RESOLUTION NO. 1656
‘A Resolution establishin g a g rievance procedure and
transit ion plan in compliance with General Revenue Sharin g
; Handicapped Re gulations published in 31 CFR Part 51.
WHEREAS, the Federal Office of Revenue Sharin g has issued
its final rules concernin g prohibition a g ainst discrimination on
the basis of handicaps and those re gulations became effective on
October 17, 1983; and
WHEREAS, said re gulations re quire for their compliance
that the Cit y of Pasco establish a g rievance procedure which
provides appropriate due process standards and provides for a
prompt and e quitable resolution of complaints; and
WHEREAS, compliance with said re gulations further re quire
that the Cit y of Pasco adopt and complete a transition plan for
the elimination of g overnmental pro g rams and facilities which
create barriers to the handicapped; and
WHEREAS, the "pro g ram director" for the Cit y of Pasco of
handicapped compliance pro g rams has completed a proposed
g rievance procedure and transition plan which the Council finds
to be both appropriate and in compliance with said re gulations,
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
RESOLVE AS FOLLOWS:
The g rievance procedure for the resolution of complaints
of the handicapped and the transition plan for the elimination of
barriers to the handicapped in the g overnmental pro g rams and
facilities of the Cit y of Pasco set forth in the attached plan
for compliance with the g eneral revenue sharin g handicap
re g ulations developed b y the Cit y of Pasco "pro g ram director" for
handicapped compliance pro g rams, which plan is incorporated b y
this reference herein as if specificall y set forth, is hereb y
accepted and adopted b y the Pasco Cit y Council.
SECTION 5 0 4
GRIEVANCE PROCEDURE
The City of Pasco has adopted an internal grievance procedure pro-
viding for prompt and equitable resolution of complaints alleging
any action prohibited by the Office of Revenue Sharing's (ORS)
regulations (31 C.F R 51 55 (d)(2) implementing Section 504 of the
Rehabilitation Act of 1973, as amended (29 U S C 794) Section 504
states, in part, that "no otherwise qualified handicapped individual
. shall, solely by reason of his handicap, be excluded from the
participation in, be denied the benefits, of, or be subjected to
discrimination under any program or activity receiving federal
financial assistance n
Complaints should be addressed to Webster U Jackson, Personnel/
Purchasing Supervisor, City of Pasco, P 0 Box 293, Pasco, Wa 99301,
(509) 545-3444, who has been designated to coordinate Section 504
compliance efforts
1 A complaint should be filed in writing or verbally, contain
the name and address of the person filing it, and briefly
describe the alleged violation of the regulations.
2 A complaint should be filed within fifteen (15) business days
after the complainant becomes aware of the alleged violation
(Processing of allegations of discrimination occurring before
this grievance procedure was in place will be considered on a
case-by-case basis )
3 An investigation, as may be appropriate, shall follow a filing
of a complaint The investigation will be conducted by
Webster Jackson These rules contemplate informal but thorough
investigations, affording all interested persons and their
representatives, if any, an opportunity to submit evidence
relevant to a complaint Under 31 C F.R. 51 55 (d)(2), the
City of Pasco need not process complaints from applicants for
employment or from applicants for admission to post-secondary
educational institutions
4 A written determination as to the validity of the complaint and
description of resolution, if any, shall be issued by
Webster Jackson and a copy forwarded to the complainant no
later than ten (10) business days after its filing.
5 The Section 504 coordinator shall maintain the files and records
of the City of Pasco relating to the complaints filed
6 The complainant can request a reconsideration of the case in
instances where he or she is dissatisfied with the resolution.
The request for reconsideration should be made within ten (10)
business days to Webster Jackson.
7 The right of a person to a prompt and equitable resolution of
the complaint filed hereunder shall not be impaired by the
person's pusuit of other remedies such as the filing of a
Section 504 complaint with the Office of Revenue Sharing,
U S Department of the Treasury. Utilization of this grievance
procedure is not a prerequisite to the pursuit of other remedies
8. These rules shall be construed to protect the substantive rights
of interested persons, to meet appropriate due process standards,
and to assure that the City of Pasco complies with Section 504
and the ORS regulations.
