Heaton. WHEREAS, upon the authorization of the City Council bids were called for on the old Fire Station No. 2 Property with a minimum bid price fixed at $50,000; and WHEREAS, one bid was received by the City of Pasco in the amount of $50,075 from W. E. Heaton and that bid being responsive to the call for bids and acceptable to the City Council, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON DO RESOLVE AS FOLLOWS: 1. The bid of W. E. Heaton for the old Fire Station No. 2 Property in the amount of $50,075, including the attached conditions allowing W. E. Heaton to obtain a permit to relocate the existing driveway to the east off Court Street and reducing the time stated in the bid documents for possession of the property to seven (7) days after award, is hereby accepted. 2. The City Attorney is instructed to prepare a quitclaim deed for conveyance of title to W. E. Heaton and the Mayor is authorized to sign the same for delivery to W. E. Heaton upon his tender of the balance of the purchase price. APPROVED by the City Council and SIGNED by the Mayor this 6th day of April, 1987. lf. We only received one (1) bid in the amount of $50,075.00. The bidder was Mr. William Heaton, who currently operates Star Cleaners on Court Street. His bid has some "conditions of purchase" attached to it. For example: 1. Ability to obtain a permit to relocate the existing driveway to the east off Court Street. 2. Reduce the time stated in bid documents for him to take possession of the property to 7-days after award. Mr. Heaton will contact you early next week for a response to the conditions of purchase. He wants to get started making repairs and alterations to the building. His plans are to move part of his dry cleaning business to this location. WJ:ew Attach: Copy of Bid Documents and Conditions of Purchase INSTRUCTIONS TO BIDDERS FIRE STATION NO. 2 PROPERTY The following described real property and improvements thereon which are surplus to the needs of the City of Pasco, is offered for sale. Said real property is described as follows: That certain real property and improvements thereon in Pasco, Franklin County, Washington described as: That portion of the southeast quarter of the southwest quarter of the southwest quarter of Section 24, Township 9 North, Range 29 East, W.M. described as follows: Beginning at the southeast corner of said subdivision; thence along the south line thereof 89 degrees 58'21" west 303.46 feet; thence parallel the east line thereof north 02 degrees 01°28" east 40 feet to the north line of court street and the TRUE POINT OF BEGINNING; thence north 02 degrees 01'28" east 125 feet; thence north 89 degrees 58'21" west 55 feet; thence south 02 degrees 01'28" west 125 feet; thence south 89 degrees 58'21" east 55 feet to the TRUE POINT OF BEGINNING. SUBJECT TO: General taxes after delivery of deed. ALSO SUBJECT TO: Building and zoning ordinances, easements, restrictions, covenants of records, if any. The City of Pasco will convey by quitclaim deed. Costs of closing, including recording, title search and title insurance (if any), 1% real estate excise tax fee (if any) shall be paid by purchaser. MINIMUM BID PRICE: $50,000.00 A certified check or cashier's check payable to CITY OF PASCO for ten percent (10%) of the amount of the bid must accompany each bid which will be returned if the bid is not accepted within thirty (30) days of the date and time the bids are opened and read aloud. The bid of the successful bidder shall be held by the City as earnest money and be credited to the purchase price at the time of closing. In the event that the successful bidder for any reason does not complete the purchase at the time of closing designated by the city, the earnest money may, at the discretion of the city, be forfeited as liquidated damages. INSTRUCTIONS TO BIDDERS - PAGE 1 Bids for the above-described property are hereby solicited. Bids must be on the bid form provided by the city, sealed and submitted to the City of Pasco Purchasing Office at Pasco City Hall, 412 West Clark Street, Pasco, Washington 99301, on or before 2 o'clock p.m. on March 11, 1987, at which time bids will be opened and read aloud. The City of Pasco shall have thirty (30) days from the date and time at which the bids are opened and read aloud to accept and award the successful bid. The Fire Station Number 2 property is currently being used by the city to store certain items and equipment and a substitute facility will need to be available for such items and equipment. The City of Pasco reserves up to ninety (90) days from the date the successful bid is awarded and accepted for closing. Closing means the time at which the successful bidder shall tender the remaining balance of the purchase price in cash or by certified check or cashier's check payable to the CITY OF PASCO ard in return the City of Pasco shall tender its quitclaim deed for the property, entitle the purchaser to possession and all other necessary closing documents shall be completed. Any prospective bidder seeking to inspect the premises should contact Webster Jackson, Purchasing Director, Pasco City Hall, 412 West Clark Street, Pasco, (509) 545-3444.
