HomeMy WebLinkAbout1869 ResolutionEl HENDLER, Mayor APPROVED AS TO FORM: 1111.114.0.n n./ N WELLS, City Clerk GREG RUBSTELLO, City Attorney RESOLUTION NO. 1869 A RESOLUTION declaring the City's intent to supply municipal water to the Clark Addition. WHEREAS, the Washington State Department of Social and Health Services has found that well water in the Clark Addition is contaminated with pollutants, specifically nitrates, which constitute a health hazard; and WHEREAS, the City has secured funding for improvements to the City's high water pressure zone, which will make it feasible for the City to supply water to the boundary of the Clark Addition; and WHEREAS, individuals representing the Clark Town Water Association and the Beneficial Water Association have expressed an interest in purchasing water from the City of Pasco to solve their contaminated well supply problem; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. That the City of Pasco hereby declares its intent to supply and sell to such associations or districts which exist or may be formed to serve individual customers or properties within the Clark Addition (potable water for domestic and fire protection purposes), conditioned as follows: A) This intent shall not binding upon the City until the execution of a formal agreement between the City and the entity purchasing water from the City; B) Neither this intent nor the formal agreement to supply municipal water be conditioned on annexation of the Clark Addition to the City of Pasco. Section 2. The City Manager is hereby authorized to take those steps and actions necessary to create a proposed agreement for Council consideration and including any actions as may be necessary to obtain required approvals from the Benton-Franklin Governmental Conference and the Franklin County Boundary Review Board. PASSED by the City Council and APPROVED by the Mayor this day of March, 1989.
