A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PASCO,
WASHINGTON, ESTABLISHING THE SCHEDULE FOR RATES AND
CHARGES FOR CABLE TELEVISION SERVICE UNDER A NON-
EXCLUSIVE FRANCHISE TO BE GRANTED TO MICRO CABLE
COMMUNICATIONS CORPORATION
WHEREAS, the City Council of the City of Pasco anticipates
granting a non-exclusive franchise to allow a system upgrade,extension,
operation and maintenance of the cable television system within
the City of Pasco, and
WHEREAS, Section 11 of CATV Enabling Ordinance No 2428
allows that one of the conditions in the granting of a cable television
franchise may be the establishment by the Grantor, on a not to exceed
basis, the rates and charges associated with cable television service,
and specifies the procedures for the petition by the Grantee for
increase in service rates and charges, and
WHEREAS, MICRO CABLE COMMUNICATIONS CORPORATION currently
dba Columbia Television Company in Pasco, by its acceptance of a
franchise renewal agrees to certain service rates and charges,
and guarantees these charges for a specific period, as a condition
of being granted renewal of the cable television franchise to serve
the City of Pasco
NOW, THEREFORE, THE PASCO CITY COUNCIL DO RESOLVE AS FOLLOWS
Section 1 The Micro-Cable Communications Corporation's
schedule of service rates and charges for subscribers, residential
and institutional, except as modified elsewhere herein, and in
accordance with the City's CATV Plan, shall be as follows
(a) The following rates shall be effective when Grantee activates
and programs a minimum of twenty-four (24) channels, which shall
occur on or before July 1, 1983
(AA) Basic Residential Service

reasonable for the service to be provided

charge

(b) The following rates shall be effective when Grantee activates
a fifty-four (54) channel, two-way plant and programs a minimum
of thirty-six (36) channels, which shall occur on or before
July 1, 1984

(c) All service installations, including converter installation,
shall be waived for residential subscribers for basic service ordered
during the first sixty (60) days following notification of the
resident that such service is available to the subdivision, with
the exception that underground installations will cost $20 00 during
that period
(d) Installation of drops of over 150 feet in length may be
charged at a maximum of $29.95 plus the cost of drop materials
beyond 150 feet for aerial installation Underground drops of
over 150 feet at standard cost plus time and materials for that
portion beyond 150 feet Installation cost estimates shall be
provided in writing to potential subscribers prior to installation
where drops exceed 150 feet

(e) All rates and charges prescribed herein are guaranteed
by Grantee as fixed for a period of eighteen (18) months from date
of initial activation of service
Section 2. All other service rates, charges and/or determination
of same will be in accordance with the specifications and spirit
of the Franchise Agreement which Includes this resolution
Section 3 The Grantee shall coordinate with local media
to see that a comprehensive program guide is made available to
subscribers In the event the media does not make such guide
available, Grantee will make every reasonable effort to provide
printed guides through convenient commercial outlets such as super-
markets and an electronic guide on an available channel or channels
so that programming information is available to subscribers
Section 4 All private and public schools, with an enrollment
of fifty (50) or more students, and city government buildings,
will be provided free basic connection and free basic service for
education purposes, except, however, such users shall be responsible
for converters in the same manner as subscribers
Each city government building shall receive one (1) drop and
one (1) outlet Each private school with an enrollment of fifty

Chosen drop locations should be at reasonably accessible locations
Any additional drops will be on a time and materials cost basis
The City or entity involved will provide whatever easements may
be necessary for Grantee to provide such service
Section 5 There will be no charge or fees for installation
of bi-directional cable drop into city government buildings and
offices for data transfer, facsimile transfer, and other cable
communications requirements when and as requested by the City Manager
Grantee shall have a reasonable time to respond to the City Manager's
request
Section 6 The Grantor acknowledges that federal regulations
pre-empt the regulation of rates and charges for services other
than basic service and that the rates for services other than basic
are not listed herein In the event federal regulations preempting
the regulation of non-basic service charges and rates are removed,
the requirements of Section 11 of the CATV Enabling Ordinance shall
apply to such charges and rates
Section 7 All City, State, and Federal taxes levied upon
gross revenue, including but not limited to, business and occupation
tax, utility tax and copyright tax, are in addition to the rates
set forth in this section and may be shown as separate items on
the subscriber bills.
