RESOLUTION NIC30 _ 1739
A RESOLUTION of the City of Pasco giving notice to the Benton-
Franklin Health District of the City's intention to
withdraw from that District at the end of calendar
year 1986, and reserving the right to cancel the
notice of intention to withdraw at any time prior to
the effective date of withdrawal
WHEREAS, the City of Pasco is obligated under applicable State
laws to participate in the provision of certain health services to the public
and, since 1942, has elected to fulfill this obligation through active membership
in and financial support of the Benton-Franklin Health District, and
WHEREAS, the District's 1985 budget reflects an array of public
health services significantly exceeding those required by applicable Statute,
and
WHEREAS, the recent declaration by the Franklin County Commissioners
of their intent to withdraw from membership in the Health District, effective
December 31, 1986, reflects the County's growing concern over the amount
of local tax dollars necessary to support the budget of the Health District,
and
WHEREAS, the recent declaration by Franklin County of its intention
to withdraw from the Benton-Franklin Health District places the City
of Pasco in a precarious legal and financial position with respect to its
ability to fulfill its public health obligation, and
WHEREAS, the City of Pasco must work with Franklin County in
seeking the best solution to the apparent problems and, if deemed appropriate,
must withdraw from the Health District in order to participate in creation
of a Franklin County Health Department in lieu of membership in the
Health District, and
WHEREAS, RCW 70 46 090 requires at least six (6) months notice
be given by a Health District member if it intends to withdraw at the
end of a calendar year, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO
Section 1 The City of Pasco hereby gives notice to the Benton-
Franklin Health District of the City's intention to withdraw from the District
at the end of the calendar year 1986
Section 2 This notice of intention to withdraw is based upon the
foregoing observations regarding statutory obligations and budgetary
considerations Recognizing that the City of Pasco and Franklin County
may find prior to the end of calendar year 1986 that continued membership
in the Health District is in the best interest of the citizens of Pasco,
the City of Pasco hereby reserves the right to cancel and withdraw this
notice of intention and, in the event of such cancellation, to continue
to serve as a full member of the District

Section 3 In recognition of the need for adequate opportunity
for preparation of the District's 1987 budget, the City of Pasco intends
to make its final determination as to whether or not it will continue its
membership in the District by October 1, 1986
Section 4 In the event that withdrawal does, in fact, take place
at the end of calendar year 1986, the City of Pasco reserves the right
to rejoin the District at such future date as the Pasco City Council may
determine to be appropriate
Section 5 The City Clerk of the City of Pasco is hereby directed
to forward copies of this resolution, when approved, to the Public Health
Officer of the Benton-Franklin Health District, and to each member of
the Board of Directors of that Health District
Section 6 This resolution shall constitute official notice of the
City of Pasco's intentions pursuant to the provisions of RCW 70 46.090
