A RESOLUTION amending Resolution No 1561 and concerning
the activiation of dedicated and leased
channels by Columbia Television Company
WHEREAS, paragraph IV C of the City of Pasco's CATV
Plan adopted by Resolution No 1561 sets forth the circumstances
under which Columbia Television Company is required to activate
additional local access channels, and
WHEREAS, Columbia Television Company is concerned that
the requirements set forth in said paragraph may require
the activation of additional local access channels when such
additional channels are either unnecessary or not desired
by the City of Pasco, and
WHEREAS,Othe Pasco City Council is not opposed to adding
an additional requirement that the City Council be required
to request the additional channel or channels for activation
when it finds it reasonably necessary to do so or to limit
the number of required dedicated access channels, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO
RESOLVE AS FOLLOWS
The City of Pasco's CATV Plan, approved by Resolution
No 1561 and adopted by reference as a part of that Resolution
is hereby amended so that paragraph IV C reads as follows
ACCESS CHANNELS The City of Pasco specifies,
as a minimum, the following selection of dedicated and
leased access channels to be made available when a 54
channel capacity is reached There is no intent to
limit the power of the Grantee to provide dedicated
or leased access channels for use by institutional,
commercial, municipal, or individual users This list
of access services shall include, but not be limited
to (1) Public access, (2) religious access,
(3) leased access, (4) local government access,
(5) primary/secondary education access, (6) higher
education access
Any or all of the above services may be provided on
the same channel, however, additional local access
channels shall be activated at the request of the Pasco
City Council when the above access services result in
the assigned channel(s) being in use at such frequency
as shall cause the City Council to find that the existing
demand for access channel use cannot be reasonably accommodated
on the existing activated channel(s) The limit on
the aggregate of dedicated local access channels which
the Grantee may be required to provide shall be three
(3) in number
