agree that the private sewer lme running between their residential property and the City Main is not the responsibility of the City The City is not responsible for the maintenance of said private line or to provide an alternative means of sewer service m the event that the private line becomes damaged or fails to function 2 At such time as a public sewer is availble to directly serve the below-described real property, the undersigned Property Owner(s) understand and agree that the permission granted by this permit shall be revoked and that they will connect directly to the public sewer line and pay for all fair-share costs of the construction of said public sewer line 3 The undersigned Property Owner(s) agree that m the event a local improvement district or utility local improvement distnct is proposed for the construction of a public sewer lme to service the below-descnbed property, that the Property Owner(s) shall not protest or otherwise oppose the creation of said local improvement distnct or utility local improvement district 4 The Property Owner(s) shall pay the normal system fee charges for connection to the City Sewer System pnor to the connection to the public sewer via the private sewerline and applicable monthly use charges thereafter 5 The above-stated covenants and agreements shall run with the land (described below) and shall continue to be the obligation of subsequent property owners A description of real property DATED this day of , 1991 ACCEPTED BY State of Washington ) SS County of Franklin ) On this day of 1991, before me, the undersigned Notary Public in and for said County and State, personally appeared known to me to be the person(s) whose name is/are subscnbed to the foregoing instrument, who acknowledged to me that he/she/they signed same as his/her/their free and voluntary act and deed, for the uses and purposes therein mentioned WITNESS MY SEAL Notary Public for Washington Residing at My Commission Expires
