HomeMy WebLinkAbout1761 ResolutionRESOLUTION NO. 1761 A RESOLUTION of the Pasco City Council relating to hazardous materials incidents response. WHEREAS, Chapter 70.136 RCW provides enabling legislation and limitations on liability to municipalities for their emergency care, assistance or advice in relation to hazardous materials incidents; and WHEREAS, Their exists a clear and dangerous potential of hazardous materials incidents which would endanger the general health, safety and welfare of the community; and WHEREAS, The various fire protection agencies in the Tr-Cities region, including the contiguous areas of Walla Walla, Benton and Franklin Counties, have attempted over the past three years to create a single "regional response team" for hazardous materials incidents and, more recently, have proposed the creation of a virtually autonomous, non-profit corporation for the purpose of providing such a "regional response team"; and WHEREAS, The concept of creating such a separate corporation for hazardous materials incidents presents a host of legal, financial and practical questions without sufficient answers; and WHEREAS, A long-standing and legally sound means of establishing and managing regional emergency services exists in the form of mutual aid agreements; and WHEREAS, The Pasco City Council finds a separate regional corporation concept for hazardous materials response to be unacceptable, and further, finds the growing danger to the public presented by hazardous materials in the community to be cause to proceed with all dispatch to establish an appropriate means of establishing a hazardous materials incidents response capability; NOW, THEREFORE, BE IT RESOLVED BY THE PASCO CITY COUNCIL AS FOLLOWS: Section 1. That the City Manager is hereby directed and authorized to inform the interested fire protection agencies in the Tr-Cities region of the City Council's decision not to participate in the creation of a single corporation for hazardous materials incidents response. 4 ATT ST: EVELYN ELLS, City Clerk ED AS TO F GRE RUB TELLO, City Attorney Section 2. That the City Manager is hereby directed and authorized to attempt to establish a mutual aid arrangement with neighboring jurisdictions which will provide mutually beneficial preparation and response standards applicable to hazardous materials incidents. Section 3. The Pasco Fire Department is designated as the hazardous materials incident command agency for the City of Pasco. PASSED This 3 day of November, 1986 and APPROVED by the Mayor. ELAND F.
