Ru stello, C y Attorney A RESOLUTION NO 1553 A RESOLUTION authorizing the City Attorney to institute suit against the City of Richland due to an inadequate environmental impact statement for the Columbia Point Development Program. WHEREAS, the City of Richland, Washington, has prepared and adopted a final environmental impact statement for the City of Richland Columbia Point Development Program which contains the com- ments made by the City of Pasco and other jurisdictions and agencies concerned with the inadequacies of the draft environmental impact statement for said project, and WHEREAS, upon the recommendation of city staff and after con- sideration by the City Council, the City Council has determined that the final environmental impact statement did not adequately address the inadequacies pointed out by the comments to the draft environ- mental impact statement; and WHEREAS, it is the deep concern of the Pasco City Council that the proposed Columbia Point Development Program may have severe ad- verse environmental and economic impacts upon the City of Pasco and that a full and adequate statement of those impacts as well as a full compliance by the City of Richland with the requirements of the State Environmental Protection Act and the regulations that implement it are of the utmost importance and necessity, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO RESOLVE AS FOLLOWS: 1. The City Manager is directed to authorize the City Attorney to commence litigation on behalf of the City of Pasco against the City of Richland due to the inadequacies of its final environmental impact statement for its Columbia Point Development Program; and 2 zin amount not to exceed Fifteen Hundred Dollars ($1,500.00) may be expended by the City Attorney for consultation with private legal counsel of his choice and approved by the City Manager, for the purposes of commencing and maintaining this l]tigation.
